To THE EpiTor OF THE HEERALD:— As usual, the HsgaLp is the first of all me® ropolltan journals to lay bejore the public the topics o1 the day, as shown in devoting two col- umns to the Bankrupt law as amended by the Sem- ate on the 10th inst., for which it deserves special credit, a8 @ law of this kind affects everybody, especially so the commerce of the United States. By virtue of my experience as @ merchant I believe I am correct in saying that the law ap amended is the most inequitable that could be enacted, as it places the creditor entirely at the mercy of the debtor. Having been interested ina gieat many bankruptcy cases in late years, I have discovered that in cases of involuntary or compu sory bankruptcy the debtor is almost in every in- stance largely mdebted to lis own family—as ols mother-in-law, uncle, father and cousiue—and I venture to say that im fifteen cases out of twenty such tndebteaness is false, and set up for the pur- pose of giving the deptor benedit of any pro rata share his assets realize. Section 59, as amended, reads that it shall re- quire one-fourth in number and one-third in value of the entire inJebtedness of a debtor to 1orce him into involuntary bankruptcy. Now, | am well aware, by experience, to what unscrupulous men will resort in order to defraud | their creditors, and 1s there any thing in this law to prevent any debtor from setting up 8 fic- titious and false indebtedness held by his own family or friends go to effectually prevent all le- gitimate creditors, combined to obtain above pro~ portion either in number or value, without which they are entirely unprotected as far as this law is | concerned. Further, section 43 now provides that @ majority in number and three-lourths in value of ail the creditors of any person may call ® ineeuing sor the purpose of a “composition,” and that their conclusions shall be binding upon ali non. pating creditors. To show very plainly how @ debtor can take advantage of his creditors, 1 will suppose & case Where a person owes legitimately $10,000, By increasing his ndebteaness fictitiously to $31,000 the real creditors could never obtaim the one-third im value to force him into bank- ruptcy, and should the fictitious creditors desire to do so tney have very nearly the three-fourths in value to make any compromise they choose, which the real creditor has to accept and release the debtor entirely. Of course the courts are, as ugual, vested with disoretionary powers; but we business men know that judges are not generally acquainted with the transactions and vicissitudes of mercantile life, and, though they might mean well, cannot afford us any relief nor insure equity in such cases.
