| ) THE COURTS. Francis McGuire on Trial for the Mur- der of His Wife. SAD STORY OF DOMESTIC UNHAPPINESS. Extending the New York Elevated Rail- road Across the Battery. Deeds. ‘The trial of Francis McGuire for murder in the ond degree was begun yesterday before Judge Suthe tand and a jury obtained the previous day in the Court of General Sessions, Part 1. Assistant District At- torney Bell, for the prosecution, placed on the stand two women named Mary Rignoy and Mary Melaugh- Ain, who had lived with the prisoner and his wife at No. 380 East Thirty-fifth street, and who testified that early on the mornmg of Sunday, the 13th of last August, the accused ordered his wife to arise and get breakfast; that she refused to do so, stating that it ‘was earlier than usual; that at seven o'clock she did arise, and half an hour Jater, having prepared the meal in question, sat down to it with her husband; that they quarrelied at the table and that the husband left the house suddenly aod did not return till about mine o'clock tn the evening. When ho then returned, according to the further testimony, some angry words passed between him and his wife, The latter made some allusion to another woman, and McGuire retorted, “It you say that again 111 kill you.’ A moment later Mrs, MeGuire cried, ‘I’m stabbed! Help me!” Upon examination it was found that sho had been stabbed inthe abdomen with an enormous butcher's knife, which bad been lying vpon a table in the room. Oakey Hall and Mr. Wuliom FP. Kintzing, who contended tbat their tient bad boen guilty of nothing greater than man- slaughter in the second degree, because the fatal viow aad beep struck im the heat of passion, while under the iniluence of liquor, and without any intention of killing. They placed upon the stand an aunt and a sister-in-law of the prisover, who, on betng examined by Mr. Kiut- cing, testified that the laiter had onthe day in ques- tiou called at their respective homes, in company with his son, a boy of twelve, and had drunk freely of beer and ale, At the close of the testimony Mr. Hall made a long and able address to the jury, summing up the case, and the hour beg then rather lute, the Court adjourned until wis morning, when Mr. Bell will sum up for the prosecution, RAPID TRANSIT AND THE BATTERY. Among the opponents to the extension and comple- tion of the New York Elevated Railroad who pre- sonted themselves to oppose its work last eum- mer were Jeremiah V, Spader and the Ninth Ave- nue Railway Company. Tho Ninth avenue company Opposed the work in the interest of its horses and Mr. Spader in the interest of himself, Judge Van Hoesen, of the Court of Common Pleas, decided against the horses, and now Judge Curtis, of the Superior Court, iu called upon to decide against the man. The suit is brought by Mr, Spader, who resides at No. 3 Bridge street, in equity, to perpetually enjoin the New York Elevated Railway Company from extending ite line across the Battery grounds. His right to this form of relief the plaintiff bases on the grounds that when he purchased the property in Bridge street it came to him Shrough an intermediate conveyance from the city, in which was contained a covenant that what was then the Bai should not be converted to private uses; that dant, the company, has no legal autbority to Duild the road, and that thi thority mu it by th Park Commissioners is insufficient to authorize ti tse of the Battery grounds for that purpose, The congany answers these claims of plaintifi by the alle- tions thut the company proposes to use the ground Between high and low water mark and below low water mark, which ground was ceded to tue city under tho Dongan and Montgomerie charter; that the ase to be made of the ground tor the purpose of the road lea public use; that the Commissioners of Parks had full Authority to grant tothe road the rights and privileges which they did grant, without turt! actiou on tue part of the city; that the company’s right as a corpor: Yon to extend its road is derived from the provisio: ofthe Rapid Transit act of 1875 and the proceedin; had under the Mayor’s commissiou authorized by that act, and early lawful and valid. The evidence introduced yesterday, though whony documentary was quite feyetleps Mr. Ervio, the opening witness, ates! some of the old maps of the Battery and vicinity, the earliest map bearing date 1728, Next follows a map of 1767, and then one of 1776—a centennial exhibit, as on the counsel facetiously termed There was also produced the survey of U, T. Goerck in 1791, together with urvey of Gerard Baucker, giving more expecially the outlines of Fort George. A glance at those early maps and surveys presented s somewhat different scene from that presented at the Battery to-day. Oneof the ob- jects of tuese antiquarian researches was to show the land that then belonged to the general government wnd that vested in the State In connec- tion with them was also produced from the musty records of the County Clerk's office two deeds, the first, bearing date in 1813, w portion of the government land to the State, and th: ond, placed on record two years later, was of tho residue of the gov- eriment land to the State. Through the unearthing of these deods it was shown that the lot now known as No. 3 Ridge street, owned by Mr. Spader, was deeded to the State, by which it ‘s claimed it was in turn deeded to the Mayor and commonalty of the city, and thence deeded to the parties from whom Mr. Spader derives his title, with the proviso, as Mr. Spader ims, that the Battery adjoining shouid never be de- voted to private uses, The trial promises to occupy several days, SUMMARY OF LAW CASES. THE CORPORATE SCHOOLS—ATTENDANCR IN THE EVENING SCHOOLS—MARRIZD WOMEN AS TEACHERS, At the regular session of the Board of Education, keld yesterday, the president, Mr. Willham Wood, in the chair, and seventeen Commissioners present, the City Superintendent of Schools reported that since the 15th of September, all of the corporate schools—forty- five in number—entitled by law to a portion of the Edu- cational Fund of tho city and county had been visited, excepting only the school attached to the House of Refuge, The number of teachers employed in the said schools is 201; number of pupils on register, 13,110; average attendance, 9,638, During the month the even- ing schools in the county have been organized and are ‘now in successful operation. The average attendance during the first week of the session was 9,714, and during the second week, 9,918. Of the 303 class teachers employed in the evening schools 247 were re- ported as excellent, 51 as good, 5 as fair and 5 as 10- eMcient. The monthly report of pupils on register in the day schools on September 1 was 113,670, er age atiendance being 101,906, showing an tucrease of 1,225 over the attendance’ in September of 1876. During the month 3,441 applications for admittance as pupils had been refused fer want of room. Of that number 1,323 bad been made at the schoola in the Nineteenth ward and 207 in the Iwenty secoad ward, A portion of this excess of pupils was caused by the temporary closing of Graminar School No, 7 ™ the Tenth ward. Very favorable reports have been re- ceived trom the examining officers in regard to the management, instruction and discipline in the. cor- porate schools, and no violation is reported of the Provisions of ‘aw in regard to sectarian teaching. Mr. Charles M.
