The jury evidently had on their minds that in order to render the captain criminally negligent he (the captain) must have intended some- thing criminal at the time of the disaster, This is er- toneous. Criminal negligence may occur whore no crimivality was iutended. Criminal negligence is that degree of gross negligence—tbe culpa leris of the Roman law—which bas and can have oo excuse; and the degree is heightened when the guilty person is in the capacity of an expert as thé captain ofa ship and | hot asa mere passenger. It the enyineer of a locomo- tive sees fit to go to sleep on his train and thereby fails to see the danger signal, but dashes through a broken bridge, be is “criminally negligent,” although he may Bave no criminal intent aguinst any one on the train, s. CAPTAIN ROWLAND'S ARREST. WHE SAILING MASTER OF THE MOHAWK SENT TO RICHMOND COUNTY JAIL CHARGED WITH PERJURY. Captain Otiver P, Rowland, tho sailing master of the yacht Mohawk, was rearrested yesterday on a war- rant issued by Justice Garrett, of Staten Island, on Monday. The complaint was made by the quartermas- ter, Palm, charging that Rowland had wilfully and felo- niously committed perjury in stating before Coroner Dempsey, at the inquest, that he had let go the main sheet when the squall was about to strike the vessel. Fergessen and leterson appeared and supported the complaint, and the war- rant was given to Constable Goggins for execution. Ho came up to New York on Monday evening and sought the captain at the United States Hotel, where he was reported to have taken up bis quarters. Rowland, *bowever, was not to be found there when Goggins talled, so the Jaiter was compelled to wait until y terday for his return to that house In the morning Goggins went to the United States Hotel again; but the captain had gone out to South Street, it was said, and the constable fol- Jowed him thither. Not finding his man at any of tho places indicated, Goggins ascertained where he had gone and started ip pursuit. He found him at last at the late Mr. Garner's stores in Worth street, showed him the warrant ani arrested him. Together they Proceeded to Staten Island and ‘appeared, pur- Buast to the warrant, before Justice Garrett. Rowland heard the complaint and afiaavits read and pleaded not tity. He admitted — that he bad made the statement before Coroner Dempsey ; but he denied that it was either wilfal perjury oF malicious in any particulor, as alleged in the com- plaint. Justice Garrett received his plea, and com- mitted him in default of $2,900 bail, The prisover, Deing unable to proeure suretics to that amount, was sent to Richmond County Jail in a carriage hired by Dimself, he being unwilling to go thither in the cus- tomary open conveyance and be subjected to the hoot- ings and demonstrations of the villagers, who had assembled outside the Court House, CLEVELAND RACES. CLEVELAND, Onio, July 25, 1876, The Cleveland Club races commenced to-day. The Attendance was much better than on the first day of any previous meeting. The track was in splendid con- dition and everything passed off smoothly. The first race was for the 2:36 class, tor which there were seven entries and five starters, Governor Sprague and Romeo beg drawn. THE ARTIST SUICIDE. Coroner Gannon, of Jersey City, last night concluded at Spi Morgue, Coffin House square, the inquest on the body of W. S. 8. Jewett, the wealthy artist, who committed suicide at Allred Cox's Hotel last Sunday morning, The jury returned a verdict that deceased came to his death by a pistol shot at bis own hands, BROOKLYN STONE CUTTERS. OBITUARY, SIR JOHN WILLIAM KAYE, A cable despatch from London announces the death of Sir John William Kaye, at tho age of sixty-two years, The deceased was the son of the late Charles Kaye, Solicitor to the Bank of England, and was born in 1814. He served as a lieutenant of artillery in the East India Company’s service in carly life, and return- ing to England in 1545 he devoied —bim- self to literature. He 1s known as the author ot the “History of the War in Affghan- istan,” the “History of the Administration of the East India Company,” the ‘Life and Correspondenco of Lord Metcalfe,” the “Life and Corresponc f John Malcolm, G:C. B..? “Christianity in India,” &e., and he Was also an extensive contributor to periodical Hiterature, In 1856 he entered the home civil service of the East India Company, and on the transfer of the government of India to the Crown was appointed Sec- Tetary to the Political and Secret Department of the India Office, MR. SWINTON BOULT. The above named well known and respected gentleman died suddenly in Liverpool, England, on the 8th inst, Mr. Boult may besaid to have founded the Liverpooland London as well as the Globe Insurance Company. Of tho latter company he was manager for thirty-five years, His death will bo regretted on this side of the ‘Atlantic by a large cirele who knew him both ag an able man of business and a genial gentleman. JOHN M. KINGDOM. John M. Kingdom, author and playwright, formerly of London, England, died in this city, on the 24th inst, of congestion of the brain. He was for several ycars connected with the legal profession here, He was the author of many plays, noticeable for their good humor and pleasant incidents, which were produced and epjoyed successful rings upon the Eng! stage, Vrominent among them are “Which Is My Husband,”’ “Three Musketeers,” ‘‘Tancrod,”’ &e, He lately published Tennyson’s “Queen Mary’? and Bulwer’s plays, which he’ adapted for acting on the American stage, as well as for literary study. At the time of his death he was editing another series of dra- mas, with the same object. REV. N. KR. YOUNG. A Washington despatch announces the death of Rev. Father N. R. Young, of the Order of St, Dominic, which took place at Giesboro on Monday, He was fifty-eight years of age. MRS. TILLEY. A despatch from St. Jobn, N. B., says that Mrs, ‘Tiley, mother of Governor Tilley, died last night, REMOVAL OF CASTLE GARDEN. The taxpayers and property owners of the lower part of the city met last evening at No. 24 Greenwich street and heard the report of the committee appotnted on the previous evening to draft a petition to the Board of Aldermen requesting them not to sanction the project of removing the Castle Garden site from its present position to Ward’s island.
