The parties thereupon, tollowed by a large crowd, repaired Lo the Supreme Court, Genoral Term, when Assistant District Atiorney Leary on behalf of the people and Charles F. McClean on behalf of the Police Commissioners appeared to resis, the efort being made to secure the discharge of thd prisoners. Mr. lowe denied that the prisoners were taose required by the extradition warrant. Mr. Leary called Jono C. Hann, Deputy Chiet of Police of Boston, who testified that on the 19th of Maret) last be saw the prisovers in Boston; that this was the day preceding that upon which Mr. Furrier, cashier of the Abingdon Bank of Beston, was robved of $5,000; that he, with Mr, Fur- rier, went betore the Grand Jury, and that upon their statement of the (acts the Grand Jury found an indict- ment ugainst the prisoners charging them with such rovbery. He swore positively that tho prisoners were the persons named in tho inuictment and warrant of extradition, aud. be produced a certified copy ot the indictment, Mr. Howe subjected tho witness to a long and seurching cross-examination, but the Witness was cool, collected aud positive, and his testimony remained unshaken, Following the above testimouy, which was all the evidence taken, Mr. Howe had a lengthy consuitation with the pris- ners aud at its close announced that they expressed their willingness to accompany the officers to Boston, feeling satisiied, however, that they could conclusively stablish ther inDocence there of the crime churged against them, Mr, Sinclair said that the identity of the prisoners he regarded as Poly proven and be made @ report to this effect to Judge Donobue, who at once dismissed the compiaint. John H. White, but not the late lawyer of this name, died in this city some eighteen months ago, and his widow, Mrs, Kate G, White, now brings suit against Jonn White, the father of her Jate husband, for $28,000 claimed to be due her husband at tho time of hia death by his father for labor and services in attending the latter’s Hore, Mr, White denies any such indebtedness, and puts ina counter claim for $48,180, In a bill of per- tuculars accompanying the answer are five charges, the first being forthe board of John H. White from the time he came of ogo til his marriage, ‘tho second tor board of his family after marriage, the third for some otter expenses, the fourth tor other ex- penses of his family, and the fifth for moneys advanced to his son for personal use. James Kellner, on the 28th of December last, was employed in Ward’s bakery abvlishinent, No, 104 Elizabeth street, aud in the course of a conversation with a fellow workman, named Max Hoppe, produces a bottle and invited Hoppe to take a drink, stating that the fluid was whiskey. Hoppe took a draught, and, soon becoming sleepy und unconscious, lay down. On awaking be alscovered that bis gold watch and $40 had’been abstracted from his persou, Kellner hud dis- appeared and was at once suspected. Strange enough, a Mr, Kollner prosented himself the next day at the Fifty-seventh Street Police Court and complained that one Simon Lanigan, in whose company he bad been the the night previous, bad stolen his wateh and some clothing. Au officer arrested Lanigau, on whose person were jounu the clothing and pawn ticket lor & watch, which, on being exhibited, was idontified vy Kellner as his, Meanwhile, Hoppe, who had been drugged, bearing that Kellner had made a complatut, gave the oilicer minute description of the watch which had been stolon from him, und it tallied exactly with the one which Kelluor claimed us his property.
