SUMMING UP IN THE ARSON TRIAL, Cost of Administration of Justice in a Criminal Court. The laces that formerly comprised 4 portion of the wardrobe of the Empress Eugénie—or, rather, a por- tion of them—was the subject of a litigation yeater- day in the Supreme Court, It will be remembered that it was charged that these laces were smuggled with a view to avoid payment of Custom House duties and that they were seized by the Custom House authori- ties, which seizure resulted in a lengthy litigation in the United States Court and finally terminated ino dismissal of tho proceedings. A laco dress and 4 laco shawl, forming a portion of the laces in question, came into the possession of J, Warren Lawton, who, through Colonel Townsend as agent, attempted to sell them, It is stated that an effort was made to induce various prominent ladies on Fifth avenue to purchase the same and donate them to tho Metropolitan Museum of Art; that this project fell through, and that then it was sought to have them put up at raffle at the late fair at the new Cathedral, This latter scheme, it soems, also failed, und then followed sssiduous efforta to dispose of the laces at private sale, ‘This brings us to the present suit. Mr. Lawton cleims that the laces were sold to Miss Anu Leary for $5,000; that after making the purchase sho refused pay- ment; that the laces were then sold to A. T. Stowart & Co. for $3,250, and that he is entitled to $2,000 from Miss Leary, covering the difierence between the original price for which they were sold to her and the price for which they were sold to A. 'T. Stowart & Co. and $250 expenses incidental to the transaction. The case came to trial before Judge Lawrence, in the Supreme Court. occasion brought into the court room an assemblage of representatives of fashionable society in this city rarely witnessed in our courts. Colonel Lownsend was the principal witness for the plaintiff. He testified that he re- ceived # note trom Mrs, General Thomas Francis Meagher, stating that she had a purchaser for tho laces, which purchaser was Miss Leary; that after various negotiations he sold the latter the laces for which she ugreed to pay $5,000. Mr. Libby, of A. T. Stewart & Co., testified to tho sale of the laces to their establishment for $3,250, Miss Leary was the leading witness on hor own behalf. She denied most positively the purchase of the laces.
