County - Attorney A. R. Allen of Martin county issued ecomplaints charging President Townley and Mr. Gilbert, who was then manager of the League organization department, with disloyalty. Sheriff Carver was sent to St. Paul with warrants for the two men, ordered to arrest them and. re- turn them to Fairmont. The public of Martin - county had been worked up with a series of charges of pro-Ger- manism and Attorney Allen thought Townley and Gilbert could easily be convictéd, in this atmosphere. - Sheriff Carver, obedient to his or- | ders, placed Townley and Gilbert un- der ‘arrest. They demanded to be taken before the Ramsey county dis- trict court, in St. Paul, to apply for bail, as was their right. Sheriff Car- ver said he had been ordered to take them immediately to Fairmont. He was urged to consult the attorney gen- eral of Minnesota to learn the law. He did "so and was informed that the accused men had the right to be ad- mitted to bail in Ramsey county. On receiving this advice the shériff took Mr. Townley and Mr. Gilbert before the Ramsey county court, where they furnished bonds and were released. COURT RELEASE DISREGARDED Sheyiff Carver returned to Martin county. He was upbraided by Attor- ney Allen for allowing Townley and Gilbert to give bonds and was ordered to return' at.once, rearrest them ;in spite of the fact that they had been released by the court under bonds, bring them to Fairmont and throw them into jail. ; Sheriff ICarver returned to St. Paul, bringing with him his deputy, John Roepke. He was unable to locate Mr. Townley, but arrested Mr. Gilbert and held him in confinement in a down- town hotel. As Gilbert’s arrest was made in di- rect violation of the orders of the Ramsey county courts, which had or- dered his release under bonds, Gil- bert’s attorneys at once proceeded to sue out a writ of habeas’corpus to release Gilbert. It was several hours before a train could leave for Fair- mont and they confidently expected to secure Mr. Gilbert’s release at once. Instead of waiting for the writ, ~however, Sheriff Carver sent his depu- ty, Roepke, out of town with Gilbert in an automobile. Gilbert was not allowed to learn his destination or route or to communicate with his friends. When the writ of habeas corpus was secured and was served upon Sheriff Carver, some time before the Fair- mont train was due to leave, Sheriff Carver said he was unable to surren- der his prisoner, as he was ordered to do by the court. He was told he must return Gilbert at once. Thoroughly convinced by this time that he had made a serious blunder by following Attorney Allen’s advice, in the face of court orders and the in- structions of the ’attorney- general, Sheriff Carver sent a telegram to his deputy, ordering him to return at once with Gilbert. Deputy Roepke paid no \attention to this telegram, but caught the Fairmont train south of St.: Paul, took Gilbert to Fairmont and threw him into jail, where he remained over night. : ; " The Minnesota statutes provide a remedy for a man illegally deprived of his liberty. for a recovery of $400 on the part of the injured party. sy Suit was brought against Sheriff .Carver to collect this amount, and the county attorney made a desperate at- tempt to have the suit tried in Mar- tin county. = - . With the failure of this attempt the ‘sheriff made the offer of settlement noted and pleaded that the full penalty of the law would be a hardship on hin;.
