Tne story of Mra. Noe briefly recapitulated is to the effect thas her father, the late William H. Morss, died | some yeare ago, leaving to her a largo properiy tu real and personal estate, ihe possession of which was » tramaferred to her by the executor on her arriving at age; that such property amounted to about $70,000 personal and sone $200,000 real estate; that about a year previous to coming into possession of her property she was married to Mr. Noe; that shortly after such marriago she was induced by her husband to convey to him all her prop- erty; that thereupon her young -husband who at the time of her marriage, she saya, was only worth the clothes on his back, proceeded to sell aud mortgage the property, apd im the course of three visite to Paris squandered nearly all of it in gambling, riotoas living and in association with lewd women, and that all that is now loft of her original estate are two houses and lots on Grand street and one on Twenty-first street, which are mortgaged to nearly their tuil value, NATURE OF THE SUIT. The suit isto restrain Mr, Noo from disposing of this allogea smal! remnant of bis wile’s property in any way and for the appointment of a receiver, or, in other words, that the Court intervene to prevent tho squandoring of this littlo residue by ber husband, and | hat {ull title to the same vo given to her so to afford ber a small income upon which to live, 8 being now, as sho alleges, wholly destitute of any othcr means. A temporary injanc- | tion was granted, and the case came up yesterday be- fore Judge Westbrook, in Supreme Court, Chambers, ‘on an order to show cause why such injunction ehouid not be continued. Quite a different state of facts from that given above appears in tho answering afidavit of Mr. Noe, His story, briefly told, is a flai-iooted denial of most of tho | allegations contained in the complaint of his wite and | charging bis mother-in-law with beizg the boad ard the front of the present proceedings against | him. After recounting the circumstances under | which bo first became acquainted with Mrs. Noo | he says that in asbort time they entered into « mar- riage cogagemont ‘The mothor of Mrs, Noo refused to sanction their engagement, They resolved on a secret marriage, und were united by Rey. Mr. McAilis- tor, pastor of the Allen Street Methodist Episcopal Unureh, This marriage was kept secret nearly a year, when it was deemed advisable to injorm the mother of 4. The latter, instead of forbidding them the houso and threatening all sorts of vengeance upon them tor their rashness, acquiesced with u cordiality that wi entirely unexpecied. A WIFE'S PRESENT. In this connection in the course of his narrative Mr, Noe takes occasion to state that previous to his marriago with the plaitif® he did not know that sho ‘was un beiross to x large property and in fact did not trouble himself with any inquiries iu the matier, He | was not then twenty-one years of age, bad alway lived | with his parents, who wore wealtiy. und monotary considerations did not enter at all into the matri- monial scheme.
