THE COURTS. Refusal to Release from Jail Andy Roberts and Valentine Gleason. What Constitutes the Good Will of an Establishment. ATTACHMENT DAY IN THE COURTS. How a Collector Got Into Jail. ‘The efforts made by Andrew L. Roberts and Valen- tine Gleason to sccure their discharge from Ludlow Street Jail have not proved successful. as will be remembered, were arrested in June last on a eharge of realizing large sums from sorged railroad bouds and other securities, and their bail failing to obtain which fixed at $85,000; These parties, was they were incarcerated in prison. ‘Tho history of their two trials in connection with other defendants, in the Superior Court, by the National Trust Company and the New York Guaranty and Indemnity Company, fn which verdicts were obtained for $36,000 and $91,000, respectively, is well known, and docs not re- ire a recapitulation. Wearying of janguishing in durance vile application was recently made to Judge Curtis, holding Special Teri of the Superior Court, for thoir diseharge under the Insolvency act. The case wus argued at great length, Messes. Averill & Gardner appearing for the prisoners and Mr, William Wirt Hewitt as counsel, Messrs. Arnold, Elliott & White as attorneys, for the National Trust Company and the New York Guaranty and Indemnity Company. Mr, Hewitt raised the points that the Superior Court tion of Btatute, and that th did not have jurisdiction in the case, inasmuch as it was not a county court, and further, that the publica. tice Was not sullicient to comply with U name and residence of the viticer before whom the application should have been presented wero not stated tn the petition, as required by statute, Many other objections were also sub- mitted, and authorities cited iu support of the various neha raised. Judge Curtis gave his decision yester- day, sustaining the points taken by Mr, Howitt aud re- fusing to discharge the prisoners. GOOD WILL AS CAPITAL STOCK. James W. Astin and others brought suit aguinst Emily G. Ellingwood, for herself aud as executrix of other parties, for dissolution of partnership, an accounting, and the appointment of a receiver. Prior to 1870 the plaintifls and defendants were part owners of the Shipping and Commercial List and New York Prices Current, including the good will and the appurte- Bances of the establishment. In 1870 there was an agreement by which plaintifls and Selah C. Cornish were continued ia the management for five years from date, each of the Astins and Mr, O, E. Bourne, plain- Lifts, to receive harap bg of cent of the proiits, and cach of the other parties ap Cornish an amount equivalent to fifteen per cent of the net profits, which was to be cousidered part of the expenses and be included in tuem before division of the profits. forly per cent net profits was to plumtils and defendants. oll The remaining divided between written agree- Ment was made, and at tho expiration of the term plaintifts, without Cornish, continued the management, on the voderstanding that their compensation was to be a “reasonable” one. A dispute arose about the rompensation, and hence the present suit. The defend- Anis denied uny partnership, and the point came up whether the paper, the good will and appurtenances were capital stock. Judge Sedgwick, mm @ decision piven yesterday, holds that they are not capital stock, jut that plaintiffs are entitled to compensation since April, 1875, and are entitled to judgment for dissolu- tion; and he orders a reference ior an accounting. The Jast attachment was in the case of Samuel Galland, who has brought suit in the Supreme Court against ‘Timothy Stebbins, complaining that defendant, who was in is employment, represented him that he ad invented a hydraulic elevator, and had sold it and ‘ail improver bins Hydraulic that the stock w. purchase 400 its and modifications of it to the Steb- Slevator Company of San Francisco; of grout value, and induced him to ares at $20 cach; that defendant has pce patented important improvements to the ele- vator, and retuses to part with them, and that without them piaintil’s shares wouid be worthless. Jordan, No, 345 East Fourteenth street, and James Anderson, No. 439 East Twellth street, were held for trial on a charge of illggally trafficking in mineral water bottles. The law making an offence of this ature 4 misdemeanor was passed by the Legislature last year, and this is proba- bly the Orst time it has been enforced, Forty-two boxes, containing 420 mineral water bottles, wore re- covered from the prisoners, The property belongs to several different parties, A BAD GANG. Wilham Fenton, John Eagan and John Wicholaop; members of a dangerous gang of young men who in- habit the ridge of rocks westof Sixth avenue, near Fifty-seventh street, were arraigned on a charge of t- decently assaulting Mrs. Bridget Fitzpatrick, also a resident of the rocks. Since the night of the alleged outrage another woman was assaulted in the same neighborhood, but in that instance the police suc- ceeded in arresting one of the gang on the spot, and he is pow on Blackwell’s Island for the otfence. His name is George Chrystie, and it is said that be was Mrs. Fitzpatrick’s rincipal assailant also, Alter an examination Nicholson way flacd $10 and the others were held for trial. MRS. KLEY'S CASE. ‘The case of Annie C. Kley, charged with false pre- tences, was continued in this Court yesterday. Mrs. Geyer, the complainant, repeated her former allega- tions, adding, however, that the accused had repro- sented to her that her husband held a clerkship in Washington with a salary of $100 a week, and that her counsel, Mr. Purdy, had in his hands $3,500 be- longing to her which he had recovered ina law suit. Mr. Purdy baving failed to appear as a witness for the prosecution through seme misapprehension, an ad- Journment was grantea. He is expected to disprove the allegation that he has $3,500 belonging to Mrs. Kiley in his keeping. Another witness is expected from Washington to testify that Mrs. Kley’s statement regarding her husband is entirely untrue. Mr, Alger- non S Sullivan and Mr. Johu Townsend are the cow sel for Mrs. Kley, and it is probable that some one will have to answer a charge of conspiracy before long. POLICE COURT NOTES.
