Grindle was convicted of cruel pun- ishment in causing the death by flogging of a sailor called Long Tom,” who was one of tho crew of his vessel, tbe St. Mark, Motion was mado for a new trial and arrest of judgment by his counsel, Messrs Fullerton and Knox, on the ground of newly discovered evidence, This evidence consisted of aflidayits of pris- oners in Ludlow Street Jail, who testified to having overheard conversations betwoen William Skinner and Harry Poent, witnesses on the trial of Captain Grindlo for the prosecution, in which Poent was alleged to bave said that he would get square with Captain Grindle for an alleged wrong, and by the affidavit of Skinner, which set forth that he did not know that the man who was flogged was *‘Long Tom,” and that the flogging be did see was such as might be ‘given by a child tweive years old.’ The motion was argued by Mesers. Fellerton and Knox for defendant and by District Attorney Foster tor the government. Judge Benedict yesterday rendered his decision, in which he say “1 have examined the aflidavits presented in support of a motion for a new trial im tnis case, and fail to lind in them avy Loe to justity set- ting aside the verdict, It is settied law that a new trial je not to be granted upon merely cumulative and im- peaching testimony, and these afiidavits disclose noth- jog more. The defendant wag fairly tried before a jury of niuch intelligence; be was, carefully defended by able counsel; the jury believed the two witnesses who bore testimony against hun, and the verdict 1s conclu. sive. IMPORTANT SUIT IN BANKRUPTCY. Judge Blatchford yesterday rendered a decision in the case of Robert McDonald, assignee of David Sol- enger, against William T, Moore and others, involving certain important questions in bankruptcy. On tho 28th day of December, 1875, David Sotenger, being in- solvent, made a general assignment, under the laws of the State, of all his property to one of the dofendanta, Meyer, in trust to pay his creditors, sharo and share ahke. Meyer accepted the trust and took possession of the property on said day, and complied with the statute as to tiling a bond and inventory. On the 4th of January, 1866, the detondants Moore, Tingue & Co, recovered a judgment in the State court against Sol- enger for $1,508 38, and on the same day an execution theroon was issued to the Sheriff, who is a defendant in the suit, and placed in his hands On the 5th of January, 1876, a petition im bankruptcy was filed against Solenger, whereon he was adjudged a bankrupt on the 17th of January The plaintit’ was chosen assignee, and an atsignment was made to him by the Register on the 16th of February, Plaintiff claims that ho has’ title to the property c: braced in the assigument to Meyer superior to Meyer claims, and of Moore, Tingue & Co., and of the Sheriff; that the assignment to Meyer was made in fraud of the Bankruptcy act, and that tho property or proceeds ought to go to the assiguce free and clear of the claims of all the dofendants. Judge Blatchford says that “the assignment to Meyer must be held to be invalid = against the rights of the plainiiff under the Bank- Feed act. Meyer must be held to have known that jolenger made the assignment with a view to prevent the property from being distributed under the Bank- ruptey uct. The question whether a soon ment in trust for creditors, without preference under a State law, is void under tho Bankruptcy act, has been decided in theaffirmative, With Tegard to the ex- ecution in favor of Moore, Tingue & Co, thero is noth- ing to impeach the validity of it. As the rights of the assignee tn bunkruptey relate back mA to the Sth of January, when the petition was filed, it foliows that the gooas were subject to.tho lien on the execution, and that soch lien has preterence of the claim of the plaintt, POWERS OF POLICE COMMISSIONERS. Sergeant Augustus Miller was about two years ago dismissed from the police force by the Commissioners on acharge preferred against him by Inspector Mc- Dermott, The Board of Police Commissioners claimed to have given the charges a hearing, but the facts appeared to be that Miller, on the advice of Commissioner Disbecker, submitted his case to the Board, and thatthe Board then refused to try the charges against him, holding that be had coniessed their truth. The matter came before the Supreme Court, General Term, composed of Judges Davis, Daniels and Lawrence, when tho majority of the Court ained the action of the Commissioners, Judge Lawrence presiding. From this decision an appeal was taken to tho Court of Appeals, and there recently argued by Messrs. Grant and Lydecker on the partof tho appellant, it being claimed by them that no ivestigation of the obarges against their client had ever taken place. The Court of Appeals has now rendered a decisiva on the appeals, reversing tho decision ot the Supreme Conrt, General Term, and ordering that Sergeant Milier be reinstated on the po- lice torce, A LUNATIC’S ESTATE. In 18¢8, as it appeared in Supreme Court, Chambers, yosterday, on a motion argued before Judgo Brady, Patrick Dickey was adjudged a lunatic, and as such is now confined. He was worth at the time he was ad- Judged insane about $700,000, bringing him an annua income of about $27,000. Ho had at the time a mar. ried daughter, a Mrs. Van Bieck, whose kusband had become insolvent and also insane. To this daughtor Mr. wickey allowed a support before his illness amounting to $250 per month, and subsequently in- creased It to $360 per month. Atter her father’s prop- erty went into the awe of a committee Mra. Van Bieck received but at tho rate of 000 a year. Sho then applied to have her allowance increased to what it was fixed at by her father while in health. The matier was sent toa referee, who reported in favor of paying jor ut the rate of $4, ce hod out of the estate, To have this report confirmed by the Court was the ob- ject of the motion yesterday, and it was opposed on the part of the committee of the estate on the ground that the payment of $2,000 per apnum was the result of x compromise between Mrs. Van Bleck and the committee, Which she had accepted and should abide by. Tho Court roserved its decision, THE “LAST DAY” UND UNDER THE CODE. On an appeal from the First District Court, recently argued in the General Term of the Court of Common Pieas by Mr. M. 3. Budlong on the part of the appel- lant, and F, J, Mather for respondent, a decision has now been rendered which is of importance as showing that the provision of the Code that when the last day within which an act is to be dove falls on Sunday tho act may be done on Monday, does not apply to the dis- trict courts, but that the act in such case must be don on Saturday, ‘The opinion of the Court is, brielly, a The Justice rendered his judgment on the alter the case was submitted to him for do cision, the eighth day being Sanday. AN IMPORTANT DECISION, In a@ decision just rendered hy the Supreme Court, General Term, in Kings cocuty, Judge Dykoman, whe writes the opinion of the Court, sustains the constita. tonality of what is known as the “Sheriff's bill,” or “Jadietal Sales bill,” passed by the Legislature at its Jast session, This act provided that in all foreclosure cascs in Kings county where there was no agreement as to the appointment of a referce to sell, the Sheriff should conduct the sale. To test the validity of this law a foreclosure suit, where all the parties were not represented, was sent to a referee, who sold the property. The purchaser refused to ace cept the litle from the referee, claiming the sale to have been invalid, The case then came before the Su- preme Court, on a motion to rolieve the purchaser, = finaliy reachod the General Term ot that court on appeal.
