THE COURTS. Condition of the Steamer Adelphi’s Boiler When It Exploded. UNAYAILING SACRIFICE. A Sexton Who Would Be Happy if He Told the Truth. Although the particulars of tho terrible explosion of the boiler of the steamer Adelphi, off Norwalk, Conn., on tho 15th of,last September, have been re- peatedly published in the Hematp since the fatal casualty, still some novel snd interesting facts havo been already developed in the trial before Judge Barrett, in Supreme Court, Circuit, of the suit brought by James’ Leonard, administrator of Sarah Leonard, his sister, one of the unfortunate victims of the accident, against the Colum- bia Steam Navigation Company tor $5,000 damages on account of her death. The court room was crowded yesterday, @ number of prominent steam- Dost men being among the throng in attendance. For Mr. Leonard the counsel are Christopher Fine and Leopold Turk, of this city; and General Taylor, of Norwalk, Conn., and Mr. Dennis McMahon appear for the defendants. On the opening cf the court quite a lengthy discussion arose on the question whether the action is properly brought in this State, there being in Connecticut a similar statute tw the one under which the suit is brought here. Judge Barrett held that the objection interposed to the bringing of the suit here was not well taken, and ordered the trial to proceed. ‘After a brie? opening by Mr, Fine, reciting the par- ticulats of the disaster and the killing of Miss Leonard, und the facts he proposed to prove, showin, that the accident was, as he alleged, the result 0} culpable ne negligence, Mrs. Jane Leonard, the mother . was called to tho witnoss stand. She simply eecntised that her daughter lived with her up to the time of the accident, and gave her version of what she considered her services as such daughter worth. tort Lane, the next witness, was) on the Adel; at the time of the explosion, and iden! fied ‘Miss Leonard ar one of the persons fatally injured. ‘The most important witness during the day was John Golton, a practical machinist and engineer, He stated that he examined the boiler of rng Adelphi after the explosion, and found it ‘at the place of the explosion only ‘One-siXtecnth’ of on inch thick, whereas it shouid have been three- eighths of an inch thick. He stated further that there were nine patches on the boiler; crown sheets had fallen down through overstrain; that the boiler was not in a fit condition to use; that with the boiler at its best he would not have given a certificate allowing more than twouty-six pounds to the square inch, whereas at the time of the ex- plosion the pressure was thirty-eight pounds to the square inch, Mr. Hill, inanager of the Nor- walk Iron Works, who algo examined the boiler, vorroborated the testimony of Mr. Colton. He ex- plained the difference between the government rulos tor testing steam boilers and those laid down by Mr. Haswell. The government, he stated, tests the strength of a boiler as a solid sheet of iron, without allowance for joints and rivet holes, while Haswell’s theory tests the strength of the iron in boiler form, claiming that the rivets woaken the iron.and that the boiler can never be stronger than at its weakest joints, where the laps and rivets are, According to the Gyverament. rules this boiler, in his opiuion, should never have been allowed @ pressure over thirty-six pounds to the square inch, and under the Haswell rule not over twenty-four pounds, ‘The trial will probably occupy several days, It is stated that experts will be called by the defence to coutrovert the testimony of the experts examined on the plaintift’s side, FORGING A POST OFFICE ORDER. ‘The trial of Jamos Morris, in the United States Cir- cuit Court, before Judge Benedict, for forging Post Office money orders, resulted yesterday in a convic- tion. ©, M. Cady, the complainent, and Officet You- mans, of the Post Office Department, had testified on Monday to an acknowle¢gmopt by the prisoner that he had committed the crime. The defendant claimed that he made the confession under threats from Officer Sharretts that. unless he did so the young woman to whom the- prisoner was betrothed and whose name had been indorsed upon a! check would be arrested and sent to prison. The prisoner also testified that the officer promised him- immunity from punishment unless the money orders should prove to have been stolen from the Post Office Department. Undor this uncontradicted testimony a motion was made to have the confession stricken out on the ground that | it was not voluntary. This motion was denied. In summing up H, W. Sackett, counsel for the prisoner, directed the attention of the jury particularly to tho uestion whether the confession was true. When it arrested, it was argued, that the prisoner, when confronted with the forged post office money orders and the check with the name of his betrothed in- dorsed upon it, told the truth, that he explained from whom he’ received them and under what cir- cumstances; that when the officers returned from their search after the real offender and without finding him, then the prisoner was told that unless he acknowledged the forgery him- the young woman would be sent to prison, and that to save her, knowing that they both wem innocent, he took upon himself the offence and said that he committed it. The trial of Cohen Davis for perjury was re- sumed yesterlay in, the Court of General Ses- sions, before Judge Gildersleeve, When tho acoused was examined as a witness on the triat’ of Abraham ‘Freeman and Charles Bern- stein on the charge of atsom—both prisbnezs ‘being then convicted and sentenced to be imprisoned for life—he testified thet on the night of the burning ho saw Freenton in his own house, the occasion being the birthday of his child, The evidence for the pros- ecution, however, showed that Freeman was one of the three men who fired the tenement house No. 11 Ludlow street on the night of November 11 last, avd could not, theretofe, have been at his own home as sworn to by the witness Davis, ‘The latter is an old man living at NO. 76 Eldridge street, following the business ot a glazier and ofticiating also as the sexton of the Shy e Street Synagogue. The penalty is rom five to twenty years oa State Prison, “AN HONEST “MISTAKE,” ‘The trial of the auit brought by Bridget Tormey against the city to recover $10,000 for gamayes aus- tained by being taken from her home in May, 1871, and sent to Blackwell's Island on the alleged ground that she had the smatipox, when in reality her com- plaint was only measles, was concluded yesterday before Judge Daniels, holding Supreme Court, Circuit. The plaintiff's story, as will be remembered, Was that on May 30, 1871, two mon called at her honse “ooking like laboring men.’ insisted that she had paper the smallpox, and in spite of the remonstrances of herself and husband, put her in the ambulance and carried her to Bellevue Hospital; that upon her ee rival there the oatony. on duty examined hi and decided that she had measles, but as she had been committed by Cate ay hed of Health as a small- ox patient, suid no wer to ict her go, came a husbs offered to take her home with him, and that she was then sent to Blackwell’s Island, where she was kept for ten It was contended that she was thus taken from her home with- out any pretence of an agra ae noo Yee sicians, as the law required, Board of Health, it was insisted that ‘tn is formality had been complied with, and evidence was intro- duced tending to show that Mrs. Tormey’s own physician had reported the case as smallpox, and that one of the “two laboring men” whom Mrs. Tormey described was the late Dr. Watts, who at that time was detailed to with the ambulance, and kept a suit of od clothes for such service to save his fay Mart ress from infection. It was, therefore, contended that there had been only an honest mistake in diagnosing tho diseasc as smallpox, which in its eariy stages fre- uently simulates measles. Upon the conclusion of e testimony for the plain’ a motion was made : for a dismissal of the complaint, on the ground that the city was not responsible for the acts of the Board of Health or its employés, nor for those in charge at Bellevue and Blackwell’s Island, who were the servants of the Commissioners of Charities and Cor- rection. On the 17th of May, 1867, Peter Gruber made his will, he then being the owner of both personal and real property in this country and of real estate in Germany, all of the value of about $75,000, When he made this will he had a wife, Fredericka, and his love for her, not only before but after death, seems to have been the disturbing element in his otherwise tranquil will. To his “beloved wife” he gave all bis property in trust, to be used by her during her natural life, provided she remained unmarried, the remainder to his heirs-at-law. Snould sho, however, a she was to forfeit not only her trust but also her right of dower. She was made executrix of the will. A suit was brought jn the name of Péter Gruber,an infant son of the deceased, to ob- tain an interpretation ot the will as to what property under it passed to the executrix in trust. Sessions yester- day the case of John Smith, who is indicted for kill- ‘ing Henry Madden, a sailor, on the 23d of last Janu- ary, was called for trial. McDowell and others was argued ref a y on an appeal from a judgment at 8 rin refusing to enjoin the defendants from t! mublication of a bond given to them by, plaintiffs, which bond acknowledged de- fendants’ right in a trade mark and bound the plain- tiffs under a penalty not to dispute it. The claim made by the plaintiffs was that they had still a quasi property in the bond, similar to eR, | 8 erty in a letter, and, although deliver it was only for a certain purpose and could not be made public conti to plaintiffs’ wishes.
