In ths instance the Fire Marsha! evidently has beer made the catspaw or avatlable tog] of @ certain fey of the companies inorder to throw @ slur on imsé who are doing a more proft- able business than themselves, Mr. Superintendent Barns, of the Insu‘ance Bureau at Albany, is the proper officer to inveatigate the management of insurance companies, and it ily becomes a newly Hedged fire marshal to throw out insinuations of fraud against them. As an officer of an insurance company I would jt to Mr. Fire Brackett that he had much better confine hiniself to the investigation of fres and to ascertain thar o1 sore correctly and study the law on arson, of which it seems he Knows: but little. In the recenttriaia of two offenders both ought to have been convicted of arson in the firat degree, and had the case been properly brought be- fore the District Attorney that would nave been the verdict, instead of which # verdict of arson in the third degree was rendered by the jury, and the court | nee sentence of tea years esch in the State ‘That was an error of judgment, which fact Mr. Fire Marshal Brackett ought to have known and so informed the court. The statutory Jaw, fifth edition, fourth yolume, page 661, makes the punish- ment for the third degre: of arson seven years in the State Prison. Now these criminals can be hiverated from prison ai habeas corpus on the ‘ound of Megal detentin and set free. Mr. Fire jarsnal Brackett must mt attempt to Oy too high nor extend himself beyond his leghimate line of business, or he may perchance barn his tiagers. A -REMARABLE SUIT. The Claim of Seveny Negroes to $30,000 Involved. {From the Nashville (fenn.) Banner, March 4.) The case of Levi Winstead and seventy other ney vs. William Hamlson, executor, oth is being argued in the Supreme Court. This suit was brought up from the ry Court of Willtam- Ieappeard tuat in the year 1851 Sunael Winstead; t a nue} wince deceased, made a will leaving $20,000 to seventy of his negroes with the provision that they shouid be the property ef iis wife during her natu- ral lifetime and then be sent to Liberia, the laws of ‘Tennessee at that period having prohibited the emancipation of slaves, Mrs. Wiostead diea m 1862, and in conseqence of the war the were not sent to Liberia, as provided the will, but remained in Tennessee, The defendants assert that ony «ge of the will relat- ing to the negroes does not hold good ou account of thelr non-removal to Liberia, while the plaintits claim that their having remained in Tenneasee does not invalidate that portion of the will, the intention of the teatator being that, after they had served thepr mistress, they should emancipated, which objett had been fully accouphished.
