Bronson, deceased, Appellants, vs. The Milwau- ke: and Minnewta Railroad Company and a Cross Ap- peal.—Appeais from the Circuit Court for the District of Wisconsin, Mr. Justice Miller delivered the opinion of the Court:— These are appeals taken by different parties upon the same record, It is a record of a suit for the foreciosure of a mortgave on the Western Division of the La Crosse and Milwaukee Railroad, and tho appellants, Soutter an? Knapp, who were plaintiffs in the court below, have up- pealed from the orig'nal decree of foreclosure, ow the ground that it did not ‘nclnde certain property which they were entitled to have sold uncer said mortgage. Upon the questions mvolved in this appeal the mem- bors of the court who heard the argument are equa!ly dvided in opinion, and the decree and orders com- Plained of are therefore affirmed.
