7 « . prejudice publ THE COURTS. | Frank Moulton’s Suit Against Heoury Ward Beecher. A Dislike to Try the Case in This | City or Brooklyn. | Argument on Motion to Change the Place of Trial. Shearman’s Strictures on the) Mutual Friend, : | m | — Francis D. Moulton, the mutual friend, still nurses | ‘Bis wrath against Henry Ward Beecher, and the eflorts to exorcise the great Beecher scandal prove futile in consequence. The important question now agitating the courts in this matter is the most proper place tor the trial of the suit jor damages brought by Mr. Moul- ton against Mr, Beecher, the facts of which have | already been too fully and frequently outlined in the | Papers to require going into more extended actails, Mr, Mouiton is anxious to have the case tried in this | city, it being claimed on his behalf that a fair and im- partial trial.can be had here, whereas Mr. Boecher | und bis legal advisers insist on the trial taking place in Franklin county or some county equally remote | from the scenes giving birth to the groat scandal. A motion to remove the cause from New York county to tomo of the rural counties of the State—a preference | being given to the northern counties—was argued at | kreat length yesterday before Judge Westbrook in Supreme Court, Chambers. The crowd in atiendance was not very large, which would seem to indicate @diminisned interest in the issues involved in this renewed litigation, but such as it was the most unflag- ging attention was given to the reading of the afli- davits for and against tne motion and to the prolosgod remarks of counsel that followed, Mr. Moulton was present, looking as placid and calmly serene as at the great trial in the City of Churches, A noticeable fea- ture was the absence, however, of the great legal Jumi- naries that gave such brilliant character to the Brook- lyn trial, ex-Judge Henry Fullerton, a brother of ex- Judge William Fullerton, the great cross-examiner, being the sole representative of Mr. Moulton, while Mr. Beecher bad as his representative his anccasing and unflinching advocate, Thomas G. Shearman, as- Siaved by Messrs, Vanderpoel and Joho L, Hill THK AFFIDAVITS ON NOTH SIDES, The proceedings opened by the reading of numerous afdavits on both sides, Mr. Shearman first reading those im support of the motion, The first affidavit | read was by Mr. Beecher, setting forth the impossi- bility of getting twelve impartial jurors in Brooklyn on the Tilton vs. Beecher trial, so that rather than bavo Do trial deiendant’s counsel accepted jurors who pro- fessed a bias against him; also the extent to which the issues of both suits were publisbed and discussed: #0 that, as dopouent believes, Jurors could not be | found in tho First or Second districts who have not | formed or expressed an opinion on the issues; whereas | in the northern counties the case was less extonsively pablished, read and discussed. Now next followed the afldavite Of others to the same effect and, 1m addition Setting forth that Tilton and Moulton had eirculued | j about as in this county. The sentiment in the rural | | under the act. Most of the cases, however, were ad- | Hee alluded to the trial o! | malice by the defen hundreds of tousands of copies of newspapers atnoug | the southern countica containing -documents in which | they accuse Mr. Beecher of adultery and perjury. Afi- | davits were read from Alired R. Reynolds, Daniel Wood, likewise Thomas §. Ellis, Charies 8. Price and. | other gentlemen as to the impossibility of getting a {air jury in New York or Kings counties, and trom the | Prosiuent of the First Nationa! Bank of Tarrytown ana | George W. Davis, as relates to Westchesier | and “adjouming counties, and from sheriffs und residents o! northern counties that the resi- | dents of those counties are less committed to an | opinion and a fair jury might be bad there. In conclu. | sion were read the all:davits of seventeen residents of this city stating that they bave been unable to find any oue here who has not formed au opimion im the | case. Judge Fullerton led off with reading an affidavit of Mr. Moulton sewing forth that his inoderate mewus are sunk in a business which requires bis presence in New York; that the same is trae of the thirty witnesses; | That some of them state that they will not attend out | o: New York or Brooklyn; that the trial wid occupy | some munths, and the expenses of removalot wit- | nesses. and counsel would be beyond his means, | whereas defendant's counsel paid $80,000 of bis ex- penses on the last trial and can de ag much again, and it the motion were granted plaintiff! must allow tho case to go by default. Next in order were read afd vils of iiteen*r: sidents of this city that they have not formed or expressed an opinion about the issues of this case, and irom twenty-seven residents that a fair trial can be had in this city. Mi. BHEAKMAS'S ARGUMENT, ‘The reading of the allidavit concluded, Mr. Shearman entered upon bis argument in support of the motion. He began by criticising the ceaduct of Mr. Moulton | Subsequent to the iustitution of the present suit, He | characterized this conduct as an outrageous attempt to opinion against Mr. Beecher and in his own jivor, These lying statements, he saiu, bad , been scattered broadcast, und he was unable io glig- | Mmalize it otherwise than as a most viliavous proceed. ing, and in using t he felt that be w: Speaking within moderate bounus, He next drew a copirast between the persons making aiiidavis for Mr. Moulton and those making allidavite for Mr. Beeche Tho tormer he said were mainly keepers of sample . rooms, of marked obscurily except in their special ais- tricks, ‘and having but very huie knowleago of the wavters sworn to, On the coutrary, the persons whose aflidavits he bad read tn support of the motion were ali men ol weil kuowu character and repute, all ol whom had resided in the city ot Brooklyn and’ this pity for the last twenty years, Ho did not deny that Mr. Soulton could get his henchmen bere, as in | the case of the juror the Seanneli tial, Whose hands ho shook every morning; they | bad had quite enough of Mr, Moulion’s cronies in the et box. “He compared Mr. Moulton vo Colonei sei- lers, and said that the men Mr. Moulton would desire fora jury would be such men as Falstai’ met on Hounslow Heath. One oi the aifiants tor Mr, Moulton was a Mr. Simon, Simon might say thumbs up or thumbs down, bus that was ail tiey knew about this | Simon. Anoiher was Mr. Parker, the sawe name us ihe managing clerk ol General Pryor and between whose handwritings there was a strong family resem- olunce, Another was a coal merchant, Which seems to dea singular coimeidence, inasmuch as Mr. Moulton’s | lather was acoal merehant, He had been unable to find | the names of one of them on the jury list of this | Court. As fur as these persons’ aflidavits showed any thing the present suit might be on a promissory pote, | Buch notes as Moulton wrung out of Beecher and upon the mon-y realized feom which Tilton thrived, Following these comments upon the Moulton fants ho next spoke upon ihe presumptions aiways to be rased against affidavits, Affidavits he Insisted, were always suspicious things. He felt conti- dent, however, Wat the court would not be carried Away by any sucn cloud of witnesses, He cited vari- ous authorities, which point of bis argument, how- ever, he abbreviated upon the Judge reminding him that’ its discussion was unnecessary. Having next ated that New York and Brooklyn are go closely in- tertwined as to form m reality one city, aod evidently propared himsel! to amplity this proposition to an in- definite length, Judge Westbrook again brought him to a halt by asking him to enlighten the Court upon tho | question bow the granting or denying the motjon would | convenience oF inconvenience witnesses, ‘This que: tion Mr, Shearman insisted should be thrown to the | winds, the only question being that of obtaining ao im. partial jury anda fair trial, He claimed that it was utterly iimpossinie to obtain either in New York or the | adjacent counties, because of the poixoning of the pub- | lic mind by the publications sent broadcast by Mr. Moulton. He next took up the matter of expouse, urging that lawyers were cheaper | iu the country, Mr. Moulton, he said, moved by re- spect for the sex, had imported a tascinating widow trom Massachusetts to act as counsel forhm, Who Could resist such torrents of such female eloquence ?— the eloquence, too, of no bashtul matden, but ot one | who understands thoroughly what she is’ about He told how an Athenian lady un trial once captivated all hearts and won her case by lilting her veil and reveal- ing her beauty, He expected the same thing would bo done with this fasctuauing widow, He turiher urged for the motion that while the case might bo tried within three weeks in the country it would require over | three montus in the city. He wound up his remarks ya hit that was keenly appreciated vy all presout, lo said that some of the witnesse®, in attending the trial, would have to go on slecping cars, a convenient | move of iravei whieh, in view of recent developments, some would doubtie REPLY OF JUDGK F . Judgo Fullerton, in replying, stated that the present 708 bis firet connection with & case involving @ discus. sion of what is kuown as the Beecher scandal, Ho would, however, not attack amy one, or apply barsh epithi effurts at wit, bat brielly submit what he considered to be the legal grounds jor resisi« (ug the presept motion, Many statements had been made by opposing counsel not contained in affidaviis, bo Which, of course, he would make no answer, His thief reyret was that General Pryor had veen unabio sbrough til health to attend and make the answering argument. Such a motion as the present one was sel- dom made in the courts, entire case showed, in | bis vew, that a fairand impartial jury could be’ ob- tained in this city. He cited several casea where sin- iar mouons bad been made, including tho well known Kewey case at Huntington, Long Island, They were not to depend upon the respective opinions of men, Ho conceded that before the Tiiton-Beecher trial the pub- Hie mind was agitated as to th question of Mr. ' Beecher’s guilt or innocence 13 agitation, he claimed, had now died away, and the people were prepared to act upon the lesumony in the case, There was not, in his opinion, county in the State where the great scanda) Tied not been 49 thoroughly talked over and ag extonaively road bey | Adgust last, | inst, entered the premises of James Fallon, No. 419 | He described the garment so minutely districts was fur more prowounced than in the city farmers, as a veneral thing, are inen of fixed upimions. \, Stukes and Tweed in thu city and insisted that ‘he present case could be tried with equal impartiality bere. Judge Westbrook—-Would you try the case with a struck jury? : | Judge Fuilerton—To this question I give an emphatic yes, and in making Unis auswer I take away every Bround for the present application. After some further remarks by Judgo Fullerton Mr. Vanderpool spoke at rome length, to which Judge | Fulierwa briefly replied.
