Suit has been brought against the Manhattan Telegraph and Quotation Company and F. A, Ab bott by T. J. Kiernan, growing ‘out of rivairy in stock telegraphing. Mr. Kiernan alleges that he had a contract with the Gola and Stock Company; that he receives under such contract cipher Messages through the Gold and Stock ‘Tele- graph Company, and also jrom his own private agent’s foreign quotations of operations in the @Old and stock markets atan expense of $2,500 @ mouth, and that the Manhattan Telegraph and Quotation Company, through Abbott, procure | these quotations surreptitiously. deny these allegations, and claim they were pub- lished news, except such as they obtained legitimately. The case came to trial yesterday | before sudge Van Brant and wil probably occupy two or three days, There are some dozen suits pending against the | cliy for arrears of rent of uuildings used as Armories and drilirooms, involving the payment vf about $250,000, and algo the question o1 the payment of some $300,000 annual rent under leases executed to the city. One of tnese suits was that brought by Daniel Fallon to recover $17,500 arrears of rent for Neilson Hall, which was occupied by the Sixth regiment. The prem- ises were leased for ten years, at an annual rent of $14,000. The amount sued for was for a year and a@ quarter’s rent, due on the Ist of April last. Payment was refused on the ground that the rent charged was excessive, and the question was also raised of an alleged fraudulent collusion between the lessee and certain members of the Board of Supervisers. A trial was hac, whico resuited in a verdict for the plaintif™ An appeal was taken from the verdict to the Supreme Court, General Term, where the case came up jor argument yesterday before Judges Davis, Daniels and Biady. Alter a lengthy argument, Mr. James C, Carter appearing on benalr of the city and F. Smyth on behalf of the respondent, the Court took the papers. Mr. Vau Holland was engaged for $5 a day to repair and rebind books and maps in the Regiz- ter's office. His bill amounted to $370, which the Oomptrolier refused to pay, claiming that the charge was excessive. Suit was brought against ube city, and the case waa tried yesterday be/ore dJuage Lawrence in the Supreme Court, It was shown that the price charged was fair and legiti- mate, and the jury rendered a verdict for $511 34, the fall amount claimed, with interest. THE EMMA MINE IN COURT. The shareholders in the Emma Silver Mining Company of London are not nighly eulogistic of investments in American mining stock. They set gown the Emma Mine speculation as a second South Sea bubble, but with more of lingering hopeiuloess than was lett to the victims of the Soutn Seq speculation, they hope’ to get their money back, The particulars of their suit against Senator Stewart, General H. H. Baxter and Trenor W. Park, charged with being the manipu- lators of the sale, which suit is brought for $5,000,000, nave already been published, and, thereiore, do not require recapitulation. Having been serve. with the complaint, the accused par- ties show an alert readiness to meet tbe charges Of fraud made against them. As a preliminary Condition, however, to the prosecution of the suit, it Was insisted that the suitors should give security for coss. A motion to tnis effect was made before Judge Donohue, in Supreme Court, Cham- vera, by Mr. S. E. Ubittenden on benalf of Messrs. Baxter & Park, Senator Stewart not appearing tous far on the papers asa party to the proceedings, The case occupied the attention of the Court but for a brief period, the reading of some papers anda subsequent sbort argument, of course, comprising all that was done. As throwing additional light on the inceptive stages of what p romises to be One of the most interesting civil suits of the times, the papers, Which are given tully below, Will be tound interesting. Btn yours, W. MaCFARLAND, ARGUMENT OF COU 7 The points urged ior une motion by Mr. Chitten- den were that the statute authorizes the vourt to make an order upon the plaints for security in such an amoune is will Insure to tae defendants the payment of all their costs ir they recover in the action; Wat such security must be lor the benefit of all ihe defendants; tnat the plaimeiils are a jore elgn corporation, having no property within the jurisdiction of the Court, and that the defendants have ho security ior their costs beyond the order Vat the Coart shail make in the premises, It was urged, iurther, that tis 1s an action la Which toe Diaintiits claim a recovery Jarger probably in amount than any other action now pending iu uns court; that it involves gut only the fortunes Olall the defendants, but their characters and representations, und’ that the defendants have no alternative i they would preserve either their fortunes or their character than 10 meet these allegations Of iraud aud have tue issues 1ound by ajury. Itis aiso stated that the present sult Was brought more than three years after the sale of the mive; that they were fuily and truly in- formed of all the facts 1m relation to the mine rior to the sale; that they worked the mine ang ad it examined | by Ubree different committees of the shareholders, and aiter twelve montns’ exam- pation and experience expressed their eutire satisfaction With the purchase, and that the Prest- dent of the company re to the deiendant (Park) a letter, dated at Sait Lake, seplemver 26, 1873, in which he say: 1 Unink it 18 quite impos- sible for apy one to go through without a tli con- Viction that it 1s @ mine of immense weaith and that we are In possession of a splendid property.” In the course of iurther remarks counsel stated that tnere are some 1,800 shareiolde:s, the taking of whose test'mony wtil involve large expense, Ww and that the discovery, bistory, production | and appearance of the mine at the | time. of tne sale ar all involved in | the issues, and requiring imouy of miners and mining experts in Utah. Upon this state of tacts it was insisted that security in a sum not less than $100,000 should be required of the plainuds. Mr. McFarland, in opposition, insisted that the umount o/ security asked was unprecedented and not all required under tue circumstances of the case, He urged this wiih great lorce and cited numerous authorities \n support of his argument. THE RESULT. Judge Donohue, having heard the papers read as given above and the arguments of counsel, took the papers, together witn the briels ef counsel, jor more extended examination and re- view ol the case. He gave his ra oruy @iterward, fixing the sevurity at and Girected an order to be entered to this Seitect. DECISIONS. i SUPREME COURT—CHAMBERS.
