ANTI-RAPID TRANSIT, & PERMANENT EAST SIDE CHECK TO THE EAST SIDE ELEVATED RAILROAD—BUFUS STORY'S INJUNCTION SUSTAINED BY JUDGE LARRE- MORE, Tt will be seen by reference to Judgo Larremore’s opinion in the case of Rufus Story against the New York Elevated Railroad Company, given below, that the prospect of an early completion of the east side extension of tho road is rather gloomy. Mr. Story, ag will be romembered, obtained a temporary injunction Fostraining tho Elevated Ratlroad Company from pro- ceding furthor with their structure om Froct stroct, opposite his premises, Ho charges in his complaint that tho Rapid Trausit act, under which the company Claim yhe right to build, is unconstitutional and void, @nd that the structure tv illegal. Judge Larremore, of the Court of Common Pleas, gave his decision yester- day on the order to show cause, embodying the same tp the following brio! opinion: — gronos oF JUDGE LARRAMORE, By tho of April 22, 1867 (chap, 489) the West Bide aud Yonkers Patent Railway Company wus au- thorized to construct au elevated railway in the couu- Mes of New York and Westchester, the construction of which, go fur as Ray | ybeod in the limits of the city of New York, was to bo completed within tive years from the passaye of the act, The company failed to Construct tho road within the time proscribed. On January 1, 1875, articlo 3 of the State conatitution, ax amended, took eifeot, whereby (section 18) the be Aes riged was proliibiied (rom passing a local or pri- bg 10 any corporation, association or Teareiges right to lay dowu railroad’ tracks or Irom cee + ‘avy private corpo! On, association or in- apy exclusive privil immunity or fran- chise whatever, The dofendapt bas succeeded to the rights uud powers of the West Side and Yonkers Pa- tent Baltwey Company, aad on June 17, 1875, an act to authorize ‘New York Elevated Ruflroad Company to continue and complete its railroad im the city of New York, and to regulate the construction, dperution and mauugement thereof, was passed by the Legisiatare (Lawe 1875, chap. 595), wherem suid couupany was authorized and required to construct Gnd vornplete one track with turneute and side tracks ‘Of its olevated railroads, at any time within five years after the passage of the act. @ General Term of Vhis Court, tn tho case of John Patton vs, Now York Elevated Railroad Company, decided that the right to construct a railway, conferred by the act of April 22, 1867, expired in 18' ‘3; that such rights and powers as had veen perfected wid secured by the grantec named IM said uct became elfvctual as againAs the citizen, and could only be revoked at the suit of the State for the forfeiture of tho eutire grunt for the failure to tomplete the railroad within the time aud ip the man hor prescribed; but that the powers and privileges not | thus perfected aud socurea were lost, and any ultempt to further carry them into effect to the tnjury of any one would sonfer a right of action tor such In- fu was ther decided that tho act ot June 17, Is75, so fur as it assumed to grungy new riybts aad privileges or revive those con- ferred by the act of April 22, 1867, was in canilict with toe provision of the constitution which prohibits the Legisiature irow passing any private or joval bul granting to any corporation, association or iudividual the right to lay down railroad tracks. ‘This decision 18 Conclusive upov the question up to the continuance ot the injunction ip tnis case. If as the Court hoids, the acto! June 17, 1874, is uncenstitutional, the further construction of its railway vy the detendunis ater 1878 was unauthorized and ih The act ot June, 1sié, commonly known as the "Rapid Trausit act,” could uot revive the forleited tranchise, ‘Tho detend- aut had lost the right 10 extend its route 80 as to Co- ineide with that referred to and intended by section 36 of the uct last wentioned. it wus not wn existing elevated ruilway in ac'ual operation, having the first rightto build upon such route then owned by it as preseribed by the statute. This conclusion arrests the hecessity of examining the other point, raised upon the argument and will afford the deteudant an early re- View of 1t ut (he next General Term of this Court. ln- junction sustained. THE PRICE OF MILK, THE EXTORTIONS OF THE RAILROAD COMPANIES THE BANE OF tHE MILE BUSINESS, To rae Epiror or tuk Henap:— There is a great deal being sald just now about the bigh price of milk iu your city—-us we think, without much right or reason, Let me explain. ‘The milk dealer in New York pays the farmer two and ono-balt @ents per quart, and he pays the railroad for treight one and one-half cents per quart. A milk route selis daily about 200 quarts, at an average, say, of cight sents, The major part of this 200 quarts is suld in these hard times in pint lots, Avy consumer who ‘uses four, five or six quarts can got his milk for seven cents, It is no exaggeration to say that to sell the 200 quarts the dealer must have at least 126 customers, Now let us see. He pays for hig 200 quarts $8. He polls it for $16. The losses in collections, as any milk- man will cortity, average over $1 50 per day. This Veaves him $6 60 for the support of himself and fam- prof and for the feeding and ing of bis horse, keep- tug wagon im repair, &c, if he sells all out, which he Ottentimes does not, the amount left over, if largo, ‘being a dead loss. As any one can sec, this is not o large income, and even this is luble from death of or accident to his horse to be cut down immensely at any moment. The real cause of grievance, and the one your paper ought toshow up and force upon the attention of tne lic, 9 the enormous freight charged upon milk, katita moment, Of $1 60 a can of forty quarts, which the deal ys for his milk the railroad takes sixty cents as ireight. Nearly one-half the gross pro- 1 the dairy farms which vend milk to your culy thus is 6: jowed up in their capacious maw, ‘Was ever such a tribute exacted out of any otber in- dustry in the world? ‘The milk train whicb goes evory morning into New York city clears daily over $1,000, Other things came down with tho bard times, but tho freight ob milk uever bas, and we fear never will, It seems useless to go to the Legislature. ‘the railronds em poy as their counsel all the members trom the milk districts, and see that they are elected, It isso wiub ubertsop. It 14 so with the late speaker ‘The tarmers grow every day poorer and It must be self-evident to every reasoning hat no business can be discounted so heavily and ‘¢ remuneralive, Whatia needed 1s that some great paper like the HexdLp shulltake hold of the imatter, and, by con- tuaued eflort, force the right to prevail. H, Somuns, April 9, 1877. THE 8. VEN CRNTERS, To tne Epiror ov THX HexaLo:— In your valuable paper of March: 20 there appeared a communication on “Cheaper Milk,” and signed “Ex- perienced.’’ Judging from the closing paragraphs the whole object of the communication seems to bave been intended as a means to make a direct attack upon those who are at present retailing milk for seven cents per quart from wagons. In order to prove thet pure milk can be sold for seven cents per quart with profit to the dealer I will give a fow figures as to cost of pro- duction and delivering o1 240 quarts daily, which all well informed farmers and milkmen will corrovor: Aw a well selected duiry of forty cows will produce 240 quarts daily, 1 have taken the expenses of a dairy of ‘that #1ze.a8 to cost of production, and tako the balance of the figures irom tne books Of @ milk association, | apg 185, Hcl at $12 per cow S480 00 feeding seventeen pounds hay p cow ninety days, at $15 per ton. 459 00 Feeding twenty pounds corn fodder por day ‘cow minoty days, at $4 per ton. 14400 ding two quarts corn meal per cow daily 180 days, at $2 62 por barrel 393 09 Feeding @ Ht quarts turn per cuw daily 180 days, ut 25 per bushel... 450 00 Labor of two men, iueluding board, at $1 25 por magi ualf their tine 4565 24 ‘on forty cows, at 140 00 jation, tiiteen per cent. 800 00 38 72 1,005 00 $40 ber montin. 480 00 Feeding und Weaving horse at $20. 240 00 Shoeing horse wt $2 50 per month 30 00 ntorest oH Horve and wagon, Se., value $600. 35 v0 100 00 ‘dur ig 50 00 ve ey dipping, twelve auarts to every 240 aquaria, at tive, ‘Total cost of producing and delivering. 09 98 Total amount received w % 9 ‘after deducting 4.35 quarts as lost by dipping. 85,825 40 ‘This leaves a net Broil of over $700 4 year for each on selling “40 quarts daily. Lf the party drives own wugon ho would have nearly $1,200, 1 have made no aliowance tor oflice expenses, bad dovts, sour imitk of milk joft over, on which expenses milkmen lay so much stress, as tho office suould be so Jocated that the protits irom local sales would puy its expenses; bad deots there would Le none, as peopie would be willing to pay daily or Hay luckots, paying for them when purchased, When they can buy pure milk at a fair price, As to sour milk there should be nove if the duiry is carofuily selected, except under Buch circumstances that vo customer would expect it to be made good. As to surplus, the butter, butiermilk : ern, obtained from the same amply repay coat. As to the chalk and water part of the communica- tion previously referred to, | have only to Buy that with weil selected cows, fet properly, tue milk would show at least twelve per cent cream and 100 Inctome- fer tost, as well a8 three and one-balt per cent butter fat by avalysis.
