The Natioval Bank of Commerce of Boston, State of Massachusetts, vs, The Merchants’ National Bank of Memphis, State of Tennessee—In error to the Circuit Court for the District of Massachusetts. —The fundamental question ip this case is whether a bill of lading of merchandise deliverable to order, when at- tached to a time draft and forwarded with the dra't to an agent for collection without any special instruc- Mons, may bo surrendered to the drawee on ac- teptance of the draft, or whether the agent’s duty is to hold the bill of lading after the acceptance tor the payment. It is true there are other qwestions growing out of portions of the evi- fence, as well as the finding of the jary, but they are questions of secondary importance. The bills ot exchange were drawn by cotton brokers resid. (ng in Memphis, Tenn,, on Green & Travis, merchants, residing in Boston. The United States vs, Archibald McKee and others—Appeal from the Court of Ciaima—The pose of the Stato of Virginia to dommion over that Tegion of country called the Territory Northwest of the Ohio River which is now filed with a population of many millions and divided into hve States of the Union, ‘was Hot undisputed in the days when that State was a province of Great Britain. Tho French had numerous settlements there, and the government of Great Britain claimed, both by the acquisition of Canada and by set- tiement, a large part of that loosely defined country. Sint had their military poste there, as well as pea ges. The Indians also denicd all right of the Coley ot Virginia to rule over them, and so! of the most warlike tribes of — that were known to occupy with claim of exclusive Tight the —_ part of the country. During the Rev- oluuonary War General George Rogers Clarke, acting under a comm‘ssion from the State of Virginia, fitted outa warlike expedition, and, starting trom the Falls of the Ohio, now called’ Louisville, made his appear- ance suddenly before the military pest of Kaskaskia, then held by the British, and captured it and sever: other posts; and, in the “course of one of the most ro- mautic campa which the history of tl region down to this day affords, effectually settled the right of Virginia to supremacy in that quarter, General Clarke was not very vigorously supported by Virginia in tiie enterprise, tor it occurred duriog ihe War of the Revolution, and that Commonwealth, as 8! now called herself, was engaged in more pressing affairs.
