Luthey, for $1,041 56 for assault and battery. The alleged assault ‘was tho result of efforts on the part of the defendant to eject plaintiff from his house, the privileges of which he had previously forbidden her. The defendant's counsel filed the neceasary bond on appeal, but recited. therein that the judgment was entered on the 18th, in- stead of the 19tn of April, For this detect the bond ‘Was returned by piaintifl’s counsel, who proposed to proceed us if no appeal had been taken, the timo to Ue ® new bood having in the meantime expired. Applica- tion was then made to Judge Sinuott, in Marine Court, Chambers, on the part of defendant, asking for an ex: tension of time in which to tile a pew bond. McCready vs, The State of Virginta,—Error to the Court of Appoals of Virginia, and one other case.—In tis case it is decided that the State of Virginia can prohibit the citizens of other States from planting oysters in the beds of udewaters within her jurisdicuon, while permitting her own peo- ple to do so, For the purpose of the ownership of the Udewaters and their beds it 18 said that the State rep- resents the people and the ownership is that of the people in their united sov ity. The title thus held 18 subject to the paramount right of navigation, the regulation of which in respect to foreign and interstate commerce has been granted to the United States. There has, however, been no such grant of power over the usherics.
