It has no legislative posers, ft eannot amend or modify any legislative acta. It cannot examine questions as expedient or inexpedient, as police * impolitic. Considerations of that sort mast in 1} be addressed to the legislature. The cases bofore us are not of this sor, The legislature has thought fit, by enactments clear of all ambiguity, to im- ‘pose penaliies for unhcensed dealing in lottery tickets ma tn liquora. These enactments, so long as they stand ‘enrepealod and unmodified, express the pubiic policy in wegard to the subjects of them. The proposition tua: they are contrary to public poiicy is therefore a contra- @icion in terms, or it is intended asa denial of their ‘expedicnoy or their propriety. If intended in the latter sense, the proposition is one of which courts cannot take ‘cognizance, We come now to examine a more serious objection to the legislation of Congress in rela- fen to the dealings in controversy. It was argued for the defendants in error that a license to carry on a par- tieular business gives ag authority to carry iton; toat ‘the dealings in controversy were parcel of the tuiernal trade of the State in which the defendants resided; that ‘the internal trade of a State is not subject, in avy re spect, to legisiation by Congress, and cao neither be Treensed nor prohibited by its authority; that licenses for wuch trade, granted under acts of Congress, must therefore be absolutely null aad void, and, consquently, ‘that penalties for carrying op #uch trade without such Hieense could not be constitutionally imposed. This series of propositions and the conclusion in which it ter- minates, depend on the postulate that a license neces early coniers an authority to carry on the licensed busi- ness. But do the licenses required by the acts of Con- gress for selling liquor and lottery tickets confer any futbority whatever? It is not doubted that where Congress constitutional power to regulate trade or intercourse it may regulate by means ef licenses, as well as in other modes; and, fm case of ' such regulation, a license will gi to the liconsee authority todo whatever is authorized by ite terms. Thus Congress, baving power to regulate com- merce with foreign nations and among the several States, ‘and with the Indian Cig Poo may, without doubt, pro- wide for cranting — licenses to pilots, Meenses to trade with the Indians, and any other licenses: meceasary and proper for the exercise of tha extensive power; and a same observation which the granting of licenses may be incident, All sech licenses confer suthority and give rights to the neon But very different considerations apply to the Saternal commerce or domestic trade of the States.
