The habeas corpus case of the boy James O'Brien, alleged to have been committed by Police | Justice Smith without an opportnnity to make a fefence, came up yesterday in Supreme corrt, Champers. The District Attorney stated that the papers in the office show the allegations of the re- lator to be untiue, and that he was informed the defor dant was examined, and that bis mother was a witness for bim, and that an alini was at- tempted to be proved. Shortly after His Honor took his seat on the bench yesterday District Attorney Rollins moved the trial of Martin. Nachtman, charged with vio- lating the Excise law. Mr. John McKeon said that he had had only forty- eight hours’ notice and tho defendant was in Al- bany attending some convention. My. Rollins re- | plied that, the charge being only a misdemeanor, the on could proceed in the absence of the ac: cused. Mr. McKeon urged a postponement of the trial, remarking ‘Mat a case vo that kind ought not to be tried just beiore election, when both sides wanted to get the temperance and anti-temper- ance voters, Ihe matter would céntinue to be discussed in the newspapers, and he moved that the case be put over till the November term. Mr. Rollins replied, saying that there would be questions of law discussed by the learned counsel, but Mr. Nachtman’s presence was not needed. Mr. Terrench took the proposition into considera- tion, and alter paying a lawyer, whose name does not appear, $75 for examining the land, the title, &c. was iniormed by him that the property was good and the speculation a very fine one, Acting on this advice a mortgage for five hundred and some odd dollars was drawn up, and the money paid to | the little man, Whose uame is Joseph Beck.
