I disciaimed any motive but a strictly oilicial one, and cordially lopted his own expressions under that head, Yet Was much surprised to discern in the conversa- tions I had with several persons, joctating. Mr. Wellwood, that it was not considered creaible that ‘any attempt would be made in good fatth to enforce the penal sanctions of the revenue laws in New York irrespectively of persons or parties. Orrics DisrRicT ATTONNEY OF UNITED STATES FOR SOUTHERN Disrricr of New YORK, NEW YORE, Oct, 1, 1868, To THE PRESIDENT:— Str—I have oeen furnished with a opy, of a re- rt addressed to yourself by John M, Binckle licitor of Internal Revenue, purporting to give history of what was done b; rs an order issued it, 1863, directing him to “proceed to the city rooklyn (Eastern Judicial district), — York, and examine certa.n evidence said to be in pos- session of Assessor Weilwood, and report whether, in your (his) opinion, the same substantialiy impli- cates in Violations of law any oilicer of the internal revenue service.” Auy generai criticism as to the manner in which the special service desigiated in this order has been performed it is not in my province to offer, but L Must be permitted to notice this extraordinary docu- ment so far as relates to tue utterly unfounded acca pais aud insinuations against myself contained erein, ‘This gentleman came to this city and commenced & series of investigations, certainly not contemplated by the terms of the order under which he professed toact, and undoudtediy without precedent in the manner in which they were conducted, Without any communicauon with me, whom official courtesy and decency should have impelied him to, at least, advise of his proceedings, he caused a prosecution to be instituted ag against tl re two chief olticers of hisown bureau, an ex-collector and one Daniel Murray, charging them with a conspiracy to defraud the United otaies. ‘This charge was based upon the tesitmony of one man alone, of whose character Mr. Binckley seems to have had Be knowledge and to have taken no steps to acquire i was not till these charges had been made and some of the defendants already arrested that I was notified that any such action was contempla- ted. 1 tuen found that a man, without the slightest authority so to do, of his own motion, had sneaked surreptitiously in.o my district and ‘Attempted, in total ignorance both of law and fact, to usurp functions which your Excellency and the Senate of the United States had seen fit to devolve upon me. 1 might surely have been pardoned if, smarting under tuts wholly gratuitous and unprovoked insult, I had peremptorily refused to have any connection whatever with a prosecution which, it now seems, Was instituted a3 a mere fishing’ inquiry, which might induce “evidence to come forward in the hands of honorable and notabie witaesses.” This admission in Mr. Binckley’s report coniirms the Opinion which my intercourse with him, while it lasted, produced, viz., that he was wholly without legal testimony by which to support or establish the charges which he had made, iknew, however, the sensitiveness of the public mind in regard to frauds in the internal yevenue service, I was determined that 1 would not allow any possible opportunity to bring to pee corrup- tion in any quarter to be defeated through the ignorance or discourtesv of the man who a‘fect- ed to know something of importance. I there- fore waived all sense of the gross insult I had Teceived, and upon seeing in tue papers that his conduct was repudiated by yourself and the Secre- tary of the Treasury | applied to the latter by tele- graph to know whether I was expected to take charge of the Dior geen On being informed that I was { immediately co-operated with Mr. Binckley as cordially as his offensive and arrogant manner would Harts determined that if there was any truth at the bottom of his vague and misty accusations ne persona! feeling of mine should stand in the wa; its development. He seemed to have no idea of the relevancy or competency of evidence, no conception of the re ioe scope of such an investigation as he had He seemed to think that such a prcceoting, Tight legally be used as a drag net with which to rake up any insinuations that scandal or malice might give birth to, in regard to any transactions in the internal revenue service, or any Ollicers connected therewith, whether mentioned in the warra.ts or affidavits in this ease or not. He seemed not to have tne smallest notion of any legal ruies which would confine the investigation to the [ npoogrend charge or particuiar defendants specitied the warrant. | could not pores eee he had any Knowledge whacver of even the simplest principles of criminal law, and | labored in vali to impart any to him. His report displays this utter ignorance of law in a very striking inanner when he says:—‘’fhe hour was coming for a full development of the magnitude of the case and the number of = defendants, to in- clude the Disirict Attorney himself,” A child's knowledge, had he possessed it, would have taught him that the rules of evidence must necessarily con- fine the testimony to be introduced within the limits marked out in the warrant, and that the number of defendants could not be increased in the way he pro- posed, Here, then, our difference of opinion began, and if this man haa, even in his own mind, any grounds whatever for charging me with lack co-operation with hun, tt arose wholly from entert some regard for the long estabi! rules of evi- ence and principles of law, and my unwillingness to peril all my reputation as a lawyer, by following the wholly unwarrantable and absurd mode of pro- ceeding Wuich he desired, and which, without pro- ducing any beneficial result, would have exposed the prosecution and all concerned in it to the just scorn and ridicule of the profession —_ the public. He attempted to compel me to remain, by closing the door upon me, and his violence obi me in self-detence to resort to force. 1 immediate! forge leg to the Attorney General that I woul ne longer be associated with Mr. Binckicy, and de- sired thas somebody else might be designated to con- duct this prosecution. The Attorney General de- clined to relieve me from tie duty, and advised me that Mr. bayer had no right or power in the pre- mises, that he had been Sees “ry by nobody to do what he had done, and that he and not I was tho one to retire from the case, ‘yhis is my connection with this case and with Mr. Binekiey trough the time embraced in his report. I submit to your Exceliency whether my course has been that of a man who dreaded examination into his own conduct, or sought to stifle inquiry into that of others. in view of my official career and recoi and what lam confident would be the testimony every officer of the government with whom I have been brought in contact, I feel that it can hardly be necessary to add to this statement that every in- sinuation and charge Konapend in this extraord! report, in any way aasatiing my official or personal conduct or integrity, is whoily, maliciously and basely false, without shadow of foundation a originating only in the slanderous imagination of the author. ‘The history of the case since abundantly vindicates me. The counsel designated for the purpose by the Attorney General myself, have exhausted all Mr. Binckley’s resources of testimony and sought earnestly to erect the most thorough search tnto all the matters as to which he has affected to have proof.
