Ferris was mach depressed in spirits, and tt no ordinary effort on the part of the Sisters to make dim feel resigned to his fate. To the ordinary looker on be was a man much below the ordmary peoner lle and not calcnlated, either by his appearance or raation, 1 luapire the Visitor with either sympathy "Be professed In words to be rerigned to his fae uneasy wwanner showed that his mind wos i) aiease, and thay his thoughts were still with t Even ap to yosterday he entertained the hope that the Governor would cominute bis sentence to im- jsonmont for life, notwithstanding bis counsel, Mr. F. imtaing, Jr., had previously aasured him that there was ‘ao chauco Whatever of executive clemency. ‘Mr. Figaniere, the Portugese Consul, who bas been uotiting in lis ‘efforts to procare a commutation of the sentence, tolegraphed from Albany vesterday the result af bis fal interview with the Executive. Mr. ted that as capital punishment had long ished in Portugal the prigoner would not have been & to death if he had committed the murder in his own country, He thought, therefore. that ‘wo greator punishment Should he meted out to Ferris. than the laws of his native country dei ‘and hoped that, considering the relations which existed be- tren the Danited States and P Governor Fenton would grant his petition. The utive firmly refused to interfere in tle premises, however, and informed Mr, Vigauiere tha’ the sentence of the court must be exe- ‘ented. Ferris wos apprized of this unwelcome piece of news at an early hour in the morning, and the result was that he wae low spirited and extremely nervous @oring the remainder of the day, PERRIS’ CONDUCT IN PRISON, Ever since hix sentence the prisoner has conducted himself iv an vnrely manner, giving bis keeper anusual trouble by his continual ‘complaints about bis food, sleeping accommodations, &c. There was not the sigbtest cause for grumbling; but he indulged in the sonstantly, and proved a very unpleasant person & have anythifg to do with, On one occasion the keep- ers, suepecting that he contemplated suicide when the worst caine Lo the worst, determined to make a thorough saminacion of his cell. After a long and tedious search a yuauiity of strychnine was found ingeniously concealed in his jookingglass. On another occasion he was de- teoted eating tie heads of Ineifer matches, which he had mseriod here and there {pn an apple, so as to divert sus. picion and at the same time render ‘the fatal dove more polatable, Ho had swallowed a small portion of the poaoned fruit when the trick was discovered, but not soiteient to cause any unpleasant consequences, He has doen under close watch (rom that time until the present, ronderin’ any further «ttempt at suicide a matter of ex. treme ditiiculty STORY OF THE MUKDER, ‘The murder of which Ferris was convicted was com- mitied on the 12th of Soptember, 1864, under cireum- stances of the most peculiar a'rocity, [t appeared upon trial that Mary Perris, the wife of the prisoner, with ber three chifdren, occupied apartments upen the top ‘Boor of 5 tenement horse at No. 31 James street, The prisoner was a man of intemperate habits, and in conse- quence of his cruel treatment to his wife she was com- petted to live apart from bim. Some time before the worder Ferre nvado an asaanit opon his wife with an x@, causing such injuries that ber life was despaired of, ‘ter her recovery she prosecuted the prisoner, and he ‘was sent to the Penitentiary for six months, his term of imprivonmoent expiring a few days before the marder, Spor the 9h of September, 1864, the prisoner camd to the residence of his wife in James street and inquired if she was howe, Hit wite being out at work ho left, and woni tom number of places where be thonght hd wan working, and npou beng informed that. she war not there Perris would jal) down upon his knees and swear by the Virgin Mary that he would kill his wife Mary before nine o'clock chat night, He retnrned in the efiernoou to James street, when he took a large knife fron bist pocket ano commenced sharpening it upon whe cary stone with te intention, ag be declared, sing the weapon upon ihe person of hie wife, but not finding fer ut home he left, Tn the evening, when Mrs. Ferris aathe home from work, she was informed that ber bus- band was out of prison and bad been to her rooms shrediening to take her life. Fearful of violence the Pour woman bronght her bed down stairs and made Scangements to pass the night with one of the neigh- bora, She had scarcely pleted the change avd put ber ebildren to bed when Verrle reappeared armed with ap axe, apd proceeded up stairs in search of his victim. Wmding ber door locked he broke it in with ae. axe, and not finding bis wife as he capectea tars menced to revenge himself upon her by jex all the furniture. Attracted by the noise, 4 Perris went up stairs aud expostulated with her huahand pon bis insane conduct, when he flew ai ber like a hend and dashed ber brains out with the axe. The cries of “murder” and “watch”? soon brought the Fourth preciuet police Lo tbe spot, and Ferris was arreated before be could leave the house, When asked why he had Klee his wife he rade no reply, and manifested a die- pemtion to give the police ag little information as ible. On the trial his counsel get up the defence of insanity, ‘vat the evidence wholly failed to sustain the theory. The prison physictans both agreed that he was sane, and said thet in tue daily contact with him they never suspected him to be anything other than a pervectly rational belng. The jury having promptly convicted the prigoner, Recorder Hoffman seutenced him to be mxecuted the Ith of Apri, 1865. A writ of ror and stay of execution which was argued Yefore the Court of Appeals gave the prisoner # vexpite of nearly year, In June last he was resen- and the T7th of August wae the time fixed for his execution, Application was then made to Governor Fenton to coimute the sentence, bat he refused to in- tertere. Ferris’ spiritual advisers then urged for a re- apite, on the ground that the prisoner wae not ina fit oondition to die The Governor grantod their request, veprieving the condemned for two montha, but assured vem that when the time was up they need not look for y farther clemoncy.
