Such largo earnings, they reasonably matutain, cannot be without eect upon prices, because they will add pro- portionately to the real value of the stocks A brisk speculation fora rise based upon th a stato of things will doubtless be experienced befure the year ex- Vir-s; but prices will just as certainly be knocked dows rit ia the habit ef Wall street to resh from one @xireme to another, regardiess of real value, Kt wil b aviation of values @ pretext for a dull when the opportunity errives for a bear Nt have nothing further to say on the Subject; prices, ic 13 opinion, will then simply ve too bigh. noticeable thet a leas bearish fo:log pre vaila Dow (na was appareut @ woek ago, aad that the Genera! tendency of speculation favors a rise, Owing to tho duiness of bucicess in Wall street movey is sgain something of a drug. Before Commissioner Osborne, The case of the United States ye, Eliza Allenbein, ‘who is charged with having falsely sworn, in a petition te bankruptcy, that a certain house im Sixteenth sireet bad been convoyed ty her by one Elizabeth Merey, was calied om yesterday morniug, at ten o'clock. At that hour intimation was made to Commissioner Osborne that Mr, E¢win James, counsel for the defendont, was indis- posed, and conid not attend. The Jornmiasioner a cord- ingly adjourned the further examination of the matter ill Thursday. Charge of Abstracting from the Post Once a Letter Containing a Check tor $1,290. Alfred Rowland, @ young maa about twenty vears of ave, was charged with taking @ letter from the Post Office of this city and embezzting its contents—s check for $1,200, The check had been sent from Washing- ton to the Rev. P, J, O'Toole, The boy found the letter In the Post Office box of Mr, Gildermaster, in whose em- ployment be was. He did not retarn it, but appropriated the letter and ihe check, as sated. The check waa made payable to the order of Mr. O'Toole; but the defend- ant, ag it appeared by the evidence produced against bim, sent the check by letier to the makers, fa Wash- ington, requestiog that they would make it payable to Dearer, as he was not known at the bank, and wanted to getihe money. Tia letter was signed with Rev, Mr, ‘a name. The senders of receipt of thia communication, the matter should at once be placed under investiga'ion. Mr. Gaylor, spe- cia! agent of the department, too the afiair in hand, and after inquiry ascertained that the letter had been by mia‘ake but into Mr, Gildermester’s box, which t# just beside that of Mr. O'foole, The letier sont to Washiug- ton, asking that the mode of paying the check should be changed, was proved to be in the handwriting of the ‘accnged. On thia statement of facts the arrest was mde, and on yesterday the accused was taken before Cominis> sisner Osborn, who committed hin for trial, The case was conducied by Mr. Joseph Bell on theg part the government, COUNT GF BANKRUPTCY. Before Jadve Barbour, Inve the Supplement iry Eraminttion of Michte! Nort n, @ Jwigment Deb‘or.—A motion was made in this case yes- terday for an adjournment of the’examination of Alder- map Norton, the case in which the Jaw reporters of the city preas were excluded trom attendance on Friday Jast. On Saturday a meeting of persons (supposed re- porters) ras held avd resolutions adopted deaonncing Judze Barbour for issuing the order of exclusion, threat- ening Impeachment, &¢. The regular law reporters of all the datly journals yesterday published a disavowal of tho sontiments expressed by tho other parties, Before granting the motion of vesterduy, therefore, Jidge Par- bour read a lengthy opinion, which he had prepared a: a reaponss to th» malcontents, in which he took tho ground that, though "the first — section of the siatnte declares that ‘the sittinga of every court within this State shalt be public and every citizen may freely attend the sane,” proceotings before a judge at chambers aro not ia any legal ronse proceedings tn court, (Miller vs, Rossm. 15 Bow,, 10; Billing va, Vanderborg, 17 Ib., 80; tn 72 Bookhont, 21 ‘b., 348.) The application of the prin ciplo of tho statute in question to proceedings before a jJndgo at chambers, he gays, would ip many cases be excesdingly inconvenient, if not impract cabin; for, to practiva, very much ef that class of busivoss is trans acted at the private residences of the jatgas. A largs portion of a judve’s chamber business is also of suc! a nature that tts immadiate publication would be highly improper—such, for instance, as the hearing and grant ing of applications for orders of arrest, attachment, &c, In the present case it vee npon the ‘appl cation of counsel that the order of exclusion was eranted ; snd in cases whero objection t made to the attendance of tho public and publication In newspapers it was, he held, tho duty of the judge to conmder whethor auch attendance or pnbdlication might be prodnetive of injury to the person about to be examined, or other par- ties, without any corresponding benefit to the creditor or the public; and It seemed clear that he ought, in the reasonable exercise of a sound discretion, to preven’, by & proper order, tho publication of the pracesdings during a progress and until from examivation of the pro comdings he shall be enabled to jndgo whether any i rions, extraneous and irrelevant effect might be pro- duced, In the prosent matter ho bad had no knowied7o of the ature of the facts sought to be d veloped, and had no acquainianco with, nor, to his kaowledge, had he ever seen the debtor. After euch examination, if It ap- peared that questlo .8 of pabiic import transpired, publi- cation would not be improper Ho was convinced that asa jndge, after a careful examioation of the case, he had a legal right to igsne ho an order, Ho was strongthoued in his opinion by consnitation with his brother judges; and it only Temsived for him to say that tho order must stand, ‘The opinion concludes as follows:—I comprehend and fully appreciate the jofluence in the community of the reporters of the pres end the extent to which I may. atthis particular time, ba affected, personally, by the conree they annear by newspapers to bave take: Bat, while I bave the honor to occupy this place, be that time Jong or short, I shall cou'inue to diaghargs my duty without favor, affection or fear, My conecience will not permit me to perpetrate a jadicial wrong; nor, poor as 1 am, can I afford thus to lose the reputation which 1 have been able to acrwire during a life of nearly sixty eara, ? {Nore —The latter part of this opinion was written under the belief that all the reporters of the press in the city had held a mee'ing aud adopted certain resolutions condemnatory of my action tn the premises; since which I have been gratified by the information that none of the regular court reporters of tbe principal Papers were prosent at ench wreting oF participated in its proceedings, but, on tho contrary, disapprova of the same} A motion was then mae to set aside the onter of exclusion, and was deni vA the court stated that Iteconld be considero’ that the ovinion oes renlered on that motion to enable it to go to the General Term, where it will probabiy be appealod. SUPREME COURT—CHAMBENS. The Express Compantos’ Uabroglio=™ for a Recelver. Refore Judge Barnard. Stephen P, Witeriury va, Elmore P. Posse al.~ caso came up again yesterday on the motion for Poiutment of a receiver of the Merchants’ Union Bx- press Company and the dissolution of the organization, The attention of the court was wholly occupied by the reading of which are intended to prove the ompiaint, which has bevn already publ in fall ta the Hekaco, ‘The charges made in these affidavits wero tothe etfect that the company was organized and mana‘ed by tnex- Perienced men; thet the express business of the coun- try was not 40 extensive that it could pay two lines to run over the samo routes; that the defendaats had pledged themssivea to call for ten per cent only of the Stock, whereas piaintiff had alroady paid in twenty-fva, and that a demaud for ten por cent more bad been made; that the company bad engaged men at exorbi- tant shlaries who had formeriy been employed by the American, Adams and other expres: companies at mocerate rates, &o, The case will be resumed thie morning.
