Cartter, of the Supreme Court of the District of Columbia, who issued the writ of habeas corpus in the case of Hallett Kilbourn, was asked this evening what action the Court would take next Tues- day in case the Sergeant-at-Arms of the House should ‘be ordered to disregard the writ, The Judge said toat M he knew what he should do it would not be proper for him to tell. To do so would be like giving a decis- Jon before the case was closed. He wanted to give the "aatter due consideration cnd hear all the arguments that might be advanced on either side, If the wnt were disobeyed it would be such a case as had Wever before arisen in the history of this government. ‘Able and experienced lawyers differed and held con- Ricting opinions as to the relative jurisdiction of the Mouse of Representatives and of the Court in this | Peculiar case. He said that the question to be deciaed ‘was whether the House of Representatives was a Judicial body. The Supreme Court could not intertere ‘With the rights of an interior court, If the House of }Representatives had judicial power and jurisdiction it would hol a prisoner by right of priority of possession. This was a year of precedents, and many legal ques+ Rions of great moment would have to be settled during this session of Congress. Judge Cartter said that he awas certain of one thing:—If he found that it was bis dduty to hold the Sergeant-at-Arms to account lor pot obeying the order of the Court he would do it, and in- waist on administering the law according to the best ‘ight he had, even if he had to take the prisoner's Place in the County Jail the next day. RECOVERY OF A CLAIM AGAINST THE NAVY DEPARTMENT. S. A. Wheelwright was examined to-day by the Com- mittee on ‘al Expenditures in reference to the claim of Tilton, Wheelwright & Co, against the Navy Department, in which they recovered about $30,000, Jn 1874, twelve years from the origin of said claim, Previous witnesses testified that it was gonerally un- derstood that moneys were puid to the Chief of Bureau offConstruction, Isaiah Hanscom, to Paymaster Thorn- ton and Congressmw Harris, of Missouri, to have the claim passed. Wheelwright testified that he has no knowledge ot money having boen paid, directly or in- idirectly, to any one except a clerk of the department for purely clerical services, by which it appears that Tilton paid said clerk one-fourth part of what Tilton Tepresented he had paid. This payment was for ser- ‘ices aciually rendered, and there wus no secrecy ‘in the matter. Outside of this he knew of no payment, sdirect or indirect, as the claim was recovered, as far as he knows, on its merits, several precedents under a Jaw of Congress fully justifying its payment, which ‘Jaw provides that contractors who furnished one hun dred per cent above face of contracts should be al_ Jowed market price for any excrssabove that, These Contracts were in 1861, and obliged contractors to fur- aish all of tbe articles specified which the government aight require; but, the war breaking out meanwhile, these démands on contractors were excessive and often reached ten times the fice of the contract. Tilton, however, claimed that he have to expend $7,000, and it seems quite Probable that the money he represented that he might have to pay was pot disbursed, but retained by said ‘Tiltop. _ At all events Wheelwright has not to this day, Rocerdingto his testimony, recovered from Tilton his share of the claim. DIUOUSSING THE HABEAS CORPUS PRIVILEGE IN TER LOWER HOUSE—THE CASE OF KII- ‘BOURN. Ia the House of Representatives to-day there was an animated discussion of the habeas corpus case of Hallet Kilbourn. Assconstitutional question 1s involved— that of the relative jurisdiction of, the lower house of Dongress and of the courts—the debate was extremely Interesting. ‘he members participating wore Hoar, of Massachusetts; Morrison, of Illinois; Knott, of Ker- tucky (chairman of the Judiciary Committee); Hurd, of Dhio; Kasson, of Iowa; Garfield, of Ohio; Frye, of Maive; Lynde, of Wisconsin; Lawrence, of Ohio, and Kelloy, of Pennsylvania. There was a strong sentiment im favor of maintaining the unlimited preroga- tive of the House in dealing with prisoners Tor contempt, and of repudiating the pretended rignt of any court to question it, In the last 150 years there ds in English history, however, an utter absence ot @ny precedent that would support this view. These who argued for the force of the habeas corpus act were among the ablest members of the House. Mr, Hard, who led the debate, at half-past five announced that he had just been informed by the Sergeant.at-Arms that Judge Cartter had appointed next Tuesday morning for the hearing of the case, and he therefore gave notice that he would call the previous question at three e’clock on Monday. The House then adjourned. ER DEFICIENCY APPROPRIATION AND THE MIS- SISSEPPI INVESTIGATION. The Senate Committee on Appropriations have fagreed to report favorably on the House Deficiency bill | on Monday, recommending that it be considered and passed immediately. With it will be passed the Senate Appropriation necessary to cover the expenses of the Investigation of the Mississippi election frauds. Twonty-five names were then counted off, commencing at the head of the list, and the parties were summoned, from whom the other sevea jurors were obtained. The only question which can arise on this point 1s:—Was the list of talesmen furnished to Marshal Sharpe by an outside party, and, if so, by whom? When the verdict was rendered it was ascertained that the jury stood four for conviction and eight for acquittal, Two of the tales- men votea for conviction and five for acquittal Two of the jurors who voted for acquittal obtained posi- tions under the District government very eoon after the trial. Itis understood that all these points will be matters of investigation, The Grand Jury also presented indictments against Leander K. Lippincott, William H. Grant and Francis X. Brosseau for con- spiracy to defraud the government. Mr. Lippincott, it will be recollected, was chief clerk of the General Land Office, and was recent!y dismissed from that position, THE SILVER BIL AND THE BUREAU OF EN- GRAVING AND PRINTING. The Silver bill was received at the Executive Man- sion to-day, and will be signed on Monday or Tuesday, The Bureau of Engraving and Printing will recom- mence operations to the extent allowed vy the appro- priation, and by the later part of the week will have all the force at work that 1a to be employed until the end of the present tiscal year. Mr. Jewell, the Chief of Bureau, says there will necessarily be a large reduction from the former nuim- ber of employés.
