Bedford, Jr., City Judge. Lawrence Hines, who was indicted for burglary in tbe first degree, pleadea guilty to an attempt to commit that offence. On the night of the 22d of poets the accused entered the dwelling of Francis eating, No. 307 First avenue, Mr. Keating saw Hines in the act of escaping and pursued hun. After him for @ block the burglar turned and fired re Spencer addressed the Court in behalf of t Prisoner, stating that, while he had doubt as to the prosecution being avie to prove the burglary, he had Qo doubt as to the result of the indictment for felo- Dious assault, upon Which he would undoubtedly be convicted. Counsel for cne of the prisoners made an urgent plea in his behalf, e@tating that a host, of influential citizens would give him a good character. and that he was the sole support of a widowed mother and & maniac sister. One of the prisoners had a ‘jimmy,’ another dark lantern and the third a skeleton key upon their pergons when they were arrested. After listening patiently to what the counsel had to say Judge ford said he sympathized with the mother of oue of the prisoners, who was present, but he was under oath to protect the community, and ‘would be compelled to send each of tne burgiara to the State Prison for two years and six months, This was the highest penalty which the law permitted ‘the Court to impose.
