THE SIX HUNDRED POOR GERMANS who were induced to buy lotsa in Astoria from Stemmler, believing them to be free of all encum- | brance, have found out to their sorrow that they | bad been deceived, that there were heavy mortgages on the lots; and now that | the mortgagees bave proceeded, under a | judgment of! foreclosure, to sell the fand which these deluded victims already re- garded as their own, their consternation and | indignation are unbounded. It will be remembered that the suit against Gerhard Schneider, Jacob Simon, Jacob Schmey, August Albrecht and Wil- helm Kernbacn, the “officers”? of the “association,” failed to restore to the poor victims the money out of which they had been swindied, The com- plaint m that case, as drawn up by Mr, Henry Welle, gives the beso hisiory of this remarkable fraud, and recites that the above-named defend- ants conspired and combined together with the design and intent and for the purpose of cheating and defrauding the plaintiffs to style themseives 8p association; tuat Jacob Simon was styled the secretary and acted as the chiel msugator and | Manager of the iraud, and that they issued cir- culars in the German lauguage staung tuat they | were an association jounded tur the purpose of | enabling mechanics to make secure Mvestments am real estate and TO ACQUIRE HOMESTEADS FOR THEMSELVES, = | The complaint goes on tu show that tue associa- tion were selling lands at the rate of $300 per lot, payable in instalments of $2 per weck, which were mortgagea, and that they conceaied irom the alntifis the existence of the mortgages so that ue land would now be sold under a foreclosure. ‘The Officers of the association bought these lands | from ex-Justice Stemmier, who bad purchased them rom Bacon ana Hyde ior $220,000. He only paid $1,000 and $219,000 remainea on mortgage, and of this enormous mortgage the purchasers of the los knew nothing. The reieree replied that his deience had been that he | gave these warrantee deeds to Simon, tte treas- | urer of the bogus association, with the instruction that they were hot to be delivered to the pur- chasers of the lots until the reiease from the mor had beeu obtamwed, and that they were, | nevertheless, given to them without his know!- edge or sanction, Mr. Alkert was of the Opinion ‘that the ignorance of these poor Germans was as much the cause of thelr misiortuue 46 anything else, for they jailed TO EXAMINE THE TITLE TO THE LAND. The land would have to be svld to satisfy the amount due to the plaintiffs, Bacon & Hyde, which ‘Was $190,000, less the amount already reailzed by @ale and releases, Mr. Aikert was unmabie to give 4D Opinion as to Who were the most guilty parties in the shameiul transaction. Mr. Browne, the attorney for Bacon & Hyde, said the facts were simpiy these:—he plainc iis sola their farm in Astoria to Stemmier and his wile @pd took from them a mortgage for $179,000, no portion of which had been paid, neither principal Nor interest. ‘They proceeded to toreciose tue mortgage and found that agreat many of these | lots had been sold to these poor Germans. They | made all the purchasers defendants to the action, and the usual decree o! foreclosure was obtained. Under that decree the property would be sold, and now Bacon & Hyde, reaiizing the hardships of these Germans, were Wiiing (Co execute releases | to them, offering to take ten per cent and give them three years in which to pay tue remainder, Mr. Browne's opinion was that taese Germans had been either grossiy deceived or been the victuums of their own ignorance aod recklessness. Tne case Was undoubtedly a very hard one, THE BOARD OF TRUSTEES, into whose care Stetamier turned over the prop- erty at tbe time he made the settiement, have done all that was ip their power to protect the victims against josing aii they had paid. Mr. Feid- man, one of the trustees, said yesterday that the first element of fraud was in the fact that these “ofticers”’ existed beiore there w en & society, and aiso that Schmey and Schneider made a con- tract with Stemmler to buy lots Jor $300 apiece in the name of a society which positiveiy did not exist. In answer to @ call signed by Peter Wood, As- semblyman of the district, for a meeting of “ah delegates opposed to usurpation and misrepresen- tation and in favor of taking an interest in their own business,” @ large meeting of democrats was held in the New York Assembly Rooms, on Iwenty- second street and First avenue, lastevening. The greatest enthustasm prevailed, and a series of reso- lutions were passed by @ unanimous vote deciar- ing that m the primary election im 1873 for dele- gstes to the General Committee of Tammany Hall for 1874 “gross frauds were perpetrated” by the importation of men into the district who bad no right to vete and who did vote, thus cheating the dond fide voters of the district out of their rights therein, It was also resolved that a vigi- lance committee of 100 should be appointed to “as- sist the poice inthe discharge of their duty in causing the arrest of any imported voter who should appear at the pray election to-night in the district.” A resolution Was passed denounc- ing Michael Lyons “as & man unit to be an in- spector of the primary election, as shown by his action in Causing the police, by Misrepresentauon, w disperse a peaceable meetng in the Second dis- trict, held to Seventeentn street and avenue C,.”” A resolution requesting Joan Kelly to have Lyons removed trom the position of inspector was also adopted. Another resolution dectared the meeting’s “want of confidence” and “want of respect for the so-called and assumed Jeader, Maurice J. Power,” and closing thus, ‘We will | not march to battle under bis dictation,” was also passed. A fifth resoluuon exonerated Captain ‘Tynan, of the police, from all blame in dispersing the meeting of ey nigot, he having done so on “the maisrepresentations made by Michael Lyons, by the direction of Power.” It will be seen by tnese resolutions that the fignt in the district between the factions 18 growing more and more bitter every day, and that there wili be lively times in the district to-night, THE GBBMAN DEMOCRATS, Definite Organization of the Central Campaign Committee. HARTFORD, Oct. 6, 1874, Of the 166 towns in the State official re.nrns have been received from 132, Of these fifty elect a clean democratic ticket for Selectmen and Town Cierk, Which officers comprise the Board of Registra- tion of electors; filty elect the clean repubiican ticket and thirty-two elect mixed tickets, constitutional amendment, giving towns of 5,000 inhabitants two representatives in the Legista- | ¢ tare, the vote in the above town is 27,786 yes and 8,941 no. About half of the towns in the State voted on the license question, and nearly one-half of these voted against the license, thus securing practical probinition to about one-quarter of the towns in the State.
