POUGHKEEPSIE, Dec. 20, 1672, The case of Henry Porter. Tennison, the alleged lineal descendant of the Archbishop of Canterbury, who was arrested in this city on ® charge of bigamy, assumed an entire new phase to-day, and now the people are excited to wonderment as te what will tarn up next. It will be remembered that when he was indicted his case waa set dows for the December Sessions. In the interim the Greatest effort has been made tosecure sufficient evidence to convict him of the charge preferred against him, but the attempt has been, ing greet measure, unsuccessful. The alleged first wife is tm Trelana, and her presence is necessary to convict him. In the Court of Sessions to-day, Judge Henry M, Taylor presiding, Tennison’s counsel, William J. Thorne, moved that the prisoner be discharged on bis own recognizance, in accordance with the statutes, the people not being ready for trial. District Attorney CoMn and Hon, Allard Anthony, acting for the people, presented five affidavits to show cause why he should be held longer to await the arrival of the necessary proof. Considerable argument followed, when, finally, the Court de- decided to discharge the prisoner. SET FRER AND REABRESTED, Tennison was all this time in Court, and a quiet but apparently deeply intereated looker-on, As soon as the Court announced his discharge he started to go, but, to the surprise of every one in the court room, his progress was arrested by Sheriff Pitcher, who served another warrant of arrest upon him. Tennison looked at his counsel Mr. Thorne, with surprise, but the latter nodded his head “all right,”” when the prisoner went along with the Sheriff quietly back to his prison home. ‘The new proceeding against this now notorious individual is an odd document, and of such inter- esting nature that we give it verbatim. Those who have watched Tennison closely and who are familiar with facts yet unknown to the public, openly assert that he is crazy. I learn from excellent authority that insanity is hereditary in his family. There is MUCH “BEHIND THE SCENES” in his case which reveals sorrow and trouble in @ social circle i: oughkeepsie. One Poughkeepsie lady, now separated from her husband, has written a letter fo Tennleo, aa pathizing with him and denouncing Miss Mapes. Tennison’s first acquaintance with Miss was made in a raltway car, through a Mrs. Mot ts, who conveyed @ note from him to her in a secret manner, ere is no doubt that his euit for her hand was greatly aided by more than one personin Poughkeepse. MISTAKEN IDENTITY. A Probably Innocent Man Sentenced to State Prison for Twenty Years=The Robbery of James Hume on Thanks- giving Evoning—The Truth Coming to Light. It wil be recollected by the readers of the Hgr- ALD that @ young Man named John McMillian was tried at a recent term of the Gencral Sesgions, charged with being one of a party of three who knocked down and robbed Mr. James Hume, the well-known master builder of 127 Clin! Place, on the eve of Thanksgiving Day, near Washington Park. Mr. Hume was rendered senseless by a blow from behind and his watch taken from him. He had seen bis assailants, however, and recognized MeMillian as one of them, A girl of bad character, who gavé heFfianig a8 Louisa Smith, swore upon the trial that she had &@en the whole transaction, and positively identified McMillan as one of the robbers. On bis examination in the Jefferson Market Police Court M'MILLIAN PROTESTED HIS INNOCENCR with teartul earnestness, aud charged the girl Smith with perjury in such a manner as to some- what shake the belief of Justice Cox in his guilt, The testimony on the trial was, however, too direct for any assumption of innocence and the jury found him guilty, withthe result mentioned. Soou after certain ofiicers of the Court learned through some statements of menibers of the “Houston strect gang,” with which McMillian was supposed bo be connected, that the real criminals were still at large and that an ingocent man bad been convicted, The names of the informers are for obvious reasons kept secrei, but through them the officers learned that two girls, well kuown (requenters of the street in that vicinity, had witnessed the whole trans. action, and if they choose could tell all about it. The names of these were obtained aiter some effort, and they were yesterday moruing arrested a | and brougit up before Justice Cox, at Jefferson | Market. ‘in a conversation with him, and in the presence of Mr. Hume, they readily admitted that | they had wituessed the robbery and had raised Mr. Muime’s head from the ground after the robbers had ted and WIPED THE BLOOD FROM HIS PACE. On the approach o/ the oflicers they ran away, fear- | ing to be arrested. They-professed to know the |r ALcriminals well, but did not know their names, Their statements were such as to convince Mr, Hume that they had witnessed the atfair, but that | they were telling much less than they really knew. Justice Cox, who from long experience can judge | very readily whether or mot the truth is being told, saw that they were concealing something, and urged them to make a clean breast of it. They persisted, however, that they did not Kuow the names of the robbers, but vulunteered @ description of them. They were separately taken to the celis below to see ifany of the alleged robbers were there. On their return they stated positively that the robbers were not among the prisoners shown them. They were left in temporary charge of the officer, while a new phase of the afair came up in the court room, Mr, Isaac Black, of Chatham street, Was arraigned, charged with RECEIVING STOLEN GOODS, in | purchased the watch stolen from Mr. Huine. ‘The complainant was Charles Woodruit, One of the parties Teno was ip arrest for complicity in the robbery. He stated that ie had accompanied @ friend, whose name he did not know, a Hiac 8 place, where his friend sold the watch { $15. Mr. Black, who is a very respectable went. map, gave ‘bail in. the sum of $1,500 to answer the charge. Megnwhile the “friend? of one o| the girls mentioned, who was seated in the audience, Was arrested, by order of the Justice, and the thres were intormed that they would be locked up as witnesses. This caused an immediate flatter among them, and aiter a hurried consulta- tion they concluded to tell all the trath, which they accordingly did, and the gutity parties are, no doubt, ere this arrested, Their story fully exctlpates McMillian, and both Justice Cox and Mr. Hume are convinced’ o! his innocence. Of course, with the arrest and conviction of the real culprits, immediate steps will be taken for his release.
