Her record, too, assnmes the grayest importance in consequence of the fact that the’ Spanish government rests its main argument In proof of the illegitimacy of the vessel upon former representations made against her by Spanish officials to the government at Washington. The charge against the Virginius may be summed up by saying that the vessel was adjudged to be a pirate by Lieutenant José M. Autran, commander of the Spanish vegsel- of-wae Bazan, for an alleged act of hostility to Spain in having made, flying the Cuban fag, a landing on. the coast of Cuba of Cubans in arms, of subjects of tne United States in arms and of am- munition of war. In June, 1°73, when the Vir- ginius was lying in the port oi Aspinwall, Lieu- tenant Autran, who was the fiscal procurator against the Virgintus, presented this allegation both to the American Consul (Thorrington) at As- pinwall and to A. V, Reed, the commander of the United States steamship Kansas, then also lying in tbe harbor of Aspinwall, with a view to prevent ing Commander Reed from protecting the vessel, Commander Reed applied to the Consul for infor- mation as to the regulartty of the Virginius’ papers, and was answered that the Virginius was an American vessel. Upon this authority Com- mander Reed acted, and promptly refused to deny the protection of his flag to the Virginius. Now, I beg you to inform me if the steamer Virginius is an Ameri- can vessel, and tf as such she has all her papers according to law; because if she has there will be no doubt that tm the United States the law of na- tions is interpreted, at least in the present case, in a very different way from what it is in Spain, and therefore I will ask the Spanish Consul in Panama to transmit my remarks to the Spanish Minister tn Washington, tn order that this high ofMicer may present to the American government the proper observations and claims, so that the ‘Virginius may cease to fly the flag of a nation at peace with Spain; and that, in case of covering that vessel with her flag, will compel Spam to take extreme measures or to ask the arbitration of some European Power in the filibuster question I am debating, because the beautiful example of arbitration we have contemplated between the Union and England urges us to follow it. SOME FURTHER CORRESPONDENCE. In continuation of the subject, Commander Reed, under date of July 1, sent to the Navy Department the correspondence which ensued, in which letter he says:— i. The Consul has had some further correspondence with the commander of the Bazan, but with no Satisfactory result to the latter. On the 29th ult the Canandaigua, Captain Rockendorff, United States Navy, commanding, arrived here, and I sub} mitted all the correspondence to him, explained all the steps [ had taken, and have acted under his directions since, This morning I received orders from htm to convoy the Virginius to sea, which I did at six P. M., and when she was well clear of the land Icame back and anchored in order to send this letter to the department, The Bazan leno demonstration. On the 25th of June Commander Reed acknowh edged the receipt of Consul Thorrington’s request to protect the Virginius, and after informing him that the vessel should have all necessary protec- tion from.any attack of the Bazan until he waa further advised, although he candidly believed the Virginius had forfeited all right to the protection of the United States government, DON CAESAR DE BAZAN AGAIN, In reply to the letter of Commander Reed the Spanish commander addressed the following :— ASPINWALL, June 25, 1873. Srr—I have had the honor to receive your. come munication of yesterday in reply to mine of the 23d, together with the enclosed copy of another from the American Consul at this port, by which I am iniormed that the Virginics is an American vessel, having her papers in proper order and au- thorized to sail under the flag she now flies; but her papers being in proper order does not sig- nify in any manner that the vessel may leave whenever she fieses, for the documents may appear legal and not be so. The act of the landing in Cuba, whicn I have denounced, 1s a mat- ter of public noteriety, besides the confession of the very parties who | Satan it. The crime hag been committed, That is undeniable, and that the government of the American Union has not yet acted upon the complaint brought before it some time ago, Under these circumstances Spanish war Vessels cannot permit the Virginius free e to wherever she may wish to sail or evon to leave a neutral port where she has Sound protection and support. It i# mot the fault of ish government that the United States not withdrawn altogether its protection to the Virginius, for it is now many months that this vessel has been engaged in business so foreign to thatof any other merchant vessel as SBaegere her to be constantly watched by the Spani cruisers. If that protection is invoked for to-day, only because her papers appear in order, dt is an arbitrary act; for you must remember that one er ago the Virginius leit a port in Vene- RIDICULING THE VIGILANCE OF THE PIZZARO, which sailed with less speed than the. Virgini and, if I mistake not, the very vessel you command Was then in port and did not seek to interfere with the pursuit of the Pizzaro, wnich is a proot that the ‘United States did not then protect her. On another occasion, more recent, the Pizzaro had springs on her cable in Pert Oabello, to prevent the depar- tare of the Virginius, and was not interfered with by the American man-of-war VJanandaigua lying at that port. The Virginius did not attempt to leave, though B fd tatyh goa had been made for her departure. I instance these to show you that the United States’ protection does not and cannot exist for this vessel, which has placed herself out- side the Jaw of nations. I only wish to know it she has the right to fly the fag of the United States out of respect to your presence in port, of whom [have requested an explanation. It appears that there is but one thing to decide, whether the documents are legal or not. If the for- mer, the authority which has extended them has been deceived; if the latter, it does not entitle the Virginius to any possible: protection from your government. I pertectly understand that you and the representative of the United States are at liberty to make whatever representations you deem proper to your government respectin; the matter. But, in the meantime, I am convince: of my right te resolutely prevent her departure; and I shall do so, in order to discharge my duty, until 1 rece!ve instructions to the contrary from the authorities to whom 1 am responsible. COOL BUT SUFFICIENT, To this threatening letter the following reply was returned :— UNITED STATES STEAMER KANSAS, ASPINWALL, June 26, 1873, Sm—The principal act of which you comph viz., the running of a blockade and the landing of contraband of war—does not insure the forfeiture of the vessel unless caught in tne act, and, thor she may be guilty, the oifence is discharged at end of the voyage, and the penalty never travels further than the end of the return voyage, The Kansas has not peen in any Venezuelan port for three years.
