B: Page, Treasurer of Vermont, vs. B. Blake.— ‘rhis action was brought to restrain the treasurer of the Vermoat and Canada Railroad Company from paying and the Treasurer of the State of Vermont from collecting a State tax of one per cent upon stocks of the company held by the petitioner, In 1854 the Legislature of Vermont passed an act re- quiring the treasurers of all railroad corporations ‘within the State to pay annually into the Treasury of the State a tax of one per cent on all the shares held in such corporations by persons’ residing with- out the State whenever such corporations pay an.an- hual profit of six per cent or more. In 1861 the Vermont and Canada road, by its profits, came within the provisions of this law, and an at- tempt being madé to collect the tax on the stock of the petitioner, he being a non resident, this action-was brought to enjoin the proceeding. On the trial of the cause in the Circuit Court for the district of Vermont Judge Smatiey held the law authorizing the tax tu be repugnant to the constitu. tion of the United States and invalid as to the petl- tioner and as to all other citizens of the United States who are non-residents of Vermont and stockholders In corporations therein. From that decree appeal was taken to this court, where tt 18 maintained that that provision of the constitution which says that “the citizens of each State shall be entitied to all the privileges and immun‘ties of citizens in tue several States” does not prouinie the tax ia question. The construction of this provision, as held: below, con- founds the word “citizens” with ‘the word “resi- dents,” and claims for the citizens of any one State all the privileges and ¢mmunities of the residents in his and every other State, Such a construction 1s unauthorized and impracticable. It 1s the citizen's privilege to vote at elections, but it is not true that ‘2. citizen of any one State oas the right to exercise this privilege in each of the several States of the Union at the same time; and because the laws of the several States confine the privilege of voting to the resident citizens. It 13 not true, then, that when a State allows a privilege only to a resident, and forbids it to all others, that it thereby infringes this provision of the constitution. ‘Ihe Jaw allows the privi- Jege to the resident and not to tho citizen of the State, except as a resident, and therefore it cannot be claimed by cit.zens of other States, tor they cer- tainiy cannot claim more privileges than tie citizens of the State, ‘The ciear, true and unquestionable construcdon of this provision of the constitation 1s that no State by its jegisiation shall forbid to tne citi- zen of auother State any privilege or immunity whieh it allows to itsown. But itis pe ooyeok clear that no State is by anv provision compelled to grant or allow to the citizen of another State what it for- bids tous own. Every State may grant to its own citszeus whatever privileges or immuniiies it thinks proper, and such only, provided it leaves the same 5 be enjoyed by the citizens of the other States on the same conditions and under the same circum- stances. The privilege of young, being confined to residents, Makes no distinction between the citizens of the States. ‘Taxing higher the property in a State belonging to @ non-resident than the same kind of property belonging toa resident makes no distinc- tion between the citizens of the different States. It subjects that les of prop- erty belonging as well to its own citizens ag to the citizens of other States, often some dis- criminating tax, unless they are residents, and it relieves them all alike on their being or becoming residents. ‘Ihe tax complained of in this case 18 laid on that part of the capital stock of which non- residents are holders; butat is precisely the same on citizens of Vermont as on the citizens of other States. It reaches all who are non-residents, and it reaches none who @re residents, of whatever State they are citizens.
