Before Judges Van Brunt and Loew. Nelson MeSten, Plaintig’ and Respondent, vs, Bdiwurd Matthews, Impleaded with James 8. Bran- der, Jr., and Samuel L. Chambliss, Defendant and Appellant.—This was an interesting appeal in refer ence to @ transaction which occurred immediately preceding our recent war. The complaint states four causes of action, The first is against the defendants, ‘who compose the firm of Brander, Chambliss & Co,, as aceptors of a draft dated April 24, 1861, for the sum of $8,050 03, und drawn at twelve months, The second is against them ag acceptors of a dratt dated february 26, 1862, for the sum of $1,169 79, and payable on October 7, 1862, The third is against them as acceptors ofa draft dated February 26, 1892, for the sum of $107 97, and payable On October 7, 1862; and the fourth is against them as makers of a promis- sory note, dated January 2, 1862, for the sum of $564 25. The defendant Matthews appeared alone and answered, and denied the partnership of the defendants, alleging that a parcner- ship was agreed upon, provided James 8. Brander, Sr., assented, but that he refused, and that the partnership was never formed. In further answer, Mr. Matthews states tnat Louisiana seceded on April 16, 1861; that war ensued, and that New Orleaus was occupied by the enemy until about March 30, 1862; and further, that the plain- tif and the other parties to tne drafts and note were residents of New Orleans and, consequently, enemies of the United States. He alleges further that the drait for $3,050 06 was accepted for the ac- commodation of Walker, Cheatham & Co., the drawers, without consideration, aud was by them trausferred to McSten, Value & Co., the drawees, dor au antecedent debt due them by the drawers, Among the principal points relied on by the re- spondent were the cifect of the proclamation of non- Aniereourse upon contracts made by this firm in New Orleans while that city was in possession of the rebels; that tne Supreme Court in this district had held ima suit against this firm that the war had no effect on such & contract. A Pickpocket Sent to the State Prison for Five Years. Before Gunning S. Bedford, Jr., City Juage. Assistant District Attorney Fellows appeared for the prosecution yesterday im this court and disposed of a large calendar. The first prisoner called was Thomas Smith, an admirable specimen of the young ‘dead rabbits” of the metro- polis, who was iried and convicted of grand lar- ceny, he having stolen a goid watch valued at $225 on the night of the 25th of January from the person of Thomas Norton, while attending a ball in Brookes? Assembly Rooms. Before the jury was sworn the complainant informed the prosecuting officer that he could not identify the accused and that there was nothing in the case.
