WN’S MATRIMONIAL CONTRACTS, BvuxING OvF A Wire's RIGHT OF DOWER AND GETTING SOLD—THE TWO MES, BLOWNS— THE WIFE'S TRIUMPH. i Several years ago few mea were more prominently known in this city than John L. Brown, He was Drought into such prominence more particularly rough bis conuection with the street cleaning con- tracta. He also figured largoly in otber city contracts, all of which proved more or loss remunerat the result being that at the time of his death (whieh occurred on Marcn 6, 1575), ho was possessed of a largo estate, Prior to his death his partner ‘was Mr. Charles Guidet, and a good sharo of the prop» erty he lc{t comprised partnership property. While the public knew Mr, Brown a3 a cdntractor very little Deyond a limited circle was known rogurding bis do- _ mestic life, In various litigations that have since arisen, and more especially growing out of the contest ‘over his will, the fucts connecied with bis married life havo been pretty well made public, MRS, BROWN NUMUER ONE, Mr. Brown was married in November, 1823, As far sis known he and his wife livea together quite har moniously for about fifteen yeurs, when Mr, Brown evinced a polygamic disposition, and, forgetting his inarriage vows, assumed marital relations with an- . other woman, This ahenation of his affections, which was said to have been mainly caused by the fact ot | Baving no children, did not mect with the hearty con- currence of his wile; but they talked the matter over, and finally a marital separation was drawn up between them. PROVIDING FOR NUMUBR ONM. ‘These articles of separation were drawn up In 1855. CLAIM BY THE ORIGINAL MRS. BROWN. During Mr. Brown’s lifetime bis wite, as far as te known, never made any pecuniary demands upon him, Dut continued to curry out strictly ber part of thoir written agreoment entered into upon their separation. It 18 stated that she never would have taken uny step in the matter except for the suggestions of others, who insisted that such agreomont would not hold good in law. A sult was accordingly brought for hor right ot dower in Mr. Brown's ostate, Coupled with this sult was also ove brought by Mr, Guidet tor a partition of bis property, which of course would have to precede the adjustment of her dower right ‘The suit was Drought to trial some time since before Judge Van Vorst, at Supreme Court, Spocil Term, ‘Judge Van Vorst yesterday guve his decision, ombouying tie same 4m quite a lengthy opinion, the substance of which 18 given below :— JUDICIAL ANALYSIS OP THE AGREEMENT. “It is qaite clear that the execution of this agree- ment by the defendant, Mary Anc Brown, aid uot in law roleuse or discharge her dower in her husband’s land. That could only be accomplished by uniting with her husband in a conveyance tw a third party. As far as the instrument purported to release ber claim of dower to her husbana’s estate the wife’s agreement was a nullity, and og it docs not appear that since her husband’s death the widow has executed any release of her rights and interest in the land tn question, she is in law entitiod to her dower, But it is urged, in opposition to the claim of the widow, that she accepted und ts iu t! enjoyment of a pecuniry provision in lew of dower, and tat she ts equitably estopped by such provision and the agreement in question frotn asserting any claim to dower in Ler husband's lands, The object of the husband in making the pecuniary provision by the agreement of 1855 io favor of lus wite was for her comfortabie support, that she might be martained with the comforts and conveniences which she uad heretofore had. This was assuredly mis duty toward her, and there is nothing disclosed in the cuse trom which itcan in any manuer be inferred that he could not have been compelled to do this had ho refused, atthough they lived apart, 1t1s both a moral and Jegal duty iposed upon a husband to support his wile aud that with reasonable comfort and convenionces, This ial the agreement im question proposed to nccom- plisb. ‘The detendant’s counsel cites no case in sup- port of his view that the widuw 18 equitably estopped from asserting her claims to dower vy the agrecment * and provision in question. On tho other hund there are cases which discountenance any such conclusion ALIENATING DOWER. Dower {s highly regarded in the law. It is a moral os well as legal right. This humane provision of tho common law wus intended for the sare and competent susteaance of the widow and the better nurture and ed- ~ucation of his children (4 Kent’s Com., page 36). ‘The busband cannot defeat it by any act i the nature Of ahenation or charges without ihe assent of the wile, given and provea according to law.’ After citing various cases showing that right of dower cannot be defeated by arrangements of the puture contemplated by the agreement between the * parties, he states that courts of equity have justly hestiated from in any manner giving their sanction to separations of husband aud wite by voluntary arrange- ment, such separations being regarded as contrary to the policy of the law and against morals, He tinds no case, he says further, in which it has been heid that a wile can reiease to ber husband her dower rights, directly or indirectly. Lewis, the miser ‘millionnaire, who died recently, bequeathing, alter some small legucles amounting to 940,000, his million nd more to the Treasury of the United States, MRS, LEWIS’ STORY. The will hos not yet been offered tor probate, nor the {issue between the woman claiming to be his widow and the executors named in tho will been formally Joined, but the counsel for both parties are collecting every scrap of evidence that can have any possible bearing on the case, The actual amount left to the United States is about $1,500,000, The story told by ‘Mrs. Lewis, who claims her third of the estate under the laws of New Jor-cy, is that sho was married to Mr. Joseph L. Lewis in 1857, and lived with bim one year a3 his wifo at his residence in Hudson street, Hoboken. At tho expiration of about @ yeur they *eparated in consequence of incompatibility of temper. The officer took his beautiful wife to Beltast, Ireland, where he settled. Mr, Lowis, or the boy Joseph L.
