THE COURTS. In the United States District Court yesterday, in ‘Whe matter of Louis H. Rosey, a bankrupt, Judge Beatohford decided that the United States is enti- Mea to prove a debt in respect to so much of the mount of its claim, set forth in its proof ofdebt, as ‘@oes not consist of any costs of the suit which had ‘Been brought in the Umited States Circuit Court to weeover from Rosey certain penalties under the Revenue law. The Judge also holds that the Gaited States is entitled to a priority or preference ‘The case of Carl Vogt, alias Joseph Stupp, who is eharged with the murder of the Chevalier Bois de Bianco, at Brussels, Belgium, was resumed yester- Bay before Commissioner Kenneth G. Involuntary jankrupt. Yesterday an application was made to Judge Blatchford, in the United States District Court, on the part of some of the creditors of the Auantic National Bank, for an order calling on the officers af the bank to show canse why the bank shonlad not be adjudicated an involuntary bankrupt, and: ap assignee appointed to collect and distribute the assets of the establissment among its creditors. This application was resisted on the ground that B receiver of the bank had been already appointed by the Comptroller of the Currency, who now held the assets of the bank with a vicw to the settle- ment of its affairs, and that, under the bankruptcy jaw of the United States, there was no jurisdiction 40 the Court over a case of this character, especiaily as the Comptroller of the Currency had exclusive power to take possession of and wind up the affairs of an insolvent national bank. Judge Blatchiord, for the sake of form, granted the order, stating that he did not believe the Bankruptcy Court had jurisdiction of a case of this character. The oider ‘was made returnable immediately, for the purpose of having an appeai taken to the Circuit Court to @ecide the question of jurisdiction, Whe Bank of England Forgery—Case of George McDonnell—Further Examina- tion of the Accused. Tne further examination of George McDonnelt, who is charged with complicity in the alleged Wauds upon the Bank of England, was resumed yesterday before Commissioner Joseph Gutman, at ‘bis office in Nassau street. Mr. T. F. Marbury and Mr. Charles M. Da Costa appeared as counsel, the former for the British government and the latter for the Bank of Eng- ‘and, and Mr. Brooke for the prisoner. Mr. Archibald, the British Consul, was also pres- ent. Counsel for the prisoner expressed a desire to #£ross-examine Mr. Archibald. This was objectea to by Mr. Da Costa, unless counsel called Mr. Archi- bald as his own witness. The Commissioner held shat counsel for the prisoner had the right to sross-examine Mr. Archibald, Mr. Brooke then proceeded to cross-examine Mr. Archibald, ‘The latter stated that he bad made the complaint in this case upon certified and authenticated copies of the warrant from the Lord Mayor of London, Sir S. CITY HALL ‘AFFAIRS, Some of the Rumors that Were Tet Loose Yesterday—The Fire Commis- sioners and Commissioners of Build- ings Qualify. The City Hall was a grand gossiping ground yesterday, and outside of the Mayor’s ofice there seemed to be little else than gossiping going on. The Micawhber family was to the front as usual, anda large crowd of the under strata of politicians was present also; but there was little of note transpiring. Nothing “turned up” for the one way either. Nearly ail the Aldermen were around, is, if they had any to keep, Nobody will ever again accuse this Board of Aldermen of getting up a “combination.” They are too innocent and good to do it in the first place, and too limber in the secona place, to keep it up if they had it, Most of them called on the Mayor during the day and had brief interviews with the man who brought them strangely to terms, If it were nota disrespectful and tainted appellation, Mayor Have- meyer might well be called “The Boss.” The Mayor was extremely busy yesterday und was obliged to refuse audience to many of those who had called to see bim, It was his last day in which to perfect the remaining nominations, and he waited most of his time to himself. ‘Chere are now to be nominated four Commissioners of Police, three Park Commissioners, a City Chamberlain, two Commissioners of Accounts—the latter offices being new and provided for by the new charter—and five City Marshals. There is also a Board of ten Police Justices to be appointed under the new bill, which received the Governor’s approval yesterday, but there is no limit of time within which they are to be nominated, There is considerable dissatisfaction expressed in promiscuous gatherings of men about the Hall atthe removal from the Board of Fire Commis- sioners of General Shaler, who ts looked upon at large as the man who did the most to periect the Department. With the remainder of the nomina- tions sent in to the Board on Friday there is little fault found, Of course, there are growlers, who desire to be appointed themselves and who will growl at any other nominations, but the masses of the people think that, although the nominees are, with scarcely an exception, entirely new men, they will DRONE efficient and capable officers if con- firmed. The new Board of Fire Commissioners and the Commissioner of Buildings, Walter W. Adams, ap- peared before the Mayor yesterday and qualified. There was amere rumor afloat yesterday that Thomas A. Ledwith will probably be one of the new Police Commissioners, but there is only a faint wssibility of the rumor being correctly founded. tts much more Jikely that he will be retained in the new deal of Police Justices, though that is only conjecture, Assembiyman Bernard Biglin called upon the Mayor yesterday and remained with him forashort time, and a report gained some cur- rency that he was likely to be named as a Police Justice, He is not a lawyer, however, and that fact may be very largely considered by the Mayor in making up his list. CORONERS’ CASES, Julia Cavonerd, a little Cuban girl, seven years of age, whose parents reside at 339 First avenue, died in Bellevue Hospital from the effects of inju ries recelved—laceration of the thigh arid arm—by having been accidentally ran over on the Ist inst. by car No, 31 of the Second Avenue Railroad Com- pany. The body of an unknown man, about twenty-four years of age, wis found floating in the dock loet of Fifth street, East River. Deceased was five feet seven inches in height, with brown hair, and wore black ceat, pants and vest. The remains were sent to the Morgue, and Coroner Nelson W, Young noti- fied to hold an inquest on the body, Coroner Young was yesterday called to the Morgue to hold an inquest en the bedy of an un- known man, forty years of age, which was tound floating in the dock foot of Twenty-first street, East River. Deceased was about five feet ten inches in height, with black hair and heavy black whiskers, He wore @ blue overcout, black dress coat, woollen jacket, brown vest and pants. The body, which apparently had been a long time in the geries, and upon the affidavits and depositions which had accompanied those warrants; these de- Prantl and affidavits set forth the particulars of e accusation against the prisoner; he received ‘them on the 22d of April; before that time he had Searned something of the nature of the case by felegraph, on the 17th of March, and also by com- — irom the solicitor of the Bank of Eng- Mr. Brook contended that the proceedings had met been based upon the original depositions on which the warrant was issued. . Betore this pro- ceeding had been commenced another had been had upon the orginal warrant. He claimed that only one warrant could be issued, aud that the ‘Warrant in this case was not the original one. The Commissioner ruled that the warrant of the Mayor of London, upon which the present Proceeding was based, was the original one. Mr, Brook vhen offered in evidence the entire gecord of the previous proceeding. ‘This was objected to by Mr. Da Costa. The Commissioner admitted the warrant in eyl- ong legal argument was then gone into by Mr. Brooke for the purpose of showing Ube construc- tion of the law of 1848 and 1840 with reference to extradition cases. Reed, appointed in This case, made his report yesterday, Judge Fancher confirmed the report and granted Mrs. | Justh a decree of divorce on the facts presented to him. The result is that Mrs, Justh takes charge of two children, girls, while Mr. Justh takes con- tro} and guardianship oi the boy.
