No day is yet fixed for the 1, The quantity of spirits alleged to have been removed is much greater in this than in the Dupuy case. The Alleged McHeury Perjury Case. Mr. McCarthy, counsel for the defendant, moved to have the trial of this case, which is fixed for Wedneaday next, postponed till a later day, in the abscuce of a material and important witness. The Cgurt refused to ake any order in the case, leaving % to hoid its place on the calendar. UNITED STATES DISTRICT COURT—IN BANKRUPTCY. DecisionWhat Constitutes an Act of Prefer ence and Bankruptcy. Before Judge Blatchford. In this case the petition avers that the debtors, while insolvent, did, on or about the Ist of De- cember, 1868, execute to one Francis M. Pendleton @ chattel mortgage on certain tools, fixtures, belting and machinery then on the premises known as the Quintard Iron Works, at the northwest corner of avenue D and Eleventh street, in the city of New York, to secure the sum of $4,000 and interest, pay- able December 2, 1868, with interest from July 1, 1868, and to one Anna P. Rogers a chattel mortgage on the same property to secure the payment of $4,507, and that those instruments were executed by the debtors with intent to give a preference to credi- tors herein named. The answer of the debtors ad- mits the making of the mortgage to Pendieton, and states that it was a to secure the payment of $4,000 and interest thereon, me fo sum having been Joaned to them in cash on or Qbout the 1st day of duly, 1868. ‘The answer also admits the making the morigage Rogers, and states that the same was given 10 ture the payment of $4,507 and in- terest thereon; the said sum having been loaned to them in cash on or about the 1st day of July, 1868. It is also admitted by the respective parties, by a written stipulation, that the mortgages given to Pendleton and to Rogers were given in December, 1868, and that witha a few days the debtors sus- pended payment. The answer avers that the debtors should not be declared bankrupts for any cause alleged in the petition and prays for a trial by the court; but it does not deny thé tusolvency of the debtors in question at the time they made the mort- gages in question, or that the debtors intended to {give preferences thereby to the creditors named in the heb iy oe On these facts 1. is clear that the debtors, being insolvent, made a conveyance of pro- perty with the inten! to give a preference thereby to a creditor, and thus committed an act of bankruptcy ‘within section thirty-nine of the act. SUPERIOR COURT—TRIAL TERM—PART |. - Adjournment of the Court. Judge Monell presided yesterday morning at eleven o’clock, when the calendar was called. There was a panel of 104 jurors.
