The conundrum, What shall be done with John alias “Red” Leary ? is still puzzling the courts, The lawyers propounding the conundrum, not sstisfied with bewildering the brains of thejudges of the State courts, took the case to the United States District Court. The lattor court has courteously refrained from giving its answer to the conundrum pending the decision of the Supreme Court, General Term, from the decision of Judge Davis dismissing the writ of habeas corpus taken out on his behalf and stay of proceedings granted by Judge Donohue on a writ of certiorari. As is well known, Leary is charged with being im- plicated in the Northampton Bank robbery, The case came up yesterday for argument on this appeal before Judges Brady and Ingalls, Leary being rep- resented by Messrs. As a trial of the suit was commenced yes- terday before Judge Daniels, holding Suprgme Court, Circuit, an epitome of the complaint is worth giving. On May 27,1871, Mrs. Tormey, who then resided at No, #& First street, was taken sick with the measles. One of the physicians of the Board of Health pronounced the disease smallpox and at onco had her remoyed to the smallpox hospital on Black- well’s Island, Here she was examined by the attendant physicians, who pronounced her disease measies. It seems, however, that the latter physician, in con- sideration of her having been sent there by the Board of Health, wonld not assume the responsibility, sl- thongh both Mrs. Tormey and her husband urgently desired it, to send her back to her home, but, sick as sho was, compelled her at a late hour of the night to walk a long distance through wet grass to another hospital on the Island, where she was kept several days. Upon this state of facts Mr. ‘Tormey brought asuit poe tho city for $10,000 damages. Under these circumstances and to shield her he acknowledged himself responsible for the act, end before this, upon héaring of Anderson's connection with the matter, immediately left his employ. A decision was rendored yesterday in the United States District Court by Judge Choate in the matter of August May and Aaron Berwin, bankrupts, on a motion to ae a proof of debt filed by the as- signee of the bankrupts against the individual estate of Berwin. The partnership was begun in 1864, and went into bankruptcy in 1872. Some time previous to this mit $47,000 was placed at the disposal of the firm, but im an account with P. Berwin & Brother, of which Aaron Berwin was a member.
