NEW YORK HERALD, WEDNESDAY, APRIL 25, _1877+TRIPLE SHEET. : LIFE INSURANCE LITIGATION. FLEETWOOD PARK. PORT OF NEW YORK, APRIL 24, 1877. | Seren senate conan, Gaeta, Sve | wee We tent ee Sa a pee niten 1p ell th her stanchions aud bulwarks, and was otherwise damaged ohuson Pawtacket; Uri: hd javer: MR. ORACE THE CONTINENTAL'S RECEIVER— | OPENING OF THE TROTTING SEASON—VICTOR ABRIVALS, ton made for Norfolx where she arr on the cemign Sage atte WHAT ME, WILLIAM ALLEN BUTLER SAYS OF HIM. Its generally believed that William R. Grace will ‘be retained ag receiver, and that 1t would be injurious to the interests of the policy holders of the Continental it he should be set aside to make room for 4 new ap- pointee, in view of the fact especially that be bas slready mastered all the difficulties of tbe situation, He is now the receiver of the cumpany for New Jersey. and bas begun several suits im various parts of the country on bebaif of the policy holders, which would in all probability be damaged to some extent by beimg handed over to a new party who would have to make himeelf tem/liar by weeks of labor ‘with their intricacies before being “ble to prosecute properly. Mr, William Allen Butler, 10 his able report ‘as referee, a portion of which was published in yester- @ay’s Hxratv, gives convincing proof that it would be to the best interests of the policy holders that Mr. Grace should be retained as receiver. Mr. Butlor says sbat upon the examination made and the ovidence ad- auced by him he found that the assets in the hands of the present receiver, Mr, William I. Grace, are sale, ‘und that they have been thus tar, and, jo lis judgment, ‘will, go long as Mr. Grace is continued in office, be prop- erly and judiciously managed; that the trust reposed im bim will be fathfally executed; that he has col Mmenced numerous and important actions to enfe the rights of the policy holders, which it was bury 10 commence witbout delay, and which we his (Mr, Butler's) judgment, properly brought and t to be prosecuted, and that Mr. Grace is engaged Jn the active and serviceable discharge of the duties of his office in a manner which will secure to the policy holders for distribution at the earliest possible mo- ment, and from time to time, all that cun be realized from the assets and from the enforcement of existing other part of his report Mr. Butler says:— resent receiver cannot be expected from choice risk, a struggle as to his wit coepted in aid of the policy holders aud under the sanction and at the request of the Court exercising its jurisdiction, when invoked on their behal!, for the purpose of securing their rights, Bo far as the receiver 1s personally affected 1 might ‘well recommend him to ask to be relieved trom a trust beset with such embarrassment, But his pos- session is that of the Coort of which hois an officer, and his trust relates to property of the policy holders who are entitled to the protection of the Court. If their interests are to be regarded as of primary importance their property 1s now under safe and competent inan- ent, and on their benall it may properly be urged ir interests will manifestly be best subserved if ‘that th the title of the present receiver and the acts done by ppointment in the 80 as not only to ceasity or inducement for tarther litigation title, but also to avoid any controversy or Interest Xpense to the fund atten $s transfer to a new receiver, It is very plain in ‘view of theso suggestions aud convictions of the fit- ness of Mr. Grace as receiver of the company #0 tersely expressed by Mr. Butler, that it would be a decided injury to the policy holders to put a now man au bis place at the present crisis of the company’s affairs, tis rumored, however, that eflorts are being exerted by a certain clique to put some person in his Jace Who will better sudserve interests that are, if not Inimical at loust, not advantageous to the policy "a, whose hopes ir mone; D were made light by the appolotment of Mr. pissed atching with a jealous eye every move made to deprive them of their rights, REPUDIATING A POLICY. About a week since therc appeared in the Heratpa report of the suit pending in the Supreme Court, in this city, between Mrs, Alice Chamberlin aud the American National lite and trust Company'of Hart- ford, The suit isto recover on a policy on the life of Mrs, Chamberlin’s deceased husband for $10,000. The eriginal insurance was in the National Liie Insurance Company of New York, but that company, getting into the hands of a receiver in 18° its assets were trans- ferred to the defendant in this case, by which the original policies, includiag Mrs Chamberlin’s, re- insured, ‘To Mrs, Chamborlin’s complaint this were re- insuring company (which has itself since transferred its assets to a company in Wasbington) made {rode that they bad been induced to reimsure er policy by misrepresentations as to the nature and amount of the assets of the company in which she was originally reinsured, and us soon became aware ‘of that fact they repudiated ail those reinsured policies, including bers, and do now repudiate them. ut note withstanding sucb alleged repudiation, of which Mrs. Chamberlin had no notice, they continued to take her premiums, These premiums, the answer says, have been kept in a separate or trust fund for tbe benefit of the policy holders. A motion was made be- Jore Judge Donohue, yesterday, on the part of dirs. berlin, for jeagment on the defendant’s ansi br the ground that it 1s itivoious. ‘This motion Jadge has denied, thus ing the cause to take th fasual course of trial, THE STATE CAPITAL, Aupayy, April 24, 1877. Mr, Woodin next moved to recomimut with instruc. Slons to strike out the appropriation of $25,000 tor the support and maintenance of juvenile delinquents at the New York Catholic Protectory. Mr. Gerard said he bad heard from many sources that tbis institution Is of bigh character and great uselulness, and if this Appropriation ig to be used for the purpose stated it fame within the constitution. Mr. Bixby said it cared lor none others than those committed by the officers of She law. Mr. Harris said he understood that the in- Btitution did not receive juvenile delinquents as within the meaning of the constiiution. ‘The chiidren taken were those committed jor idleness and vagrancy, but when the President of the institution was belore the Financial Committee he was asked if they received those convicted of felony or crime, and he said they did not. This was what he (Mr. Harris) thought was the meaning of the term “juvenile delinquents.” Reading trom the Laws of 1847 in substantiatico of bis view, he said that by law algjuvenile dennquents must ent either to the House of Refuge tor Juveoue Delnquents on Randall’s Island or to the Westera House of Refuge at Rochester. He did not speak against the instituven or its work; it was doing a noble work, but it was’ not wor and did not appeal to our sympathies, ir, Hammond said he would be glad to vote tor this @ppropriation 11 1s wero evident that it was forthe pport of juvenile delinquents; but it appears that by jaw they cannot recvive that class of persons, He read from the charter of the instituuon, showing the pur- poses of its incorporation and the laws tor the com- — of juvenile delinquents Thiet, he thought, was rely constitutional question and he must be ‘0 ded with that view, The motion to sirike out was lost. THE DEAP MUTK INSTITUTION. Mr. Woodin moved to reconsider the vote by which tho appropriation in favor of the deat mute institution at Rome was refused, Carried. The motion to ap- Propriate was thea put and adunted, The bill was recommitied and retained in the order of third reading, to be resumed this evening. RANDALL'S AND WARD'S ISLANDS, Mr. Prinee introduced a bill to change the bulkhead Jines of Randall’s anda Ward's islands, und to prevent the creation of a nuisance by filling in the area between the buikbead lines, It authorizes the Board of Police ol New York city to cause the street cleaning materiul to be deposited in the waters of Little Hell Gate to within one toot of the taco of said waters at high tide, und the area so filled to be immediately covered with cleaw ashes and clear, sound celiar earth or sand to tae depth of two feet above tide water. Now he says he cannot do it, because he 18 connected with an athletic club. Athletes, as a general rule, favor gympastics of all kinds, and tho fact that he falls back upoa so poor and filmsy a protext proves that he is afraid to meet me. To give Dim another chance, | renew my offer to meet him in a glove contest for $1,000 a side, at any place he may name, six weeks after he bas put up his money. I will deposit my $1,000 with the Farmers’ Loan and Trust Company either Weduesday or Thurs- day next. If be doos not accept this I repeat my pre- vious advice to him to cease issuing challenges, P. J. KELLY. TRAGEDY IN BROOKLYN. TO MILLER. 4 MAN SHOOTS A POLICE OFFICER AND IS MORTALLY WOUNDED BX ANOTHER POLICE- MAN, A tragedy occurred in South Brooklyn last night, in which two men were wounded, one slightly and the other mortally, under circumstances of a painful char- acter. About ten o’clock, while patrolman John Mur. tha, of the Third precinct police, was on duty on Hicks street, he was summoned by a citizen to go to the fonement house, No. 659 Henry street, wheroa disturbance was going on, The oMcer repaired to the place indicated by bis informant, and upon entering # ing apartment on the second floor he found a stout, heavy looking mau choking a woman who was lying on a bed. The tongue of the victim was protrud- tng from her mouth, and OMcer Murtha hastening to ber rescue seized the fellow ond caused him to release his bold on her. The fellow then seized a double barrelled shotgun which was in the corner of tho room, and, pointing it at Murtha, caused hii to beat a procipitate retreat from the premises, On Teaching the sidewalk Murtha rapped for assistance, and Officer Rogers, of the same precinct, replied thereto. The two patrolmen then re-entered the Apartments from which Murtha had been driven, ogera going in advance. No sooner had the latter crossed the threshold, however, than the infu- Tiated occupant of ‘the place’ discharged the contents of one barre! of the gun «at him. The shot entered Rogers’ left arm, inflicting a painful but not gerous wound, Murtha theo in sell-defence, fired a shot from his revolver at the would-be assassin, tue ball striking the man in the right temple and pene- trating the brain. The tenants in the house then cume upon the scene and it was ascertained that the man’s pame was Aptonio Lox. An ambulance was called und Lox was removed to the Long Island College Hospital, where he remained in an unconscious condition up to an early when it was the opinion of the Lox is about forty years Ofage, and a blacksmith by occapavion, Patrolman Murtha, who has an exccllont reputation as an officer, repaired to the Butler stroct station house immedi hour this morning, alter tbe shooting, and, handing his pistol to Captain Leavy, stated the particulars of the occurrence.
