THE COURTS Sentence of Ex-Deputy Col-' lector Des Anges. THE MURDERED PEDLER. Effort to Save the Convicted Mur- derers from the Gallows. Ex-Deputy Collector Des Anges, recently found guilty of complicity in smuggling goods through the Ap- praiser’s office atan under valuation, was yesterday brought before Judge Benedict, of the Umited States Cireuit Court, to be sentenced, Des Anges looked completely broken down, His wife remained in the adjoining room, evidently not feeling berselt able to listen to the pi of the sentence. Judge pads in passing sentence, addressed the prisouer as follows:—You have been charged with t Offence of conspiring against the United State: Siter'e fair trial you have been found guilty, [tr mains for the Court to"inilict upon you proper punish- ment, You were an oificer in whom confidence was placed. You abused the place and lent your- self to fraud. You are & man of intelligence, and know that you ean bring forward no plea of miti- {ation forthe erimes you have committed and con- nived at. The punishment is hardly adequate to the offence. You are sentenced to two years’ imprison- ment and a fine of $10,000, and to remain in Albany Penitentiary until the said sum is paid. Although Des Anges had based a teeble hope on the points made by his counsel that some mercy would shown to him, the cold, stern, sharp words of the Judge seemed to full like ice upon his heart, and he almost fainted. The United States deputy marshals assisted him from the room, und afteran affecting inter- view with his wife he was taken back to Ludlow Street Jail, He will be taken to Albany on Monday. THE LYDIG’S WOODS MURDER. At the opening of \he Court of Oyer and Terminer yesterday, before Judge Barrett, Messrs, William F, Kintzing and John 0. Mott, counsel for Weston, Ellis ‘nd Thompson, the three negroes under sentence of death for the murder of the pedler, Abraham Weis- burg, at Lydig’s Woods last summer, made application for a writ of error and stay of proceedings, During the trial the counsel, as will be remembered, raised several technical objections, upon which they now base their application, The principal grounds forming the basis of the application are—first, that the Court erred in overruling a special plea interposed challenging the array of petit jurors, the same having been drawn by Thomas Dunlap, instead of Douglas Taylor, Com- missioner of Jurors; second, that the Court of Oyer and ‘Terminer had no jurisdiction to try the indictment, the same having been found in the Court of General Sessions and transferred, and third, that Judge Barrett erred upon the trial in not Appointing triers to try the question of the competency of 4 proposed juror upon a challenge to favor, the law authorizing the Court to act as trier upon a challenge to favor being claimed to be unconstitutional, it being In derogation of the common law right of trial by jury. The case was submitted without argument, and de- cision reserved. Should Judge Barrett refuse to grant astay Messrs. Mott and Kintzing will make an applica- lion to some other justice of the Supreme Court, vested with like power, DECISIONS. SUPREME COURT CHAMBERS. The General Term of the Court of Common Pleas has adjourned till the 6th of December, when it will meet to render decisions upon cases argued during the present term. In the Central Branch Union Pacific Railroad suit, Judge Donohue, in Supreme Court, Chambers, yester- day, on application of Sariuel L. Tredwell, granted an order for the examination before trial of Effingham H. Nichols, late treasurer of the road. In the matter of the United States against John A, Lant, accused of sending improper hterature through the United States mails, the motion to order the com- plainante to furnish a bill of particulars was argued be- fore Judge Benedict in the United States Circuit Court, yesterday, and the motion denied. ‘The husband of Ellen O'Connell, being about to go to sea, conveyed certain property to Francis Gillen, to be reconveyed to his wife. There were various judgments against Gillen, and bis creditors claimed a lien on the property thus conveyed to him, Mrs, O'Connell brought suitin the Supreme Court, Special Term, to have these judgments declared not a lien on the prop- erty, and Judge Van Vorst yesterday so decided, In the United States District Court yesterday suit was brought before Judge Blatchford by Detweller, Street & Co., against Herman Cottrell. § About two years ago the firm of Lyon & Co. became bankrupt, and ‘the defendant, Cottrell, was appointed assignee. The creditors, Messrs, Detweller, Street & Co., and othery, claim through their counsel, Raphael Moses, that the assignee had combined with one of the creditors to give him possession of the property, worth $30,000, by pay- Ing him $10,000, ‘The plaintiff’ now brings this suit to hold the assignee liable for the whole amount. Decision was reserved. Suit was brought in the United States District Court ey by Secretary Bliss, on behalf of the United tates, against Thomas T. Sturgis and Susan Sturgis. Thomas Sturgis died possetsed of personal property worth $100,000, and be will appointed the defendants bis executor and executrix. The will was duly proved, tnd the defendants received and held in trust, i their Aduciary capacity, a certain legacy or interest arising from the will, “wherein my son, George W, M. Sturgis, hall receive, after he becomes ot age, the sum of $100,000, Which will be on the 2st day of February, 4872." hen the terms of the will were being fulfilled the United States claim was not thought of, and a duty or tax upon the value of said legacy in excess of the $100,000 at the rate of $1 for every $100, bac A $199, with’ interest thereon from the first date of tho legacy, is claitned by the plaintiff. James MeGrath, the man who escaped from Ludlow Street Jail two weeks ago, while contined there under a charge of counterfeiting United States coin, and who was captured by United States Secret Service Detective Drummond on board of an outward bound ocean steamer at Philadelphia, was yesterday arraigned before Judge Benedict, in the United States Circuit Court, pleaded guilty to the charge, and said that door of the prison open and walked out. Sentence was postponed until next Saturday to admit evidence of his character. ‘There was quite a lengthy argument yesterday in Su- preme Court, Chambers, before Judge Donohue, grow- ing out of a dispute between the 7rivune and Sun asso- ciations as to whether workmen for the latter can oc- cupy ground belonging to the Tribune for the purpose of taking down the easterly wali of the Sun Building, clared by the Superintendent of Buildings to be un- safe. A temporary injunction was obtained against the Sun Association aud the Superintendent of Buildings, restraining them from going on the Tribune property. The argument was on the question as to the permanency or otherwise of this injunction, It was claimed on be- halt of the Tribune that the act of the Superintendent of Buildings was unconstitutional and that if the work ‘was alluwed to go on the Tribune Association would be ‘irreparably damaged" and would be subjected toa multiplicity of suits from tenants to whom it had agreed to lurnish steam facilities. All this was denied on behalf of the Sun, and at the conclusion of the ar- qument Judge Donohue took the papers, announcing that in a few days he would give his decision. William White, Jr, and Charles Sothern were charged with having assaulted and robbed Charles Smith and Peter Shonberg, Norwegian sailors, of $100. The complainants arrived in this port a few days ago, and took up lodgings at the sailors’ boarding house, No. 89 Oliver street, of which White’s father is pro- rietor, On Wednesday night, after drinking in neigh- oring saloons, they went to White’s place to sleep. A dark and crooked hallway led to their apartments, While in the corridor Smith was assuulted, he alleges, by White, struck on the head and robbed of $100, Shonberg also stated that he too was assaulted, upon remonstrating with White by the latter’s bartender, Charles Sothern, and bad! iy beaten.
