THE CHARTER OAK TRIAL. CONTINVED OBJECTIONS TO THE TESTIMONY FOR THE STATE—MR. FURBER DEPRECATES THE SHUITING OUT OF EVIDENCE. [BY TELEGRAPH TO THE HERALD.) Hanrvorp, Conn., Dee. 11, 1878. The Charter Oak Insurance Company conspiracy trial dragged wearily to-day, the prosecution making carnest efforts to get in a8 evi- dence testimony that was continually and Benerally successfully objected to by the defence. Many of these matters were mere details of transfers of the company’s stock, &c. Yet as they came under the rules as to inadmissibility the de- fence stood upon their legal rights and interposed pbjections. Ex-Governor Marshall Jewell was called for the prosecution to prove that ex-President Wiggin, of the Charter Oak, had a contract with the company under which he was to receive a large salary and commission, the contract being substan- tially similar to the one made with Vice President White, which has already been put in evidence. Mr. Jewell testitied that he had a@ conversation with Wiggin regarding this contract about a month after Wiggin had left the com- pany. The Court sustained the objection of the de- fence that no testimony could be put in of admissions dy one of the alleged conspirators a month after the conspiracy had ended, and further remarked that ad- missions as to the contract could not be regarded as good evidence, A STOCK TRANSACTION. Daniel Phillips and Nelson Hollister, who, during the palmy days of the Charter Oak were large stock- holders and both on the Board of Directors, testified that they sold their stock to Furber and Wig- gin, and that subsequently cach bad ten shares transferred back to them, enabling them to continue as directors. The prosecution Interrogated Hollister pretty Stesply on the pos- sibly suspicious circumstance that he sold his 340 shares of stock in October, 1875, for $22,000, or $115 share, to Furber, and that he appears not to have Bea the use of the money until the following March. Hollister settled the question promptly by explain- ing that Furber gave him a draft on W. A. Stephens & Co., of New York, and that he drew the ymoney by check some weeks later, As Treasurer of the Connecticut Valley Railroad Company Hol- litber admitted signing the million and Sqparier second mortgage bonds which were taken by the harter Oak Lusurance Company; but after handing them to Walkeley, who was president both of the railroad and the insurance company, he had known wothing further regarding them. ADVERTISING A FALSE RETURN. W. H. Goodrich, business manager of- the Hartford Courant, was summoned by the prosecution to prove the publishing by the defendants in the spring of 1876, as an advertisement, the annual statement of the company for the year ending December 81 previous, in which, it is alleged, the ‘and were overvalued for fraudulent purposes and to deceive the Insurance Commissioner and also the {public. One reason for the attempt of the prose- cution to get this advertisement in evidence that it was signed by Fisher, Wiggin White, and a failure had made of the attempt yesterday to get in evidence the report itself as sent to the Insurance Department. The de- fence objected to this advertisement as inadmissible, and the question was argued for an hour or more, On its conclusion the Court reserved its decision. MR. FURBER ADDRESSES THE COURT. C. H. Castle, principal bookkeeper of the Charter Osk Company, was called to testify to the ac- count between the company and Furber, as its financial manager. Witness produced a transcript from the ledger, to which counsel for the defence proceeded to make strong objections, when they were interrupted by one of the accused. . Furber, in a voice marked by great carnestness pnd some traces of excitement, addressed the Court, saying that he had no objections to placing the per in evidence, for he had no question that | ai other than a correct record. THE CHESTERTOWN MYSTERY, | @ONCLOSION OF THE EVIDENCE IN TRE MARY- {°%aND SCANDAL, CAKE--A VERDICT OF Ac- QUITTAL. (BY TELEGRAPH TO THE HERALD.) NewcastLe, DeL, Dee. 11, 1878, The Dodson trial was continued this morning ‘by the examination of additional witnesses for the defence. Mrs. Eliza Howard, colored, testified ‘that she lives with her husband on Mr. Dodson's farm, and they both work for the Dodson family; on the Friday preceding the alleged shooting of Jones she was whitewashing with Mrs. Dodson, when ‘her son James complained to Mrs. Dodson that Jones told the master that he was idle, and he Pevengefully informed the lady of the stories Jones had told his mother and step- father concerning the young ladies. She then corroborated her son’s statements to Mrs. Dod- son. On the Monday night following Jones left the Dodsons, slept in their house and went to Chester- town Tuesday morning, at noon of which day she saw Jones brought back to the farm by Mr. Dodson and Philip Vincent, to whom he repeated his story of burying the babies. ‘They ull went in the carriage to the bank of the creek, ‘where Jones dug for the bodies, but not finding the ‘was reconducted to the house, when he admitted that his stories were | He was then whipped, tied ‘and locked up. A BAD REPUTATION, Several witnesses who had known Jones for a num- ber of years, and one who waé acquainted with him opted Ny deposed that he was a notorious liar and they would not believe him on his oath. Another host of witnesses testified to the hitherto unblemished character of the three prisoners. SUMMING UP. Both sides having rested their case Deputy Attor- ney General Robinson opened for the State. Messrs. ad and Gray replied for the defence and were fol- lowed by Attorney General Pennington, who closed the argument for the people. ‘THE CHARGE TO THE JURY. The Court having alluded to the gravity of the charge said that it should be most carefully consid- ered. There was no doubt that Jones was shot and strangely escaped death. His statements up to seven o'clock were fully corroborated. The evidence of the ‘witness for the proving of an alibi for the prisoners ‘was entitled to full weight, andthe jury should de- ide on the evidence alone. NOT GUILTY. The jury retired and were out abont forty minutes Teturning with a verdict of not guilty, whieh w: received with alight ripple of applause. The pi oners were immediately discharged. The jury arrived at their decision at the first ballot. This concluded cases of the present term of court. AN ATROCIOUS MURDER +h BOY OF LAW WITH A KNIFE. (BY TeLeGRarn to THE HERALD.) Bostox, Dec. 11, 1878, A brutal murder occurred at South Boston to- night. Edward Donovan, eighteen years old, stabbed his brother-in-law, James H. Fox, twenty- six years old in the stomach.
