THE COURTS. An examination was commenced yesterday by order \% ef Judge Brady, of the Supreme Court, on the applica- ‘tion of Joseph Clifton, to recover the custody of his young daughter, Teresa Clifton, at present in the care of the Sheltering Arms, The father avows that he did not know that the house of Mrs. Annie Small, from which she was taken, was a panel house, The object of the examination is to show the fitness or otherwise of the father to have the custody of the child.. Mr, John D. Townsend appears for the father and United States (Commissioner Davenport in opposition, On the affidavit of J. W. Drexel and Albert Gallup, in the suit of Drexel, Morgan & Co, against the Bank of California to recover $25,000 in gold, Judge Brady, at Supreme Court, Chambers, yesterday, granted the usual order of publication, The affidayits set forth that the defendant is a foreign corporation; that no officer of the defendant could be found withm the State on whom service could be made; that the president of the ¥ank is dead, and that the cashier lives in San Francisco, A warrant of attachment was also granted yesterday by. Judge Brady against the property in this State belonging to tho Bank of California in a suit brought by Joseph Hubson and others to recover $7,494 40 in gold. A similar attachment was granted in the suit of Henry H. Fargo & Co,, the last named’ sult being brought on vilis of exchange for $100,009, of which the Bank of North America is payee. A warrant of attachment was likewise yesterday granted by Judge Brady against preene in this State belonging to the Gold Bank and Trust Company of San Francisco to recover upon two drafts for $4,628 41. ‘The suitors in the case are the Equitable Life Assurance Society of this city, The assignees of Friend & Pitts antl Samuel A. Castle & Co, filed their bonds yesterday, Mr. James Glassfora and Daniel E, Pedell being the ‘bondsmen of the for- mer in $10,000, and Jacob Waldheimer and J. E, Hymes of the latter in $60,000, In both cases the sureties Justified in double the amount of the bond, A voluntary petition in bankruptey was fled yester- day in the United States District Court by Messrs. Edward 8, and Joseph Torry, owners of patents on door springs, weather strips and ice cream freezers. ‘The firm states that its Habilities do not exceed $30,000, A young man, named Hammond Wittowskl, 'was brought before United States Commissioner Osborn ye@terday charged with taking from the New York ‘ost Oifice, on August 31, 1875, a letter addressed to Julius Oppelhover, and’with unlawfully opening the id letter. WANTED AN OWNER, Yesterday afternoon Officer Hogan, of the Sixth pre- einct, arrested in Baxter street, two colored men named Dan Williams and Peter Cooperson, having in their possession a valuable black silk. suit which they were trying to dispose of. When asked how they came by the property they were unable to give any satisfactory account, and so were locked up. Justice Duffy subse- quently held them to await the appearance of an owner of the property. The prisoners are said to belong to the notorious Battle row gang of Williamsburg, SELLING LIQUOR WITHOUT LICENSE, Frederick Varley, a brother of Reddy the Black- sinith, was yesterday heid to answer in $100 bail on a charge of selling liquor without license. He gave bail and was release: WASHINGTON PLACE POLICE COURT. Before Judge Bixby. AN ALLEGED GAMBLING HOUSE RAIDED, Captain Steers, of the Twenty-ninth precinct, made a raid on an alleged gambling house at No, 17 West ‘Twenty-eighth street about eleven o'clock Wednesday night and arrested four persons named Virgil Whit- comb, James E. Williams, Henry Wilhams and John Smith. Whitcomb, who’ is said to be the proprietor, was held in $500 bail to answer by Judge Bixby yester: day, and the rest were discharged. A DESPERATE TILL-TAPPER. Gustave Bischoff, of No, 308 Eighth avenue, yesterday morning caught a man named James Burns, of No. 864 Ninth avenue, in the act of robbing his’ money drawer. As soon as Burns discovered that he was detected he pulled out a pistol and threateued to shoot Mr. Bischoff unless he was allowed to leave the store. Mr. Bischoff, in spite of Burns’ threat, called in Officer Cairns, of the Sixteenth precinct, who took Burns into custody. Judge Bixby held the prisoner on two separate charges of petit larceny and felonious assault and battery. ESSEX MARKET POLICE COURT. Before Judge Morgan, DANGEROUS ACQUAINTANCES. About seven o'clock yesterday morning August Rein- hardt, of No. 127 Delancey street, went into Owen Geoghegan’s saloon, at No, 103 Bowery, to take a drink. There he met a girl named Mary Maher, whom he invited to join him ina social glass. Mary accepted the invitation and engaged August in a conversation for a few minutes, during which time she managed to rob him of a wateh and chain anda pocket knife, She then bid him good morning and left the saloon, Im- mediately after her departure August missed his watch, and, running out in the street, saw Mary going down the Bowery toward Canal street. He caught her at the corner of Eldridge and Canal streets, and when he demanded the watch from her she turned on him like a young tigress, and, were it not for the timely intervention of Detective Sullivan, nth pre , August would have suffered se- physical injuries, as well as the loss of his watch, Mary was arrested, brought to the Eldridge street sta- tion house and the stolen property was found in her possession. Judge Morgan yesterday afternoon com- mitted her in $1,000 bail to auswer at the Court of Gen- eral Sessions. Leonard, executor. et al.—In error to tha Circuit ‘T OF Prop- NEW YORK HERALD, FRIDAY, SEPTEMBER 3, 1875.—TRIPLE SHEET “Sourt for the Western District of Michigan.—Mr. Jns- tice Hunt delivered the opinion of the Court.—Freder. ick B, Leonard, of whom the defendants in error are the executors, brought his action in the Circuit Court, claiming to recover from the Jennisons, the plaintiffs in error, $25,000, the alleged value of certain sawed lum- ber taken by them from his possession, The canse was submitted to the Court for trial without the interven- tion of a jury. The taking of the lumber was proved ‘and its value Was found to be $17,133, which was after- ward reduced to $11.461, for which sum judgment was ordered for the plaintiff. ‘The trial was before the Court without the inter- vention of a jury, by virtue of the act of March 8, 1865 (13 Stat, 501); and the record contains a special finding of facta, Leonard and others, under the style of the Beldon Lumber Company, were the owners of certain lands in Michigan, " respecting which a con- tract of September = 1, 1866, was = made with Edward Cole, a consideration of $27,000, to be paid to them, they agreed to. sell and convey to Cole the lands described. Cole agreed to pay for them the sum of $27,000, as follows, viz. :—$10,000 with interest in one year, the same sum with interest in two years, the balance of $7,000 with interest at the end of ‘three years, It was further agreed that-for every 1,000 fect of timber cut and removed Cole should pay monthly the sum of $3, and he agreed to cut and Temove at least 8,000,000 of feet every year. In the event that the monthly payments fell short of the annual payment, Cole was to make up the deficiency prior to June 11, 1847. Cole-executed to the Jennisons, the par- ties to this suit, a bill of sale of 1,000,000 feet of the logs cut on said premises, and three chattel mortgages upon the same to secure them for advances made to him. The Jennisons, not being paid the amounts se- cured by their mortgages, entered upon the lands in question early in July, 1867, and took possession of the timber cut by Gole, ‘and not theretofore re- moved, and commenced to remove the same, On the 20th of that month they entered into anagreement by which they recognized the interest of Leonard in the property, and undertook to pay what was due on the contract to Leonard, and what should become due so long as they “operated” under said chattel mortgage, A. dispute soon arose as to the amount thus due, and on the 4th of September, 1867, the Jennisons refused further to “operate” on the land, but abandoned the land and have not since removed any timber therefrom. Leonard then entered into pos- session of the lands, for the alleged breach of contract by the non-payment of $5,282 70 then due and unpaid on the Cole contract, and took possession of all the down timber not removed, amounting to 1,122,000 feet, board measure. At an ex- pense of $5,369 64 this timber was transported by Leonard to a mill near the mouth of the Grand River, sawed into lumber, and placed on vessels for the Chicago market, without interference with his posses- sion, removal or manufacture by any one. While thus on the vessels, and about to be sent to Chicago, the Jennisons seized the lumber, sold and converted it to their own use, ' claiming thatthe logs from which it was manufactured were theirs by virtue of the mortgages to them from Cole, hereinbefore described, It is for this tak- ing the action 1s brought. There 1s but a single question of law in the case, viz., Are the fats found sufficient to support the judgment?’ ‘This question may be affected by a greater or less number of considerations, but tt is the sole question, Looking at the circumstances that Coie had refused to perform and had surrendered aud assigned all his interést in the contract and the timber; that the Jennisons had ceased their operations and had abandoned the land; that+ Leonard had entered into possession of the land and the timber cu and had caused the same to be removed and sawed into boards; that the right of the Jennisons ex- tended only to such timber as had been cut where the mortgage was executed; that there is no evidence that the timber in question had then been cut, it seems sufficiently plain, not only that the Leonards’ were the owners of and lawfully in possession of the timber and lumber in question, but that their right was assente!l to by all parties who were in a condition to question it. The Jennisons not only failed to show any title to the lumber at any tine, but voluntarily abandoned what- ever interest they might be supposed to have had. Judgment affirmed, THE MURDER OF CAPTAIN LAWRENCE. The pursuit of the unknown murderer of Captain Lawrence, of the schooner. Joseph E. Potts, though at first too long delayed, is now persistent, and with some hope of a successful result, There were rumors yester- day morning that he had been arrested at East Chester, on the Sound, only ashort distance from the scene of the murder, put they proved to be unfounded. District Attorney Corning yesterday ascertained that Michael Welsh, who was on the tugboat which towed the Potts up to Cow Bay, was not acquainted with the murderous mate’s name, althongh he remembered seeing him. The Claribelle, on which the mate sailed before he ship- ped with Captain’ Lawrence, had not arrived at Bos- ton last evening, and nothing could be learned from that source, There is another clew, which Officer Smith, of Flushing, is now working out, which it is thought will lead to something tangible, not only as to the mur- derer’s name but his whereabouts.
