The complaint was yesterday submitted to Judge Speir, holding special term of the Superior Court, anda temporary mjanction was granted restraining the defendants from doing anything in Connection with the construction of their proposed road, In connection with the complaint an undertaking was aiso filed, Messrs. Burdett Smith against the Now York Tribune Asvociation, an order was yesterday entered by firection of J Speir, of the Superior Court, that Mr. Smith fle a new undertaking for costs. The suitof Mrs. Emma Eldridge against Moses Be Maclay and others, brought in the Supreme Court, was} yesterday discontinued by consent. This discontiou- ance follows as a necessity after the recent decision in the Surrogate’s Court im the Barmore will case, out of which the action grew. In the criminal branch of the United States Circutt Court, before Judgo Benedict, yesterday, Assistant Disirivt Attorney Foster asked that a panei of 100 petit jurors be summoned for the May term instead of sev- enty-two, the usual number. as thero would be cases brought to trial in which there might be difficulty in procuring unprejudiced jurors. King, of No. 598 Greenwich street, went to the policy shop at No, 3324 of the same street, and purchased for fifteen cents a policy ticket known asa ‘gig.’ He did this, he testified. not asa gambler, but for the purpose of obtaining evidenc against the place sufficient to break iwup.
