THE COURTS. Church Music That Was Not a Concord of Sweet Sounds. FASTIDIOUS FAULT-FINDERS. Still Exploiting the Galena and Northwestern Pool Operations. INTERMENTS IN THE CITY. Our leading city churches bave long been tm the Habit, as is weil known, of providing themselves with paid choirs and organists whose artistic touches are likewise invoked by the potent influence of a we!) paid salary. Of courso the wealthier the congregation the more artistic the singers and tho more skilled the or- ganist, with @ proportionate increase of pay commensurate with their higher advancement tothe divine art, Naturally it would be supposed that the greatest harmony would prevail in the music department of our churches, This does pot seem, however, to be always the case, a8 was developed ina suit brought to trial yesterday before Chiet Justice vurtis, of the Supremo Court, Edward C, Schanck, who brings the suit, sites in his complaint that ‘he was engaged by the Church of the [ncarnation, corner of Madison avenue and Thirty-fifth street, to furnigh the church with an organist and quartet choir, such arrangement to go into effect on the 1st of May last ana to continue tor one year, The church authorities agreed to pay him ,000, with which to pay the artists to be thus en- gaged, After some trouble in making his selection, there being ecarcely uny end to the artists feeling themselves competent for the cares to be filled, be made his selection, and they entered Upon their assigned duties, The singing of the choir and the playing of the organist gave rise to discord, not among the artisis so much, it seems, as among certain members of the congregatiou. At all events, after a sort time the church peremptorily refused to perform its part of the contract, and so Mr. Schanck bas brought suit for $3,000 dainages, Ex-Judgo Fithian appeared for the plaintifl and Mr, John E, Parsons for the churcb, Mr. Schanck was called as the first witness. Though his compiaint was drawn up after the usual staid legal formula, bis testimony was spicily piquant. He charged the whole thing upon the ‘Musical Commit tee.” The misfortune of this commitice was, he suid, that they knew nothing about music. He represented that Mr. Schanck’s duties as impresario consisted mainiy in pulling the coat tas of the male singers and culling out to the lady singers, “louder,” or “gotte,r’’ as the whim took him, Mr. Herrick, a vestry man of ten years’ standing and algo 4 member of the ‘Musical Committee, gave a painfully luguorious account of the effect produced by the musical services in the church under the leader- ship of Mr. Scbanck, Mr. Clark, also of the Musical Committee, was ex- umived. A rather singular suit has been brought by Mrs. Milderberg uwgainst tbe German Lutheran church’ Curistopher street, Her story 1s. that ker father was owner of a vault in the church, and that she, on his death, succeeded in its ownership. Her father and other members of the family having been buried there, she desired to place in the vault the remains of her brother-in-law, who died in July, 1874 The church refused to allow the vault to be opened, on the ground that 1t was foruidden by a corporation ordinance. The trial of James Sutton, President of the Aldine Publishing Company, charged with perjury in swearing, as alleged, to a groater loss than occurred at a fre that took place on the 24th of Jue, 1875, was resumed yes- terday, Assistant District Attorney Herring, on the part of the prosecution, examined a number of experts on the manulacture of cbromos and clectrotypes. The prisoners plended guilty and were sentenced each to eighteen months in the Penitentiary. Eliza Murphy, a shoplifter, of No, 26 First avenue, pleaded guilty to tho charge of stealing a piece ot silk from the store of A. T. Stewart & Co, She was sen- tenced to two years in the State Prison. Frank Penuegran, of No. 316 Tuird avenue, who woke into the rooms of Eliza Lau jot, at No, 21 hast Houston street, and stole clothing and jewelry valued at $100, pleaded guilty and was sent to the Penitentiary ior one year, Jobn McGarvey, of No, 18 Monroe street, was ar- reigned at the bar Churged with picking a lady's pocket on Broudway, aud, having pleaded guilty, he was sent to tbe Penitentiary lor one yeur. Before Judge Brady, INTERESTING FOLGERY TRIAL AND CONVICTION OF THE ACCUSED, John 8. Brash, jointly indicted with Jobn F, Care penter on @ chargo of torging and uttering a check drawn in the nume of Sargent & Co,, hardware mer- chants, on the Importers and Traders’ National Bank, for $400, was placed at tho bur for trial, Brush, who was neatly bot plainly attired, 1s a young man with sinister black eyes, a heavy, dark mustache and a complexion of extreme sallowness, He occupied a seat next nis wife, a young and notably protty bru- nette, who seemed to exhibit unusual devotion to hin during the progress of the trial, She wore a costly sealskin sacque and was otherwise elaborately coa- tumed, The court room was crowded during the pro ceedings, and great interest was manifested in the dotails of the case.as they were unfolded by counsel, In the employ of Surgont & Co. was a young clerk, Anson Llutton, an acquatatance of Brush, The prisoner obtained from Hutton a blank check of the firm, and a few days subsequently a check signed Sargent & Co., calling for $400, was presented to the teller of the Importers and Traders’ National Bank, payavle to bearer, und duly honored. Tho discovery was speedily made that the signature of the firm bad been forged, aud the police were put on the track of the supposed culprits, Suspicion fivally fastened upon one Jobn F, Carpenter, and bis bouse was watched. He was taken into custody, and the prisoner, as he was in tho act of leaving the premises, was also arrested, both euptures taking place on the 2d of December last. ‘The prisoners were tuken wefore Judge Morgan at tho ‘Tombs and committed for trial, At ihe trial yesterday a jury Was etnpanciled without much difticulty, and the case proceeded. Messrs, William F, Kintzing and Rutus F. Andrews uppeared as counsel for the accused, Assistant District Attorney Russell for the prosecution, Mr. Hunt, the paying teller of the Importers and ‘Traders’ Bank, testiticd that the check in question was presented on the 19th of October, 1876, and by him honored. He tdentitied without difficulty Curpenter, who Was present in court, 4g the man to whom he paid the money, There were three other checks also pro- sented and honored, all of which bore the periect kignature of the firm'of Sargent & Co. Mr. Sargent, senior member of the victimized firm, testified as to the spurious signature attached to the check, Anson Hotton, the clerk, was poxt put on the stand, and swore that he gave the blank check to the prisoner, and also that after the crime became known the ac- cused admitted to bim that he had perpetrated the forgery, but torbade him to divulge it on pain of so- sious personal consequences. From fear of the pri: oner ho failed to notity his employers, but subs quently consented to tell all lie knew when questioned in the strict. §=Attorney’s office.
