Wynns vs. Francis Vinton. —The following i an abstract of the written points of argument, ae sub- mitted to the Surrogate yesterday by Mr. A. W. Bradford, of counsel for Rev. Dr. Vinton, The argu- ment is in opposition to the reopening of Dr. Vinton’s accoants as executor, trustee, &c. :— Thomas Wynns died in February, 1851, in gts, bos Brooklyn, and by bis will Edwin Coffin and Dr, Vinton were appointed executors, testamentary trustees and guardians of his infant child. In consequence of the absence of the executor Coffin from the Umted States, and finally by reason of his discharge as trustee, the entire management of the estate, the care of the child, &c., devolved upon Dr. Vinton. The ward lately attained age, and Dr, Vinton applied for a final settle- ment of his accounts, for a discharge, witb a prayer that another trustee might be substituted 10 bis place, Thig trust lasted over sixteen years, sud Dr. Vinton acted in a three fold capacity, In addition to ordinary execu- tory duties there was @ trust to accumulate the income beyord the sum he deemed proper as an allowance to Miss Wynns, and, in case she died without issue, to pase over the whole estate to the Smithsonian Institute.
