A CAR CONDUCTOR'S TRIUMPH Abnormal Anxiety to Secure Large Houses at the Theatres. A motion was made yesterday by Judge Ditten- hoefer in the case of the United States against W. K. Porter, indicted for sending lottery circulars through the mail in violation of section 389 of the Revised Statutes, to quash the indictment on the ground that it did not set forth the circular so that the Court could determine on inspection that it was a circular concerning lotteries, Mr. Dittenhoefer said that for aught that appeared on the face of the indict- ment it might have been a circular warning people against the purchase of lottery tickets, or a circular in reference to a raffle at achurch fair, He cited the case of Hallenbeck vs. The People, in 2 Ab- botts, in which Judge Westbrook, in quash- ing ‘the indictment, held, on an indictment for selling ol matter, that though the rnledid not require that the records of the court should be polluted by spreading the obscene stuff on the records, yet it was necessary to state in general terms the nature of the matter, and also the decision of the House of Lords to the same effect in Brad- laugh “fer the Queen, Bradlaugh having been in- dicted for publishing a book on the ithusian theory which was complained of as being obscene. Assistant District Attorney Butler cited in answer some Maine and huretts cases and criticized Bradlaugh against the Queen. Judge Benedict in giving his decision said that while he was not yet pre- pared to say that in sending obscene matter through the mails he would go as far as Judge Westbrook, yet in this case there was no reason for failing to set up the lott circulars in the indictment, and therefore, he grant the motion to quash the indictment. With this indictment fall many other indictments on the calendar in the Court. INTERESTING TO CAR CONDUCTORS. There was commenced in Part 2 of the Marine Court, before Chief Justice Alker and a jury, yester- day, a suit brought by Thomas Maher against the East Broadway, Dry Dock snd Battery Railroad Com- pany to recover $59. Of this sum $50 was deposited with the company by the plaintiff at the time ho took service as conductor with the company, and the $9 wae for wages due at the time he was discharged, The defence of the company was that by an agreement entered into by Maher at the time he became conductor he was to forfeit the $50 deposited if it should be found he had by fraud, negligence or incapacity deprived the company of any passenger fares to which it would otherwise be entitled; that he had been dis- covered on various half-trips of his car, on various days, to run short from one to seven fares, and that thereby his balance of pay and the $50 deposit be- came forfeited as liquidated damages to the com- pany. Maher was tried in the Court of General Ses- sions for embezzlement and acquitted, and this case is practically a retrial of the ue decided there, Mr. Douglas A. Levien appeared as counsel for the plaintiff and Mr. John Scribner for the defend- ant, and, on motion of the former, the Court decided the defendant was bound to prove affirmatively that plaintiff had violated his contract. The case is still on trial. SELLING BOGUS THEATRE TICKETS, Some weeks ago Louis Oocrtricher, of No. 22 Chat- ham street, bought what purported to be two tickets of admission to Gilmore's Garden. The applicant was, however, refused admission, the tickets being counterfeits. Detective McNaught took into custody the man who sold the tickets while he was engaged in celina pling bog tickets of admission to the Bowery hen arrested he represented himself as ies the Macao, of No. 133 wery. When first arraigned before the Police Magistrate he admitted to having been arrested on « previous occasion for sell- ing bogus tickets of admission to Wallack’s Theatre. ‘The prisoner wee arraigned for trial yesterday in the Court of General Sessions, and p guilty to ob- taining money under false pretences. He was sen- tenced to the Penitentiary tes ean tae months. REV. MR. M’CARTHY'S LIBEL SUIT. Betore Judge Van Brunt, holding Supreme Court, Circuit, there was resumed yesterday the trial of the suit for libel brought by Rev. Charles P. McCarthy against Rev. Edwin 0. Sweetser. The examination of the plaintiff was continued at great length in the court,in which he gave ajdetailed account of his clerical troubles in connection with the efforts to permanently ex him from the New York State Convention of Universalists upon fonce gr preferred by Mr. Sweetser, which cha: the basis of the libel suit. After his examination several members of the Third Universalist Bleecker Street Church gave their testimony on behalf of the plain- tiff, After the prosecution had rested a motion was made to dismiss the complaint, on which ensued a lengthy argument by the opposing counsel. Judge Van Brunt granted the motion, ng that there was no evidence that Mr. Sweetser published the charges, to send them to the State Convention. He held “that *yoth being members of that corpora tion Mr, Sweetser, under its rules, had a right to pre- fer his charges, and that until such charges had been sustained on a trial the present action could not be maintained, having been pm pooucnturely, brought. INDICTMENT FOF FOR MURDER. John and Francis McKenna, who were proprietors of a liquor saloon in Mulberry strect, were called to the bar in Part 1 of the Court of General Sessions yesterday, charged with the murder of William B. Wilse, whose death occurred in a shooting affray. Assistant District Attorney Lyon requested that the accused, who, he said, had been relessed on $2,500 bail by the Coroner, be committed without bail in view ot the fact that the Grand Jury had found an in- dictment against them for murder in the first degree. Counsel for the accused objected, but, after some dis- cussion, Judge Gildersleeve decided that they be com- mitted nntil he had an opportunity to investigate the facts of the case. DR. BRADFORD'S CASE. In the case of Orlando E. Bradford, who was con- victed of malpractice in having caused the death of Victoria Conners, counsel for the accused stated in the Court of General Sessions yesterday that in mak- ing s motion to-day for a new trial forthe prisoner he would produce the woman who actually com- mitted the crime on the deceased. He added that this woman would make the startling confession that she perpetrated the criminal act in faa ie, and would a produce the clothes of the dead girl in sup- port adinission. Willis Angel, receiver of the Belmont and Buffalo Railroad Company, brought asuit ageinst George yg dyke and others, former officers of the company, to recover thirteen bonds of the town of Hume, in Alle- ghany county. In that case, as wellas in this and the two which follow, the government maintains that under the sixth section of the act of July 1, 1862, it is entitled to five per cent of the net earnings of the several divisions of the Pacific railroads from the dates of their respective comple- tion. In the cases of the Union Pacific and the Denver Pacific the government sets up this claim ass in the way of an offset against suits brought to recover payment for transportation services while in the cases of the Central and Kansas Pacific companies it sues directly for the five per cent clauned. The defences in the several cases are similar. In October last 8 joint meeting of the Brooklyn Board of Health and the Health Committee of the Board of Education of that city was held with s view to considering the best method of guarding against the spreading of contagious diseases among the pupils in the public schools, No definite plan of procedure was adopted at the time, however, and as the Board of Education appeared slow to act in the premises the Sanitary Superintendent, Dr. Raymond, has taken the subject in hand.
