we THE COURTS. ‘The case of the People vs. Mrs, Virginia W. Justh, charged with having an abortion performed on her at her house in Oyster Bay, in August last, was resumed on Friday last at the Court House, Jamaica, L. L, before Judge Snedeker, The case had been adjourned from the previous day of the session in consequence of the time of the Court being im the interim engaged tn the regular busi- ness then pending before it. The case for the Prosecution had then closed, with permission to reproduce the notorious Dr. Grindle and his wile. It appeared, however, from the statement of coun- sel for the peopie Lo the Court that these worthies had fled beyond the jurisdiction of the Court and its officers. The prosecution, however, were here eontent to close their case. Mr. Townsend, counsel for the defence, then made a motion to dismiss the complaint, supporting it in a long argument, chiefy contending that the whole accusation was the result of aconspiracy on the part of her hus- band, Mr. Emil Justb. Alter an equally long argu- ment by Mr. Shafer, associated with the District Attorney, Judge Snedeker put the party charged upon her defence, pertinently asking Mr. Townsend, if it was a conspiracy, how did he account for the presence. of Mrs. Jones, an associate and accom- Plice of the Grindies, at Mrs, Justh’s house for eight days, and her discharge therefrom with a remuneration of $50, Mr. Townsend’s effort to explain this, to the judicia! mind, very suspicious circumstance, will be detailed by whatever facts thev can produce when the testimony for the de- fenceis putin. In the meantime the Court put the accused upon the deience, and adjourned the pro- ceedings till to-morrow at eleven 0’clock. Yesterday, in the United States Circnit Court, before Judge Blatchford, Mr. William Fullerton, counsel for William M. Graham, moved to reduce defendant’s bail, which had been fixed by Judge Benedict at $25,000. The defendant, who had been President of the Wallkill National Bank, is charged with having embezzled about one hundred thou- gand dollars, the property of that establishment, Judge Blatchford declined to interfere, considering that, under the circumstances, the bail was not excessive. Counsel said he would take an early Opportunity of bringing the matter again before the notice of Judge Benedict. Mr. Graham is now Jocked up in Ludlow Street Jail. ‘Thomas Woodward was yesterday held by Com- missioner Shields to await the action of the Grand Jury on a charge of having refused to join the American ship Nearschus, after he had signed arti- cles and received his advance note, UNITED STATES CIRCUIT COURT. THe Widow Fisk and the Credit Mobi- Mer—A Stockholder Moves to Intervene in the Action. Before Jndge Blatchford, Yesterday, in the United States Circuit Court, before Judge Blatchford, in the case of Lucy Fisk, executrix of the late James Fisk, Jr., vs. The Union Pacific Railroad Company and the Crédit Movilier of America, Mr. L. A. Lockwood moved, on the part of Mr. N, W. Butler, a stockholder of twenty- five shares, for leave to intervene in the action and contribute to the expenses of the suit, share in the benefits heretofore had. and that the suit siall not be discontinued without notice to Mr. Butler, Mr. D. D. Field and Mr, Jenckes, of Rhode istand, Appeared ior the plaintil, aud Mr, Stuckuey lor tue deieudants, In the course of the argument Mr. Stickney said the suit was brought on six shares of stock, and that the litigation haa been going on six years. Mr. Field observed that he had not learned what that suit was. The action “as brought not only for six, but tor 20,000 shares, and 1¢ was the opin- ion 01 his associate, Mr. Jenckes, aiter a careful ex- amination of the case, that the plaintiff, Mrs, Fisk, would ultimately be entitled to twenty parts out of twenty-tive, being $40,000,000 of the earnings of the road. The Court took the papers and reserved its de- cigion, : UNITED STATES DISTRICT COURT. Business in Bankruptcy. Voluntary Petitions—Jonn W. Holgate, William q. Vanderzee, Frederick J. Before Judge Barrett. For some time past money and valuables belong- ing to guests at the Metropolitan Hotel have mys- teriously disappeared, Suspicion fell on two colored waiters, Richard Walter and James McGuire, and a trap was set tocaten them. Falling unwittingly, as alleged, into this trap, one was caught with some marked money in his possession» and the other gobbied up a ring which was left lying about loose as a temptation to dishonest cu- pidity. On being arrested the prisoners were de~ tained twe days and a night at Pelice Head- quarters, When they were taken belere Judge Dow- ling, at the Tombs who committed them in deiault of $1,000 baileach. Writs of habeas corpus having been procured by Colonel Spencer, their counsel, they were brought beiore this Court yes- terday morning and application made for a reduc- tion o1 their batl, The counsel animadverted upon the injustice of the detention at Police Headquar- ters before being taken belore a committing magis- trate, and then insisted that the bail was exces- sive. Aiter hearing the argument, Mr. Russell, As- sistant District Attorney, opposing the application, the Judge reduced the bail to $900 each, Inthe case of one of them, who if was claimed signed a waiver o! trial by Jury in ignorance of the nature efthe document, the matter was postponed till next Thursday, to allew a full eXamination into the jacts of the case, Decisions.
