THE COURTS. The Legal Tribulations of Mme. Lucca. Important Decision as to Theatre Licenses. Sharkey’s Case—A Question of Court Jurisdiction. Several liquor dealers were up for examination yesterday before United States Commissioner Shiclds, charged with non-payment of the internal revenue tax levied on their business, Some were committed to await the action of the Grand Jury, others being discharged. The examination in the case of James McUarthy, charged with the killing of John Smith, allas Wright, at sea, on board of the ship Cultivator, was yesterday postponed by United States vom- missioner Osborn to Wednesday next. A sailor named Hansen, of the Norwegian bark Lief Ericsen, was yesterday committed to await the action of the Grand Jury, charged with mu- tinous and disorderly conduct on board the vessel, The old adage, “out of sight, out of mind,” does not prove to be true in the case of Joan J. Shar- key, the fugitive murderer, His name comes up wtill occasionally in the courts, Appiication was made yesterday in Supreme Court, Chambers, ber fore Judge Lawrence, for a writ Of peremptory Mandamus against Mr. Sparks, the Clerk of the Court of General Sessions, to return the writ of certiorari issued in tne case. AS no one appeared in opposition the application was granted by delault. The object as stated is to enable the case to go to the Supreme Court, General Term, pre- liminary to carrying it to the Court of Appeals. In this connection it will be remembered, however, | that the General Term decided some time since that inasmuch as Sharkey had absconded, Mr. Sparks was not obliged to make any return to the ‘writ of certiorari. MME. LUCCA AGAIN IN COURT. Though far away in Switzerland, breathing its | invigorating mountain air, and with recuperated health preparing for more brilliant operatic triumphs in the future, Mme. Lucca has left for her lawyers in this city work enough to keep them pretty busy for some time to come. Lucca, Mme. di Marssa, Signor Vizzani, the tenor, and others, went to Havana under the managerial care of Henry ©. Jarrett. ‘The arrangement wade was, as alleged, that the profits shonta be used—tirst, to pay tne current expenses; second, to pay the artists} and third, that the surplus should be used co can- cel the indebtedness to the artists of Mr. Maretzek. Mme. Lucca was not to be pecuniarily responsibie im any Way. ‘The season terminated with no pay- ments worth mentioning to any ol the artists ex- cept to Mme. di Murska before it was announced | that there were no junds to pay the minor artists. Mme Lucca remained, and appeared | Bt several performances on purpuse 10 | enable all to get tne iull amount of their | jues. But ior all this they did not get their | money, the reason given by Mr. Jarrett being that | the leading artists had absorbed all the receipts. | Mr. Jarrett commenced proceedings in Havana, | making Lucca, Murska and Vizzani liabie for the | deticiencies in payments. The result was that | these parties had to deposit $9,000 with the Aus- | } trian Consul before they could leave the isiand; and now, as already stated, five suits have been Seouns against Mme. Lucca in the Marine Court, growing out of this Havana business. A motion as iuade yesterday, before Judge McAdam, at | Inamvers, to compel the plaintitr fo find security for costs, on the ground ot being a non-resident. Mme. Lucca denies by answer any indebtedness pn her part. Affidavits were submitted | through her counsel, Messrs, Townsend, Weed & Aub, showiug that Mr. Jarrett leit the Everett House on the 9th of last May under pretence that he was going to Niagara Falls; that on the same flay he satied in the City of Brussels tor Europe; that the passage for him was secured three days previously by Healey, his servant; that this ser- Vant also engaged passage tor himself at the time; that the tickets were got lor ‘Healey and triend;” that Aealey told the clerk that the frieud was Mr. Jarrett, but that Mr. Jarrett did not wish certain | parties here to Know ol his departure, and that vheir names were entered un the passenger list as _ “Healey aud friend.” Another puint in the testi. mony 18 that Mr. Jarrett, wno is alleged as one of | the assignees of the claimants, is declared to have asserted that he never authorized any proceed- ings in nis name, and upon this the averment ts made that his signature to the alleged complaint {6 a forgery, and is so pronounced by an alieged expertin the business, There was no opposition to the motion, and the Court ordered that the plaintiffs furnish security for costs In each of the actions, 4nd that if this is notdone within forty days that a motion may be made to dismiss the complaints. THEATRICAL LICENSES. In the early part of last May a preliminary injanc- tion was obtained in the Supreme Court restrain- ing the Society jor the Retormation of Juvenile Delinquents, the Mayor and Corporation of the city from the collection of licenses required by the act ol the Legisiature passed in 1872 to be paid by theatres and other places of amusement in the city, and irom enforcing the penaities prescribed ‘on such act until tne matter had been adjudicated in the Court. Subsequently @ lengthy argument ensued upon = an order to show cause why this injunction should not be made permanent, the same being argued by no less eminent counsel than A. Oakey Hail for the motion and Willfam M. Evarts and EK, Randoiph Robinson in Oppostion. Although the action Was brougit by Mr. Wallack, the arrange- ment was that this should be a test case and govern all the other places of amusement in the city, for whom air. Hail was specially retained. This argument, which was published fully in the HERALD at the time, took place betore Judge Donohue, in Supreme Court, Chambers. Juage Donohue gave his decision tn the case yesterday, embodying the same in the following opinion which, as will be seen, is short, sharp and decisive, OPINION OF JUDGE DONOHUR. In this case the iacts and points involved in my judgment are such as to entitle the plaintiff to re- Brain derendants, as asked, until a final judgment on the merits.
