THE SAN FRANCISCO BREACH OF PROMISE CASE. Turner vs. Ortiz. MONDAY, NOVEMBER 217, The entire morning sessioh Was taken up with arguments of counsel as to the admissibility of cer- tain books and witnesses with reference to the lawa of Mexico in relation to contracts, which, aiter a patient hearing, the Judge declared inadinis- sible. At the opening of the afternoon session the detence called MISS LECTA K. TURNER, the plaintiff, to the stand. She gave her eviaence in a calm and self-possessed manner, although ex- ung some of the nervousness incident to a lady pee pecultar position. Her testimopy was as jollows:— A have corresponded with James Cherry; two or three letters passed between us; have none of the letters in my possession at this time; did not show any ol those letters to defendant; 1 received three letters, to the best of my recollection; never corre- sponded with any one signing himself J. WALL STRERT, } Torspay, Dec. 5-6 P. M. On ‘Change to-day wheat waa firmer on the “cold snap,” but without exhibiting much activity. The Cotton market was quiet. THE EXPORTS OF THE WEEK. The aggregate exports (exclusive of specie) from the port of New York for the week ending December 6, 1871, were $3,947,436, MCNRY ACTIVE. ‘The money market was active, particularly toward the close of banking hours, when there was @ general sourry for balances, and borrowers paid seven per cent gold without hesitation, These transactions were exclusively upon stock collat- erals, the dealers in governments having been sup- piled quite freely at seven per cent, and in many Instances at six. The demand, while in part art fictal, was in great measure natural, the banks being steady shippers of greenbacks to the West and South for the movement to market of cotton and wheat. Some surprise is expressed that in view of a total disbursement of $10,000,000 coin at this point (the Sub-Treasury having to-day pald out @n additional $890,000, bringing the total up to that figure) in payment of checks received from Wash- ington tn exchange for the ‘‘called”’ '62’s, the banks should not be better able to meet the present de- mana for money and prevent what this afternoon was positive stringency. Perhaps the explanation es in the fact—and tne theory is offered very diffl- dently—that the Syndicate are quietly selling ex- change on London and turning he gold into the Treasury. It is certainly diMcult to explain Otherwise the apparent scarcity of coin in the street, forin the present dearth of speculation in the Gold Room $10,000,000 of goid could not have been actually marketed here withlu the past week, at least withont a different result upon the pre- mium, The whole Syndicate and refunding business is such a muddle, and has so perplexed the street, the brokers and the merchants, that It is to be hoped the proposed Congressional investigation of the matter will be hastened with all possible expe- dition, Prime commercial paper was quoted 7a 12per per cent discount. Foreign exchange was dull ana unchanged. GOLD WEAK—110% a 110, The specie payment tendencies of the various suggestions in the documents laid before Congress, @s well a8 the reported convalescence of the Prince of Wales, still furtner weakened the already weak temper of the gold market and led to a aecitne to 110—the lowest point gold has toucned since tho close of the war, although not the first time of its sale at that figure, the same price baving been reached once before—viz., No- vember 4, 1870, when the repeated triumphs of the German armies in France implied the speedy settlement of the war last year. The market was ‘still auil and the speculative feeling is in abeyance, the “bears” deeming it imprudent to sell and the “bulls’’ fearing “specie payments.” Tac prices to- day were as tollows:— 10 A.
