Collection of Assessments Under the Old Ring Regime. 4 BECEIVERSINP THAT Wi8 WORTH om ar ‘The trial of an important sutt involving a charge of ‘he exaction of usurious interest against a sav- ings bank came to trial yesterday before Judge Larremore, holding Special Term. The suit is brought by Thomas L. Sandford against the Union Dime Sav- ings Bank, its object being to declare void certain mort gages which are acioud on platutif’s title to certain property belonging to him in Sixty-third street, on the ground of usurious interest. The complaint sets forth that the plaintiff, wishing to save bis property, which was about to be fold under foreclosure, applied to the defendant for a loan of $70,000, That \k oftice: Mthough refusing to Joan hin the uired sum, sai that if the mortgage could be paid and the premiums bought in legally by the bank fora greater rate than even a cent the loan might be effected, and that then, Everett Clapp, who had an interest in the prop- erty and was cl 4 with carrying the loan, made an agreement with Franeis T. Clark, under which the party who had bid on the Rogers but not paid for it, gave a deed of his bid to Gl who mortgaged it to Clapp, who was only an tee s0 that the Lank should. not directly take a mortgage, but leave the morteage legally transferred to them by Clapp, to whom Sand- Jord executed a quit decd of his, Clapp agreeing to Ww more than the legal interest to the amount of $9, ane F merge plains of usury to that amount, The régaye was for one year and) was dated May 9, and alot asked to hi ¢ cancelled. Wheeler H. Peckham, who appeared for the bank, mo red vo dist that Clark wi mee the plaintif’s agent in making tho jage and did not show a cause of action. judge Larremore allowed the case to stand over until ane if obtains leave to amend his complaint, IMPORTANT ADMIRALTY CASES, Yesterday Jadge Benedict, of the United Statos Dis- trict Court, rendered bis decision in the suits of William H. Mount ot al, va, The ‘steamship Benefactor; Will- mam Hirst et al. va, Tho Same, which were actions brought to recover $145,113 of the steamship Benocfac- tor for the loss of the schooner Susan Wright ina collision which occurred on February 26, 1875, Tho place of the collision was off ®quan Beach avout ten o’clock in the morning, the weather being fine and clear at the time. The steamer, Whieh was bound outward, wags running at the rate of ten knots an Lour, while tho schooner was going at the rate of eight kuots an hour, bound to New York. There ‘Was nothing, the Judge holds in his cision, to pre- Vent their passing cach other in safety. They came together without slacking their speed, and the schooner sank almost immediately, with her valuable cargo. Alter briefly reviewing. © evidence Judge Benedict pay “The fault causing the collision was tho fault of the steamer m attem; head to pass ahead of the schooner and so close to There was no necessity for \bus shaving the “satanic: and it was bighly im- proper so to do, The steamer, having chesen such a dangerous course, it matters not whether she mis- judged her avility by forty feet and so ran into the schooner, or whetber the schooner, by reason of a similar Inigjudgment, was led to suppose that the steamer could not clear her, and at the last moment juffed, A steamer has no right, under circumstances luke these, needlessly to place herselt fn such close proximity’ to & sailing vessel that the error of a mo- Mont will bring destruction. There must be a do- cree for the libellant, with an order of reference to ascertain the amount of loss,” On the 1st of August last the canal boat Late and Early, loaded with 250 tons of coal, in tow of the-steam- boat Connecticut, was run into and sunk by the brig Arctic, in tow of the steamboat Herald, off Four Miles Point on the Hudson River, The Arctic was libelled by Louts Meyer, the owner of the canal boat, for the damage done to his boat and the loss of thecargo. Judge Blatch- ford, in the United States District Court in Admiralty, yesterday filed a decision allowing reduced amounts for he canal boat and disallowing any claim for damage to the coal, as with regard to it the evidence was too vague. ‘The coul was carried by Meyer as freight, and was hot his property, but the decision did not disallow the claim on this account. THE STARKWEATHER SUIT. Afier the Ring robberies wero brought to light it was claimed that tho city had been defrauded of a large sum of monoy by the late Henry Starkweather, father- in-law of ex-Governor Hoffman, and who fora long lime was collector of assessments. The suit not hav- tng been brought to trial up to the decease of Mr. Stark- weather, the action was revived against Mrs. Lucinda R. Starkweather, bis wileand administratrix. After y in the courts, with the usual inter- ions and counter-motions, the case finally came to yesterday, before Judge Sanford, of the Superior Ce The case is being tried by the Jadge, without a jury, and will probably occupy two or three days, Ex-Attorney General Barlow appears for the Attorney General, who is the prosecutor, and Mr. Alanson P. Nash represented the defendants. It 1s un- becessary to recapitulate the aliegations set forth in the ‘ah ee as they have already been published detail, The judgment demanded is $130,608 31. Th answer sets up that Mr. Starkweather exacted only t fees allowed by statute, berg two-and-a-half per cent on all axsessments collected and two per centon as- Sessments unpaid and returned to the Bureau of Ar- tears. position of m: Ks RECEIVERS’ FEES. It is evidently worth something to bea receiver, Theodore M. Davis was appointed receiver of the Ocean National Bank. Having wound up tho duties of nis receivership, his next step—a usual one in such cases— was to get paid for his work. The matter was referred to Philo P. Ruggles, whose report was submitted to Judge Barrett, in Supreme Court, Chambers. The ref- eree reported that his services were worth $58,520 63, The ground of allowing such heavy tees is that the ap. pointment dates pack to December 12, 1871, that t receiver was successtul in collecting $400,000 ana doubtful claims growing out of therobbery of the vank ; that he secured one-hait of the Portage Lake debt, amounting to $1,600,000, which was considered com. paratively worthless, and that no expense incurred in employing extra counsel. Judge Barrett decided that he had no jurisdiction in the matter, but, while leaving the question of the settlement of the fees to the Comptroller of the Currency, gives it as his opinion that, upon the proofs submitted to the releree, no other report could have been made, SINGULAR “DIVORCE SUIT. Maurice Levy some three years ago became a disciple of St. Crispin and worked for Davis Fenlight, an Eliz. abeth street cobbler In humble circumstances. The young apprentice, a8 the story goes, took a fancy to Elizabeth Fenlight, the daughter ot his employer, sho at the time being about fourteen years of age. The fair Elizabeth did not reciprocate the affections ot the youthiui Maurice and refused to marry bi ger mother, however, thought it a good mate! id in. sisted upon her marrying him, On the way lice magistrate to be matried she und police: jn any such foolishucss, This brought her to terms, but ab the marriage service she refused to take her hus- band’s hand and declared she would never live with him, which declaration sne carried into effect. Her father, us ber guardian, has brought suit for divorce. The cane came ta trial yesterday beiore Juage Donohue, holding Supreme Court, Circuit, VERDICT FOR INJ URIES RECEIVED. In the suit of, John Suilivan against John Annin, John Cowan and George Vassar, to recover $10,000 damages for injuries received by the falling of an awn. ing oa West street, New York, the jury found a verdict for the defendant, Annin, who 18 the owner ofthe house; and a verdict against Cowan, the tenant, and Vassar, the contractor for 82.500. David, to vacate tho or- der of arrest. The suit was instituted by the plaintiff for the conversion of the title deed of 200,000 acres of , Kentucky land and for $60,000 damages. The complaint alleges that the deeds of the lands, which are valued at $1,000,000, were given to defendant to place on record, and that instead of so doing ho held them. David was arrested and held in $4,000 bail. Defendant’s counsel, in seeking his roleaso, claim that the lands are worth but little, hundreds of acres being offered for ten cents, ieee Gilbert reserved his decision.
