Pursuing a linc of examination de- was engaged in interstate commerce, in_the sense of conducting an inter- state business, Stuart S. Janney, chief counsel for the complainants, drew from Mr. Herrmann an outline of the Interstate circuit of the eight clubs in each of the major leagues and the fact that visiting teams and their re- spective leagues receive a certain per- centage of the gate receipts at the end of each series. Further attempts to show a monopo- listic_tendency on the part of organ- ized baseball were made by Mr. Jan- ney, through examination of Mr. Herr- mann as to the effects of ruiings of the National Baseball Commission, a co-defendant in the present suit, on players, who once suspended or drop- ped from the major leagues through financial or other grievances with their respective clubs, are prevented from plaving with other major league clubs until reinstated by the com- misstor. Under cross-examination, Fdward Hanlon, former baseball player and magnate and owner of the site of the Baltimore club’s bal: park, said that a bail club usually operates at a loss the first vear of its existence and that profits of the future are specu- iative to a_ certain extent. As the Baitimore club played but one year iprier to the peace agreement between organized baseball and the Federal League, George Wharton Pepper, chief counsel. for the defense, seized upon Hanlon's testimony to strengthen the detencé’s contention that the prescnt suit was fnstituied as a means of ob- ning resmbursement for a bad bus- ness venture. New York, June 12.—The market acquired a new lease of life today, primarily on the overnight decision fof the directors of the United States Steel Corporation to declare another “extra” dividend of three per cent. on the common stock for the cur- rent quarter. This action, }insures fuil it is believed. virtually dividend returns of 1 per cent. on the common shares for calendar year. Morcover, it bespeaks the confidence of eminent trade @ thorities in the future of tie steel in- dustry. Declaration of other increased or extra dividends, the whirlwind wind- up of the Liberty loan campaign with its rush of small subscribers and the stability of money rates were addi- tional factors of sentimental value. United States Steel was absorbed in countless lots of 1,000 to 20,000 shares, the price rising steadily to 134 3-8, an overnight advance of 33 3-4 poinfs, and closing at 133 7-8. At its top Steel equalled 13§ 5-5, includ- ing recent dividend ‘payments, and exceeded its previous maximum by a quarter of a point. Bethlehem Stee]l new stock also es- tablished a new maximum at 155 and Industrial Alcohol recorded a similar achievement at 171 1-2, both issues receding at the end. A majority of the other equipments and affiliated industrials rose to highest prices of the year. A general increase of demand was manifested in all parts of the railway diwision, the inquiry Tanging from high grade investment issues to many of the low priced or reorganized roads. Extreme gains of one to over three points marked the trading in these stocks, but these, too, were part- ly forfeited on realizing sales. Shippings, oils, motors, utilities and numerous unclassified specialties par- ticipated in the rise at eross advances one to four points. The only stock to display heaviness was Delaware and Hudson, which lded almo:? three points on litigation involvinzg payment of the next dividend. Total sales amounted to 1,245,000 shares. Yet another low record for rubles and slight easing of lires were the features of the exchange market. Bonds were irregular, a few impor- tant issues tending downwards.
