Michael Jordan, a sailor, was yesterday exam- ined before Commissioner Shields, on a charge of having assaulted the mate of the American ship Hamilton Fish, while on a voyage from Liverpool , to New York. The defendant went a‘t and began to curse and swear, whereupon the captain told the mate tosend him forward to attend to his duty., This led toa dispute between Jordan and the mate, the tormer offering fight and the latter striking Jordan with a belaying pin. Jordan drew & knife on the mate, and attempted to stab him. The defendant was held to await the action of the Grand Jury. Pursuant to adjournment Judge Davis opened the Court of Oyer and Terminer yesterday, but after hearing the motion to discharge the Stokes witnesses, as reported below, adjourned the Court till the 30th instant, without transacting any other business, THE SPRING VALLEY DISTILLERY. Judgment of the United States District Court Reversed—A New Trial Ordered. Judge Woodruff rendered his decision yesterday in the case of The United States, plaintiff in error, 8s. The Spring Valley Distillery and other property, Elijah Brown, claimant, defendant im error. The distillery at Spring Valley, in Rockland county, N. ¥., with the land on which it stands, and certain land used for ingress to and egress from the same, And also the stills and other apparatus, tools, tmplements and instruments used, fit and intended for use in the distillation of spirits, were, to- gether with certain distilled spirits and raw ma- terials for distillation, seized on the 23d of Jan- Gary, 1873, for alleged violation of the internal revenue law relating to distillers, distilla- ‘sion and the taxes, &c., imposed thereon, Upon such seizure the information in behalf. of the United States in this cause was filed, and sondemnation of the property prayed for, as for- feited by reason of such violations, Elijah Brown only appeared hereim as claimant, setting up his awnership of the distillery and and its fixtures and the real estate seized in fee, and his owner. ship of the tools, implements, apparatus and instru- ments (other than fixtures) provided for, used and Intended for use in distilling upon the premises, but making no claim to the distilled spirits or to raw materials seized. On the trial in the District | Court evidence was given showing that for more than three years prior to the seizure the claimant, Elijah Brown, was the owner in fee of the distillery | and fixtures and real estate seized and claimed by him, and the owner of the movable tools, imple- parents and instruments intended to be used in he business of distillation, and which implements, &c., were seized as stated. Evidence was also | Ae tending to show that on the 3d of November, 70, & lease of the lot ef land on witch the distillery is situate, with the distillery buildings thereon and the machinery and fixtures, was made and ae- livered by the claimant to the copartnership drm pf Newman & Co. (wnich cousisted of Marcus New- man, Sjmom Kahnweiler and Elijah Brown—the tlaimant Elijah Brown), to carry on the distillery business ior tive years. M. Newman & Co, did no ,duamess under that copartnership, but in Septem- ber, 1871, the interest of Newman & Co, was trans- ferred by the claimant to Marcus Newman. A rail- foad was constructed across the claimant's land to admit of ingress to and egress trom the distillery, and this was done with the knowledge and consent of the claimant. The evidence iurther went to rove that Mr. Brown was not aware oi the alleged raudulent nature of the distillation carried on at | the distillery, and that he could not legally be held | responsible for the act o! his lessee, if that act was in any way fraudulent. To the charge of Judge | Blatchford certain exceptions were taken by’tne tounsel for the government, the Judge hoiding that there could be no condemnation of the property of the claimant unless yale] were satistied that be had guilty knowledge of the fraudulent distillation tharged to have been carried on by Newman. Judge Woodruff writes a lengthened and elaborate Dpinion on the question at issue. He states that 20 question of ownership is made, and that it is expected that the owner of property will see to the | use made of it at his peril. Words might be mul- tiplied on the need of stringent provisions to pro- tect the government from irauds and evasions of | the law, ana the slight restraint that would exist when only the forfeiture of a building at will or | at sufferance, [rom month to month, or trom year to year, was all that is to be apprehended. The learned Judge says that the trial below proceeded upon an erroneous inter- pretation oi the law governing the rights of the xg and that it may not be of any materiality discriminate between fixtures and movable ar- aah toois, implements and instruments used in the distillery. Itis probable that the instruction to the jury to treat the latter as real estate for the purposes of the trial grew out of the other instruc- tion that the property of the oWner could not be forieited unless the owner was a@ party to the fraud, or in complicity witn the distiller therein. {t is proper to say that if a case be mace in which tools, implements, instruments and _ personal | property round on the premises are forfeited, I see | 0 ground on which, by calling them real estate, or art Of the distillery apparatus, they can be with- rawn and saved. Davis, as Re- ceiver of the Ocean National Bank.—On February 13, 1871, tue bankrupt, Alired Wild, without con- sideration and as mere surety, became the endorser pf two promissory notes made by the Portage Lake and Lake Superior Canal Company, one for $73,002 51 and the other for $35,111 40, Which, on that day, were delivered to the Ocean National Bank, and were made payable with interest. These notes were given in renewal of a number of other notes then unpaid,« which had been also given in renewal of prior notes held by the bank, and which were taken from the Canal Company for a loan of two sums of $75.000 each, made on and aiter January 7, 1867, by the bank, dre of the sums 7c ce on the 5th of January tv be made in jorm to the Canal Company, and the other at the same time agreed to be made to P. J. Avery, but proved by the testimony and found by the reieree in thé District Court to have been, in part, for the benefit oi the Canal Company, who, in the accounts kept of the transaction, was treated as the actual debtor for both amounts, The reason assigned for giving the transaction the form of two {oans—oue to the Canai Company and the other to f. J. Avery—was that the National Banking law prohibits an indebtedness by any oue party, as borrower, to an association iormed thereunder to an amount PAghhed than one-tenth of the capttal of che association making the loan. These three boys, employed at the time of the shcoting as bell boys in the Grand Ceutral Hotel, were, it wili be remembered, keptin the House of Detention from the time of the shooting to the close of the second tral, last January. ‘Then they were released with about three hundred dollars each for thet lost time. On the decision of the Court of 4 pes lf granting Stokes 4 new trial they were Feat Pato ander an order 0} fhe Court of Oyer and ‘Terminer. Mr. Mott applied to Mr. Justice Pratt, at the Supreme Court, Spectal Term, for their discharge, but that Judge declined to interfere with an order of tae Court of Oyer and Terminer. Mr. Mott, on his motion peatascay. insisted that the law of 1845—the only law authorizing the detention of witnesses by a court ol record—had no validity for a second arrest; or, if it had, that it required the Court to take reasonable recogni- zancc. He dwelt on the hardship of their long de- tention, with a possibility of its continuing tor months longer, Judge Davis said that the ends of justice were paramount to all other considerations. He. could hot entertain the question of the deprivation of liberty to which these witnesses were subjected, It was all important that their testimony should be given at the next trial of Stokes, and if released now they might be induced to put themselves out of the way. An Escaped Convict Sent to Sing Sing for Six Yenrs. Before Recorder Hackett. Assistant District Attorney Horace Russell and the Recorder disposed of a large aumber of prison- ers yesterday. A notorious criminal, named James Morrison, alias J. UW. Brady, an escaped convict, upon whose Person two loaded revolvers were found when ar- rested, pleaded guilty to burglary in the third de- gree upon an old indictment which charged that on the night of the dt of February, 1871, he broke into the jewelry store of Joseph B. Lewis, 88 Bleecker street, and stole a gold watch, a topaz ring, a pin, asilver knife, and other small articies. He was remanded to the State Prison, to serve out an un- expired term of three years, and at its expiration to be jurther imprisoned for the term of three years and six months, A Husband and Wite Charged with Larceny. James McManus and Ruth McManus, husband and wife, were placed at the bar charged with stealing ladies’ and infants’ wearing apparel, valued at $242, on the 5th of June, the property of Laura F, Matson, 848 Lexington avenue. James pleaded guilty to the charge and was remanded for sentence, As his wife could not be iegaily held Assistant District Attorney Horace Russell con- sented to her discharge. An Assanit with an Axe. Patrick McCarty pleaded guilty to an assault with a dangerous weapon, with intent to do bodily harm. The p ner struck Dennis Sullivan upon axe on the 20th of July, His Honor directed him to be remanded till Friday, in order to inquire into the circumstances attending the assault, Larcenics and Burglaries. Patrick Haley pleaded guilty to an attempt at grand larceny, the indictment charging him with stealing wearing apparel and a musica! instru- | ment, valued at $82, on the 28th of July, the property ot Alice Noonan. | Jacob Schroeder, who has served one term in the state Prison, pleaded guilty to an attempt at burglary in the third degree, He broke into the | liquor store of Henry C, Bertrand, 149 Delancey street, and Stole $10 Worth of liquor. These prisoners were each sent to the State Prison for two years and six months, | Miciael Sullivan, who sto} worth of fancy | goods and $165 in money on the 29th of July, the | property of Louis Getz, pleaded guilty to an at- tempt at grand larceny. He was sent to the State Prison tor two years and three months, Thomas Smith, who was jointly mdicted with Stephen Byrne, pleaded guilty to an attempt at | burglary m the third degree. The indictment charged that on the 26th of July he broke into the Jaundry of Am Doyle & Co., 137 West Twenty- ifth street. Smith was sentenced to the State Prison ior two years and four months, August G. Noiter, who was indicted for burgla- riousiy entering the barber shop ot John Hagen- bercher, 318 Eighth avenue, and stealing $35 worth of property, pleaded guilty to an attempt. ‘This prisoner Was sent to the Penitentiary for one year. A Simple Assault. John Buckley, who was charged with striking Edward Riedmuller on the 24th of July upon the head with ‘a cart rung, pleaded guiity to assault and battery. Petty Larcentes. Peter Kilkenny pleaded guiity to petty larceny, the indictment charging him with stealing $70 trom Bernard McQuade on the 13th of July. Stephens showed previous good charac- ter, and the jury gave lim the benedit of the doubt by rendering a Verdict of not guilty, ALLEGED THEFT OF AN AMERICAN FLAG.—The ac- cused not ordered to he shot, but to be discharged on the spot, Patrick McEvoy was tried for grand larceny, the allegation against him being that on the 234 of Juiy he stole an American flag and stat worth $75, the property of the Lion brewery Company. Tato Saturday nag Detective Farley arrested William ‘Thompson, Louis Gayer and James Nolan at No. 141 Bleecker sti eet. It was ascertained that Thompson had hired @ furnished room in, the latter house from @ Mra, Shaw, and four tranks and about twenty-two hundred dollars’ worth of Mrs. Rice’s property were tound in the room. The prisoners were discovered sleeping there when the apart- ment was searched, Mrs, Shaw, the landlady, states that she did not see the trunks carried in, but saw two of the pris- oners carrying out parcels, Another party who appears to be connected with those arrested, James McGinty, was yesterday taken into custody by De- tective Kelso. The four men were each held in $2,000 bail to answer by His Honor Judge Hogan. A Young Forger, Monday afternoon a boy named William Barfks, aged about fourteen, went into the Citizens’ Na- tional Bank, in the Bowery, and presented to the paying teller, Alexander Eggleson, a check for 3310 60, purporting to be drawn by Herman Suckow, of No, 54 West Thirteenth street. Mr. Eg- gleson, suspecting forgery, detained the boy and Sent for an oficer. Officer O’Conor, of the Twenty- filth precinct, arrested the bey. Mr. Suckow was also sent for, and he pronounced the check a for- gery. Judge Hogan held the prisoner in $1,000 bail to answer, Cut with an Axe, John Holden, of No. 125 Washington street, and James O'Keele, from the same locality, after im- bibing some very bad liquor, became involved in a quarrel over some trifling difference, and O’Keete cut Hogan in the head with an axe, injuring him severely, He was arrested and taken before Judge Hogan yesterday.
