Dealer in Su Factory Made Harness ( Non<upport Case Ball Game! & - -, James W. MtGrath, a young barber, who had his left leg amputated over two years ago, as a result of diseased bone, the qperation being performed soon after his marriage with Miss Lila May ‘Hall,” was arraigned in the Third district court, before Judge Oli- ver H. Willlams, Friday, charged with the non-support of his wife and two children, the complaint being made for the term commencing on February 16 of, the present year. According to the testimony of Mrs, MtGrath, they were married by Rev William L. Swan in Westerly, Febru ary, 29, 1906, and have two children; one being born July 12, 1906, and the other in July of the present year. The wife had lived with her parents in Westerly since November of last vear, with the exception of three weeks, which she spent in Hope Vall where her husband had opened a bar- ber shop. She said that the only sup- port she had received from, her hus- band since February was $1.50, and that she believed he was able to con- tribute to her support, but did not; that she had never asked iim for the support and that pe had never. of- fered to assist hep during that period. She testified tkat she believed her husband capahle of earning $15 a week and believed he did earn ihat amount when he had a shop of his own in Westerty and that he rece.ved $10 a week while working for another bar- Dben. Her husband had left Westerly to locate in Hope Valley hecause he could get no work here. Mra McGrath’s mother and father test/fied to supporting her and her children and that the husband _did nothing for them since February. John R. Gorton of Hope Valley. a relative by marriage to Mrs. McGrath, gave evidence to the effect that for a time McGrath boarded with him and was doing &, good business, but had left his home owingea bill for board. After that transaction the witness did not take particular notice of the barber's ‘business. Mr. Gorton Interjected a bit of sensati@n in the trial when he stated thai McGrath was frequently seen rm*lg in and out of the .village with 8 Miss Lee, and from appear- anceg had money, and said that on on. turday the barber had earned at his trade the sum of $7.80 James McGrath, the accused, testi- fied that he had alw. ven his wife all the money he had.” He said that his barber chalr in Hope Valley had been attached for debt and that he was out of employment and that it was im- possible for him to get work at his trade In Westerly. He was anxious and willing to support his wife and children, were he able to do so, and bad endeavored to do the best he could for them. The parents of his wife evi- dently did not have the kindllest feel- ing towards him. Judge Williams announced that he would take the case under advisement andtdefer judgment until next Friday, the regular court day Alfred Carson was arrai harge of maintaining a ance in Westerly. The liquors seized at the place known as the Dolly Varden at Charles- town beach were adjudged forfeited to the state and orders issued for their destruction. There were thirty women and twen- ty men at the special meeting of the W-toh Hill fire district, which was in session from 3 to 6 o'clock Thursday afternoon, which was called for the farther. consideration of the purchase of the property in Bay street, with a view to widening that thoroughfare and beautifying the eastern water ap- proach. By legislative act the fire district is authorized to issue bonds for the purchase of the property at a sum not to exceed $50,000, and at a former meeting it was declared that the land could not be purchased, as the amount required was in excess of the limitation to the amount of $1,600. Some one was given to understand that there had been concession made so that the purchase could be made within the lega! li ation, hence the special meeting. Here it developed that instead of the blocking sum be- ing decreased it was increased to nearly §$4,000. As a result there was considerable wrangling, but no defi- nite conclusion was reached. So this matter was deferred for farther con- sideration at a meeting to be held in' the very near future, as it was desired to have definite action before the cot- tage owners left the Hill for the sea- son. There was also long discussion over the matter of carrying surface wat into the bay by pipe line, some co: fusing it as a plan for sewerage, and this caused arguments which reached no definite settlement. It was voted to erect a new firehouse at_an, expense not to exceed $500, the building to be of wood and two sto- ries It was planned to hold agother mecting Saturday evening, and en- avor te settle the Bay street matter.
