And in taking this action, may it please the Court, I desire it to be fully understood—as representing this government on this oceasion—that proceedings will be laxen in such a manner, and before such a tribunal, that wharo, at least, terrorisin will not pro- Vent witnesses from giving their testimony in a case of thiskind. It is a notorious, a Ce ee! an ad. mitied fact that the neutrality laws ofthis’ government have been openly, publicly violated by this defendant and bis conts+res and coadjators. There 1s no dispute upon that point. There can be none, And it is the duty, as it is the intention, of this government to see that ‘her nationa! obl gauona shall be maintained, and that ther laws of noutrality shal! nut bo viotated if that caa be prevented by any action upon .thels part. And in tak ng the coarse I have indicated I want it fully under- stood that these vidlations of thia Jaw of our government sin be punished, and that every effort shail be made to see that th* pational obiigations are fulfilled and that the violations of th:s law shalibe punished upon every party who has violaied it, no matter how high his ren or how low hig station. I, therefore, if your Honor please, in view of the statements 1 have made, and in viow of the peculfar ciroumnstances surrounding this case, Withdraw the present prosecution sga.ust the defendaat in this cage, OBSERVATIONS BY MR. BPKUIAL TELEGRAMS TO THE NEW YORK MERALD. Mostesat, June 16, 1866. All the Fenian prisoners have privately left the city for St. Armand this morning, Mr Ramsay, Queen's counsel, representing the Attorney General for Lower Canada, waited upon Mayor Starnes and directed him to hand the prisoners over to Colonel Ermatinger, a magis- trate of the county of Bedford, where they were cap- tured. The object of this transfer is that they may be identified, and the depositions of witno-ves living in the vicinity taken against them in regular course, Owing to the absolute privacy of the transferral there was no popular excitement. After the depositions are secured the prisoners wi!!! probably be taken before the Attorney General at Ottawa, with a view to his deter miuing how much of a case be bas got, immediately after which the mode of trint will be seitied npon and the time and place indicated.
