A number of liquor dealers assembled at Police Head- quarters yesterday morning to be beard before the com- mittee of the Excise Board. Many of those present were licensed to sell liquor, but the captains were compelled to withhold their endorse- ment from the applications on account of the sur- rounding circumstances, when on investigation they proved not to be so bad as represented. The question was Whother au estate, by implication, had been created in Jobn Hover, Jr., thereby rendering certain dispositions by the will void, as contravening the statute of perpetui- ties. This Court held that to devise an estate by im- plication there must be so strong a probability of such an intention that the contrary could not be supposed, That if the language of a will is susceptible of two construc. tions, by adopting ove construction it would be unlawful, while if the other were foliowed it would be Inwiul, the latter interpretation should be given. The Court held that in this case no estate was given to John Hover, Jr., by implication, and affirmed the jndgment of the courc below. Marine Court, Before Judge Alker, An 2ction was brought by James McDonald against Captain Arey, of the schooner A. Richards, to recover $500 damages, for injuries received at the hands of de- fendaht. McDonald complained that he was struck on the right eye by the captain with a piece of mahogany, ‘and that in consequence of this blow he lost the use of his eye. He said he was picked up by Captain Arey, with rae othors, from & wreck which Coe Oa CRanelapaer in Mexico, The schooner sailed for New York on the 12th of March, and plaintiff and his shipwrecked com- panions paid $60 for their passage in her. When they were four days out Captain Arey wanted them to go on duty, as the rest of the crew, and ordered plaintit! to serape one of tho ship's boats. Plaintiff remoustrated, when the captain struck him and inflicted the injaries above mentioned, ‘The defendant being absent there was no defence set up, and Judge Alker gave a decision in favor of the plaintiff, awarding him the full amount he sued for.
